Opioids felony for posession with prescription

me & my boyfriend got arrested on monday night.
i got a misdemeanor for being under the influence of a controlled substance(oxycodone) and he got the same thing PLUS a felony charge for being in posession of a controlled substance. but he has a legal prescription, which i'm sure he got from a dirty doctor. but the script was legal and he had his bottle on him and everything. although we didn't get the pills from his bottle, they are the same pills as marked on the bottle. will his ffelony then be dropped because of the prescription? or how does that work... just curious. his first court date is today and i cannot attend. he has been in the county jail ever since. please help, i'm worried about him.

I would talk to a lawyer and delete this post. The pills were all from his prescription, right? hint hint...
