If cannabis is legalised will those who have been charged for it be released?

Hey guys,

I recently read on the news that verious US states are making moves towards legalizing cannabis, and it got me thinking: If a drug is legalised - say for example cannabis - will all those who were charged for related offences be released from jail or prison? I can't think of another time when law was changed to make something legal, so I'm not sure how this would work in that respect.

Not necessarily. They still did something illegal while it was illegal. Let's say it's legal today and there was someone who went to jail last week because of it... well that person still did something illegal... it was still against the rules.
Hope I explained that right.

I'm not saying it's right or wrong, or what would happen, just offering another perspective.
 
Pretty sure people with booze weren't released from prison after prohibition ended.

Two states have legalized cannabis.

Not happening. I enjoy a lot of crime and legal shows (not the fiction but real life stories) and I've seen a few times when they have to use sentencing guidelines in effect when the crime was committed (sometimes 20 years ago). Now I admit that may be a Federal thing and States may differ but I think generally if you did it when it was illegal, you have to do the time.
 
states are legalizing it slowly and so far the government hasn't intervened. yet. that's the good news.

on a federal level marijuana is and will still be illegal for a long while; the people behind bars for it will stay there until their sentences are up.
 
Which is totally false. Only two USA states have legalized cannabis so far, which includes Colorado and Washington State, but no other states have legalized cannabis so far.

Arizona has a medical marijuana card. How is than not legalized?
 
Yeah man legalization= police encounter while carrying results in no legal action. Getting caught with bud without a card=charges coming your way.
