F.D.A. Says It May Ban Alcoholic Drinks With Caffeine

WASHINGTON — Top federal food regulators threatened on Friday to ban caffeinated alcoholic drinks unless their makers quickly proved that the beverages were safe.

In a statement, the Food and Drug Administration said it told nearly 30 manufacturers of the drinks that unless they could provide clear evidence of safety, the agency would “take appropriate action to ensure that the products are removed from the marketplace.” Officials did not say how long such a determination might take.

The drinks, which combine malt liquor or other spirits with caffeine and fruit juices at alcohol concentrations up to about 10 percent, have become increasingly popular among college students. In a news conference, Dr. Joshua M. Sharfstein, the agency’s principal deputy commissioner, said consumption was associated with increased risk of serious injury, drunken driving, sexual assault and other dangerous behavior.

The F.D.A.’s action was prompted by a letter from 19 state attorneys general, who wrote to the agency expressing concern about the products’ safety.

Caffeine may lead people to underestimate how drunk they are, giving drinkers a false sense of confidence that they can perform tasks they are too impaired to undertake.

After pressure from the attorneys general, Anheuser-Busch last year eliminated the caffeine and other additives from its flavored malt beverages, Tilt and Bud Extra. And MillerCoors agreed to stop selling its product Sparks.

The brands under scrutiny — which include Joose from United Brands and Four from Phusion Projects — are being marketed to young people with social marketing tools. United Brands, for instance, has a Twitter site to market Joose.

A call to United Brands was not immediately returned.

Federal law requires makers of products that combine common ingredients to prove that the combinations are safe.

“F.D.A. is not aware of any basis that manufacturers have to conclude that the use of caffeine added to alcoholic beverages is generally recognized as safe,” Dr. Sharfstein said.

The Center for Science in the Public Interest, an advocacy group whose lawsuit against MillerCoors over its marketing of Sparks preceded the company’s decision to stop selling the product, praised the F.D.A. action.

“For many years,” the group said in a statement, “federal regulators have stood mutely by as these potentially dangerous products, which resemble nonalcoholic energy drinks in many ways, gained in popularity among young people.

“In fact, emerging research suggests that the young consumers of these products are more likely to be the perpetrator or victim of sexual aggression, to ride with an intoxicated driver or to become otherwise injured.”

Whoever drinks those nasty red-bull alcoholic drinks obviously doesnt care much about their health anyways, those things got so much damn sugar in them its nasty.

More government bullshit. Holy crap, it only gets worse. Just leave people alone! Ban the FDA. Soon it will be 1776 and that failing it will be 1984.

I always pour a shot of rum in my coffee. Will the SWAT team bust down my door, tazer me and haul me off to prison?

What the fuck?! Since when was drinking any form of alcohol "safe"? Don't get me wrong, I love a drink probably more than the next guy but how are the companies supposed to prove any beverage containing one of the most drugs ever created is "safe"?

Okay, so I can't buy a Sparks, but I can go order a vodka red bull at the bar... WTF is the point here? I know people that regularly pop a caffeine pill before going out to the bar anyhow... soooo dumb...

R.I.P Sparks .. Loved those in college. One of those and I cut my drinking in half for the night.
I don't remember side-effects including rape & pilage .. Perhaps the insidious beverage also erased my memory?

Note to self: Seek and Destroy the "Center for Science in the Public Interest."

What kind of bullshit biased public-action group is that? The name alone implies the bastardization of Truth (Science) for private political aims.

And now the Food and Drug Administration is banning things for non-scientific reasons .. First flavored cigarettes, for supposedly being targeted to minors; now this, under the guise of rape/DUI prevention?!

Apparently prosecuting existing crimes isn't cool these days .. Gotta protect the minority by oppressing the masses instead.

Might as well merge the FDA with the DEA, since both are now agencies operating under purely subjective ethical mandates.

If the FDA can't trust adults with legally-approved poisons, things do not bode well for the liberalization of draconian Federal drug laws, even cannabis ..

Hey FDA, gluttony is a deadly sin, and the obese disgust and infuriate me .. Why not ban meat, artificial sugar, and saturated fats?
Oops, don't want to step on the lobbyist's toes .. Such deadly vices are integral to the American Dream ..

Eat a bullet, nanny-regulators .. Oh wait, then the FDA would see it fit to ban firearms outright.
OK I'm done :X
