Feds Move to Throw Pot Smokers in Prison for Impaired Driving

Did you smoke pot last month and drive a car this morning? Obama wants to arrest and incarcerate you.

If you smoked marijuana last week or even last month and you drive a car, you may be sent to prison under new guidelines drafted by the federal government.

The Obama administration released its National Drug Control Strategy guidelines last week. http://www.whitehousedrugpolicy.gov/publications/policy/ndcs10/ndcs2010.pdf The federal government wants all of the states to adopt its authoritarian and draconian diktat and expand the drug war. From the guidelines:

Encourage States To Adopt Per Se Drug Impairment Laws [ONDCP]. State laws regarding impaired driving are varied, but most State codes do not contain a separate offense for driving under the influence of drugs (DUID). Therefore, few drivers are identified, prosecuted, or convicted for DUID. Law enforcement personnel usually cite individuals with the easier to prove driving while intoxicated (DWI) alcohol charges. Unclear laws provide vague signals both to drivers and to law enforcement, thereby minimizing the possible preventive benefit of DUID statutes. Fifteen states have passed laws clarifying that the presence of any illegal drug in a driver’s body is per se evidence of impaired driving. ONDCP will work to expand the use of this standard to other states and explore other ways to increase the enforcement of existing DUID laws.

Cannabis metabolites can remain detectable in the urine for up to 100 days or longer for a regular cannabis consumer and up to fifteen days for the casual consumer, according to NORML, the marijuana advocacy organization. http://www.opposingviews.com/i/obama-drug-policy-smoke-pot-months-ago-get-a-dui In other words, even if a pot smoker is conscientious and does not drive while intoxicated, that person can be arrested and convicted for DUID days or weeks after consuming marijuana. It would not matter if you are sober as a teetotaler — if THC molecules are detected with a urine or blood test, you are probably going to prison. You can kiss the right to vote and own a firearm sayonara.

In 2007 there were 14.5 million current users of marijuana in the United States, compared with 14.6 million in 2002, while the number of Americans who have used marijuana increased. http://www.alternet.org/drugs/102246/drug_czar_fails_spectacularly_at_cutting_marijuana_consumption/

The following states enforce “zero tolerance” draconian DUID laws:

Arizona: Zero tolerance for cannabis metabolites, mandatory 24 hours jail, up to 6 months upon conviction.

Delaware: Zero tolerance for cannabis metabolites.

Georgia: Zero tolerance for cannabis metabolites, mandatory 24 hours jail, up to 12 months upon conviction.

Illinois: Zero tolerance for cannabis metabolites, up to 12 moths upon conviction.

Indiana: Zero tolerance for cannabis metabolites, up to 60 days upon conviction.

Michigan: Zero tolerance for cannabis metabolites, up to 93 days upon conviction, vehicle immobilization for up to 180 days.

Nevada: 15 ng/ml for cannabis metabolites.

Ohio: 15 ng/ml for cannabis metabolites, mandatory 72 hours in jail, up to 6 months upon conviction, 6 month to 3 year license suspension.

Pennsylvania: DUID for cannabis metabolites, amount unclear.

South Dakota: Zero tolerance for cannabis metabolites for persons under the age of 21.

Utah: Zero tolerance for cannabis metabolites, mandatory 48 hours jail, up to 6 months upon conviction.

Obama’s new guidelines will criminalize and add to the system hundreds of thousands of people and add thousands of people to the prison industry slave labor complex. In 2007 an American was arrested on marijuana charges every 36 seconds. Obama will increase this criminalization rate significantly.

DUI checkpoints are on the rise around the country. In California, for instance, the state increased grants in 2009 by 47% for DUI checkpoints, including “roving” DUI patrols. http://www.duilawyerorangecounty.com/blog/dui-checkpoints-roving-patrol-alerts 2010 was predicted to be “the year of the Checkpoint” in California. In California and elsewhere, these unconstitutional checkpoints are a highly profitable business for the state, netting billions of dollars every year.

Behavioral impairment is not the issue. Expanding the criminal class is the issue. Government will never rest until it categorizes most of us as criminals.

