DUI question

Not quite sure if I found the right tread for this, if not please help me find we're to go. Thanks

Question:
I was driving home from work at 2 pm on wed oct. 31. I dropped my water bottle on the floor and I must have swerved when I picked it up. I continued down the freeway and took the exit to my house. As I was stopped, with my blinker on, an officer, passing the opposite direction, flipped around and pulled in behind me in my driveway as i was exiting my car. Im standing outside my car and the officer starts asking me a series of questions. He stated that someone had reporting me swearving on the freeway. He then asked if I had been drinking. I said no, and then was asked to blow into a breathalyzer, which I blew a 0.0. The officer then asked if I took drugs, which I said no. Then he asked if I took any medication that day which I said no, but I said I took my dr prescribed meds the night before, which are norco and soma.The cop then days "oh thats what it is." so he made me close my eyes is the freezing cold and wind and count to 30, well he said I counted to 45. Then he makes me walk, my shoes were untied And loosened up cause I just got off work, then he
Wants to look at my eyes, and then tells me I'm being arrested, but not for what. He proceeds to go threw my purse and car, without my permission. I had nothing illegal in there, but he comes back to the car and holds up a packet of pills and says everyone of these will be
A felony. I said turn the package over and see what they are.... They
Were fucking dramin for car sickness. He put the pills and my purse back and didn't
Say another word. So then he go opens my front door looks inside then locks the house and returns to take me to jail with only my car keys and cell phone. On the ride up there he proceeds to tell me that today was his first day working in my county. I took a urine test which only showed positive for the meds I take, plus that stuff will show up in your systems for days after u take it, so even if I was on meds that day you can't prove it like alcohol? I was also charged with drive under the influence of alchol. How can that be when i blew a 0.0. I would have atleast thought Id be charged with driving under the influence of drugs/ narcotics. I
know I can get fucked up at times and party like everyone else, but that particular day I wasn't. What do you guys think do I have a fighting chance against a DUI charge when I blew a 0.0


Let me give you a little background about me, I live In humboldt county, ca. I'm 30 years old, 5'8, about 125 lbs, long blonde hair, married, no kids, an adorable pit named Carmine. I have no previous criminal record, I was in my corporate work clothes when arrested not to mention my driveway. Im sure my neighbors have lots to talk about now;) I recently started taken meds for a rotator cuff injury. Everything I take I've been prescribed and can provide records. I'm scared shitless to loose my license and my job. Anyone have any good feedback or been in a similar situation?
 
Looking back on it now I would have made a ton of different
Decissions. I'm the innocent looking hustler that never gets in trouble. I leave the trouble making up to
The hubs. I really thought my innocence would be enough, god that was stupid. Never trust anyone on the other side. I'm just wondering if a public defender will cut it or spend money I don't have on a lawyer that actually gives a shit.

This is reason enough to not talk to the police - you don't have to, and they will often use the truth against you, even when you haven't broken any laws. For that reason in and of itself, it does not behoove you to speak to cops.

Even if you didn't consume alcohol your DUI report will probably still say "driving under the influence of drugs/alcohol", just like if your DUI of alcohol it can still include drugs on the charge that's just how they lay it out sometimes. They also might have gave you a charge of DUI per se and dwi but that should all get dropped to one charge, all of them won't stick.

When I got my DUI my sr year of hs 2008. I told the cops maybe my prescribed meds were affecting me, hoping to get out of my DUI. He told me that you can still get a DUI off that but when I blew .15 he didn't matter lol.

Also, I had a friend that got pulled over for unsafe lane change, he was stoned and had weed in the car. They gave him a DUI of alcohol/drugs and possession. In court he had a lawyer since it was his second DUI and he has his charge dropped to reckless driving- alcohol related (even tho it was solely weed) and he was in a program and had probation for 9 months (this was all in delaware if it helps)

Either way there cracking down on driving under the influence of drugs, especially prescribed ones. I'd advise you lawyer up if you can afford it. Also if its your first offense you will probably just go through a diversion program.

I recently was charged with a dui. even though they dropped the charges. I passed all the field tests but denied the blood test. Last time i did a blood test for a dui they didnt even test for drugs. They tested for meth making materials. Damn right outragous. Any way my recent one they said they wouldnt charge me due to passing the field tests. Eyes. Walking the line. breath and standing my feet up and counting. They couldnt get me on any of them but marked the dui charge on the ticket as other. I had to sit in jail 3fucking weeks for them to drop it. Took my drivers license and sent it in . now i dont have a drivers license for 60days even though i passed field sobriety and was found not guilty.
fuck the police well 99% of them. Crooked. will charge you for anything they can. Best not to make a statement at all ime.
 
They probably took your license cuz you refused the test. In Maryland and delaware refusal of a blood or breath test is 4 months no license and most of the time results in being found guilty cuz if you don't have anything to hide then why refuse?
 
My license wasn't taken from me and I didn't refuse any tests. They never even ask for a blood draw. I think i got a pretty good case and fuck the police, most of them were high school loosers searching for that higher power to get back for being bullied. I've always thought I good cop would be one whose been around the block and knows the game. They could actually help people rather than suspect, accuse, and arrest people for something they saw in a training video. A good cop would actually try to help someone and not fuck up people's lives with a criminal history.

I've got some calls into lawyers, hopefully I can get a free consultation before deciding on one. I really hope this goes in my favor.

I understand that, buts its the weekend and I can't call a lawyer. I was mostly curious to hear if other people have had similar experiences and what there outcome was. Just trying to do a little research, plus I find others topics on this forum very interesting. Its nice to hear your not alone and there's others going threw or dealing with things I personally am or ways to
Makes things easier. I personally would rather share my thoughts, experiences, etc. with a complete stranger online than a friend or relative that could pass judgement.
