Got a good criminal lawyer (nsw)?

Long story short, friend got busted with five (5) pills at *
2 in one bag, 3 in another, all for him.

Weighing in at 4.9grams (bullshit - I think their scales are busted).

Wanting to know if anyone in NSW can recommend a good* criminal lawyer; if you don't feel comfortable with posting details here you could PM or email them to me.....

* Personal experence preferred, but word of mouth is ok

4.9g is bullshit, that's more like about 15 or 16 pills weight, anyways the way they do it over here (WA) is they bust you on the actual weight of the drug they're busting you for, say the pills are 50% mdma and they weigh 1.5g then they'll bust you fot 0.75g mdma, which is fuck all, maybe a fine and a CSO or at worst and ISO and a curfew.

Make sure he requests that some of then be sent to an independent lab for testing, this'll cost about 100 bucks or so, but well worth it.

He won't really have anything to worry about until you start getting around 12g+. Even then, with PGC and a good excuse it's still only likely to end up in a suspended sentence at the worst.

I doubt u need a good lawyer, i mean 5 pills isnt really that much. My friend got caught with 10 pills (all duds btw) and he was granted unconditional bail. No jail time no probation.

Err...if someone is requesting legal assistance, it's hardly appropriate to assume you know their situation. The person could have a job where even going through the diversion courts could have consequences. It also could be someone with previous convictions. Or perhaps it's simply someone who wants to fully understand the implications of pleading guilty (or not). Many other possibilities.

IMHO, seeking legal advice is the best move anyone can make when facing drugs charges.
 
Pay the $200-1000 and go home... try not to get busted next time.. I doubt this will even show up on their record? Just goto court, or maybe they'll even forget about it... Im assuming they have sent back test/lab results and it is going ahead tho?

The Drug Misuse and Trafficking Act (NSW) states that admixtures are to be treated as if they were pure. That is, if you have pills that are 10% pure they are to be treated as 100% pure for the purposes of determining the weight for classification.

Shit rule, I know, but you can see the rationale behind it. If you're trying to buy pure drugs, buy crap ones and get caught, why should you face any less time than someone who has pure drugs?
 
Clearly people want the most from their drugs.

Say that all pills cost $35. What would people want: a pill that is 25% pure for $35 or a pill that is 75% pure for $35? Clearly the latter is three times better, for the same price. The only rational decision is to prefer the latter, and indeed this is what we see. Pills sell for approximately constant price that has nothing to do with purity.

If you want 100% binder, why wouldn't you go and buy methylcellulose? Why spend $35 on something that could have been easily replaced with a sugar tablet? Sorry, but no court would ever accept that - with good reason.
 
hey swifty - I'm afraid you're wrong! The total weight on which you are charged in WA is the total weight of the pill, ie active ingredients PLUS the admixture. Speaking as someone with more than a passing interest in the issue, and with a high distinction in the criminal law university unit that deals with drugs etc, I'm 100% certain on this one. =]

Yes I know that it is bullshit, particularly as most mdma tabs would be at best 100mg MDMA and 400mg filler/'admixture', but that's the law!! :(

In WA under 0-2000mg will get you possession (prob 0 to 3-6 tablets depending on the individual weight); 2000mg to 28000mg will get you possession with intent (prob 3-6 to 50-90 tablets depending on weight); 28000mg + will be trafficking.

The key, if you're busted with say 5-20tabs is to *prove* to the court that they were only for personal use. Basically the burden of proof is reversed once you get over 2000mg/28000mg. This is difficult but if you can demonstrate a history of high-level pill use (ie friends willing to testify that you'll chomp six a night, etc) you might get away with possession.

BTW no way will anyone get sent to jail for six pills, unless they have a suspended sentence or something outstanding... that said, a criminal record can have extremely serious consequences. That's why ya'll shouldn't be doing drugs, k? :P
 
^ I agree re the six pills thing. The legal system realises that gaol isn't the place for someone with a few pills. An opinion from a barrister I know is that even for multiple offences, so long its only a few pills you won't go to gaol. Doesn't mean they won't give you a suspended sentence though
 
Does a suspended sentence give you a criminal record? and if you only have posession and not a sale or trafficking charge, does it still make life difficult when entering certain countries?