Don't you just love the Government? They are always doing so many things to help improve our lives, benefit our future, and make things easier for us in general. Without the Government, i don't know what i would do? who would be there to criminalize the majority of the population in one way or another? who would be there to spend Billions upon Billions of OUR dollars on things like imprisonment, Oil Wars that (might) benefit today but certainly not tomorrow, oh and how about that 6+ billion for EACH type of nuclear missile system, while simultaneously "campaigning for a nuclear free world? Certainly without the government to make these choices for us, we would all be doomed.

So now what's coming, checkpoints to get a sample of your piss? Maybe while they're at it they will check your DNA for certain behavior genes before they send you to a reeducation facility.

I don't drive, but I'm glad I left that country.

"Zero tolerance" doesn't sound like it'd stand up in court. How would they prove impairment?

Yeah show me these studies where pot doesn't impare driving.

Im assuming they will probably bring in random drug tests for drivers like they do here in Aus. You lick a card kind of a thing and they plug it into a computer. It tests for current THC levels and includes a threshold for passive pot smokers (small amounts and your free to drive). I think the RDT tests for amphetamine, pot, opiates, benzos and im not sure what else.

Do senators or presidents have to lick a card? After all, they're in the driver's seat of an entire nation and they are guilty of authorizing the murders of far more people than impaired drivers.

(not against you)

All of those are available by prescription. So what would you be punishing if you exonerate the person who took prescribed dronabinol 2 days ago but prosecute the person who smoked home-grown weed 2 days ago? Certainly not impaired driving.

It's a sumptuary law.

I don't know about any studies, but from many of my own experiences and basically the experiences of every single person i know that smokes pot (which is a LOT of people) that not only does being high on pot not impair your driving, it makes you a BETTER driver. Obviously if your ripped out of your skull thats not safe, but driving after a couple beers is safe while driving after 10 beers isn't, so whats the difference? My argument that it makes you better is based off of the fact that when you are driving around sober, many people often find themselves thinking "wait, how did i just get here?" because you litterally drive on auto pilot sometimes. (referred to as "highway hypnosis" or something i believe. Anyway, being high on pot, to an extent, makes you better at driving because you are consciously aware of every single move you make. Basically you are more aware of your surroundings and what you are doing. I firmly believe this to be true as well as everyone i know. And like i said, to an EXTENT. No different than alcohol, theres a point where your obviously to high, but below that point improves your driving. IMO.

It's getting worse :X They just keep taking away our rights, left and right. It's our fault for voting these morally-bankrupt assholes into office, right? Wrong! No matter who we vote for, it doesn't matter, because they are all chameleons and will say anything to get into office, the fuckheads.

This world is so fucked up, and nothing short of a planet wide catastrophe is going to change things. It's no wonder people look to drugs to ease the pain of living here. But even our freedom of mind is constantly being taken away from us.

Yeah show me these studies where pot doesn't impare driving.

Here's a couple:

"You keep on using that word. I do not think it means what you think it means."

To say that the presence of THC metabolites in a person's body represents "per se evidence of impaired driving" is a simple, straightforward falsehood. It is just not semantically true. If you look up all of those words individually, and them put them together into that sentence, the sentence is a verifiable lie. It's really quite simple.

Now all we need is to live in a world where that actually matters.

I could have sworn I posted this, but I guess I read a different version of it and didn't post it. :|

I have no problem with punishing impaired drivers, but they need to come up with a way to prove that the driver is impaired at that moment in time. Checking urine doesn't do that.

And why stop there? Why not bust drivers that are tired, that are stressed, etc? I'm pretty sure I've seen at least one study that proved that drivers that are sleep deprived are as dangerous, if not more so, that drunk drivers at .08.

Also, they need to make the DUI laws more severe, at least the monetary fines, and lower the alcohol threshold. An level of .04 and an automatic fine of $5000, plus all the fees, that will be automatically deducted from your wages. Add in license suspension and we have a decent start. There's absolutely NO fucking reason why anyone should drive impaired.

Indeed, they did. The standard deviation of lateral position was affected the most, which I can't understand since I never experienced such a problem. I was always able to maintain proper tracking. The worst thing I did was forget to give a lady her right of way, which is bad enough and could have caused an accident.

Pot doesn't affect driving as bad as alcohol or sedatives, according to the studies, but you're right, it's still significant. People simply shouldn't drive impaired, whether it be drunken, drugged, sleepy, with a cell phone in their ear, a sloppy burger in their lap or otherwise.

Man I think this article may be bogus, I've been driving high all week and they still refuse to give me my free trip to prison...
