Evidence of dealing

Was a genuine answer PT.

Yes you can get done without drugs on the table, but it's a much harder prosecution. Is why the Mr Bigs never actually dirty their hands.

I know it was a genuine answer lol. I just realised that my original comment might have looked like I was saying "What can you get done with if you're not in possession? FUCK ALL" which wasn't the case. I'd be up for taking my chances with a half decent lawyer if they had no drugs to show. Still gonna hurt the bank balance though, innocent or guilty.

That's one of the major travesties in our justice system - If you are deemed to be capable of affording a lawyer then the cost of fighting a court case is all on you. Even if it turns out that the charges were a pile of shite & you're found 100% innocent.

My mate got done years ago with tanning the window of the local Indian restaurant. He clearly didn't do it. Everyone knew it wasn't him. He even explained in great length to the cops that arrested him why it couldn't possibly have been him. The case was as weak as it possibly could be. Still went to court. Still cost him a couple grand in lawyer fees. Obviously found not guilty. He knew that from the start but it cost him a small fortune (relatively, to the likes of me & him, when we were 18/19).

It looks like it's not as simple as that, it does depend which court you're at but the division isn't between civil and criminal cases, it's between crown and magistrates courts, and if you use legal aid and win you should get all your contribution back, but not if you fund it privately, it says here. That's in England and Wales. I've not looked into Scotland yet, no doubt it's different. Well it's certainly different, we don't have magistrates or crown courts for a start.

Everybody ought to read the case law on conspiracy and incitement before they ever send a text, the wrong kind of utterance is a crime in common law and rightly so.

Would somebody need to be caught in possession in order to be caught dealing or would text messages be adequate?

Is this pertinent to the situation in your other post in the darkside? Is it something additional that has happened? (If you don't mind saying)

I think you will be fine. The shady asshole that you spoke of in other thread (if it is same situation)is full of shit. Do you even know he for sure turned over that facebook conversation? Take some pressure off yourself and quit stressing so much. It is very unlikely that it would lead to arrest. Though you discussed heroin and dealing you didn't name specific times and places to meet etc and is far as the cops or anyone else knows you were just talking shit (that wasn't true) to make yourself look like you were the man! They have no evidence that you actually DID anything, just a punk talking shit (as far as anyone knows).

Even if you actually by some small chance were arrested I am sure agood attorney would get it thrown out bnased on those facts. With your family it may be a different story cause you would have a lot of explaining to do but you will get past it.

Take care and quit stressing yourself out so much!

Oh aye, prosecutions for conspiracy and the like are very very rare and unless you are a Pablo Escobar let nothing disturb the christian tranquillity of your life.

You would get charged with "Concerned with the supply of Drugs"... Happened to a mate of mine before and she got a relatively low fine and that is all...

yeah you need to get the other side using it, when you set up a secure session it sends a key exchange message first

they do an app to encrypt voice aswell, haven't checked it out yet though.

Haha brilliant. Just an update o the situation: nothing came out of it. The cunt is going around telling people about how he gave information Had no idea being a rat gave you bragging rights but there you go. The way things are it's unlikely anything will happen - he has a record, I don't. Also the cops know the whole situation that resulted in him ratting one me so they could well turn a blind eye to it. They have no reason to believe that I deal other than what he is saying and even if I ended up in court I happen to be related to one of the best solicitors in town for this kind of thing. So I suppose I have little to worry about.

Excellent!! Glad this has worked out for you :)

I'm sure there must be a few situations where saying nothing might make things worse, but I can't think of any right now. Keeping your trap shut is generally the best course of action -- and certainly never breathe a word until you've spoken to a lawyer. If you haven't actually been offered legal representation yet, you probably are not actually in trouble right now -- well, either that, or you're in so much trouble as it wouldn't make a lot of difference anyway .....
