Friday I came home to a soaking wet sludge of paper and manilla folder on my porch. Upon further inspection I had apparently been "served" with papers summoning me to court Wednesday the 14th because my ex-boyfriend, and father of our 6 month old, is trying to get full custody.
He did this a month ago, and the last month he has been hiding this from me, knowing I'm broke and have no money to hire an attorney myself. He said to me, "It states you can only have her every other weekend, but I'll let you see her more" and about the CHILD SUPPORT that he wants from me, he said, "Oh, I'll only ask for the minimum amount."
I work full time; I'm a school teacher. I have a 5 year old daughter who lives with me full time (her father is not in the picture at all). I have my own 3 bedroom place, a reliable car, insurance for the girls, etc...
He lives at home with his parents, doesn't have a job, etc.
You would think, "He doesn't stand a chance!" but that is so apparent that I'm wondering "What does he have on me???"
Since he doesn't work and stays home all day at his parents house, he watches the baby while I work. I used to think "That's the least he could do", but now I realize that that was a huge mistake.
It took 5 or 6 times of him not being awake when I went to drop her off, and him making me late for work to say, "Fuck it, you keep her every night of the weekday. You don't work, and you consistently can't wake up for me to drop her off to you, and you've made me late too many times."
So I would get off work, get home around 5, pick the baby up, keep her until around 9 or so, and bring her back to him. I'm a school teacher, as I've stated, and I knew this was temporary, because summer was less than 2 months away and I would have her all the time anyway.
My mistake though, because he's probably logged how much I keep her, and how much he keeps her.
I have so many questions, and need so much advice that I don't know where to start.
My parents are going to help with with an attorney. Tomorrow i have to go and find one, because Wednesday is the court date! How I can get the summons on a Friday (which wasn't even handed to ME, is that legal?) and have to be at court less than a week later! I have no defense!
I'm going to get a lawyer tomorrow, hopefully. And they can hopefully get a continuance on the court date.
Here's my question: is there any way he can get full custody??? He probably has text messages that are quite mean coming from me. I'm definitely preparing for the worst: He'll get full custody of my baby, my little 6 month old baby, and I'll only see her every other weekend, or when he is feeling generous. And I'll have to pay him to sit on his ass at his parents house all day.
I have never in my life felt so hurt, angry, helpless, etc.
I have the baby now, and though I don't want to keep her from him, I'm terrified to take her back, even though he swears he can't legally keep her from me.
I live in Mississippi by the way, we were not married and possession is 9/10ths yadda yadda.
ANY HELP, ADVICE, ANYTHING WOULD BE APPRECIATED. I haven't slept in two days, today is Mother's Day and all I can think about is him and how he is royally fucking my life.
