A “drug-fuelled” woman killed her four-month-old son through gross negligence when she knocked a large television set on to his head as he lay on his mat below, a jury has heard.

Natalie McMillan, 25, formerly of Bradford, was said to be in no fit state to look after her son, Kian, who died from “catastrophic” brain injuries a day later in hospital.

The television toppled off a cupboard as she attempted to move it to plug in a scart lead so she could watch a DVD at a house in Burnley last December.

Kian’s father, Edward Hanratty, 41, of Dirkhill Road, Great Horton, Bradford, was also under the influence of drugs at the time after he passed out on the kitchen floor earlier, Preston Crown Court was told yesterday.

Suzanne Goddard QC, prosecuting, said: “The prosecution case is that Natalie McMillan was not in any fit state to look after a child. She had taken heroin and valium and an amount of alcohol.

“She chose to become intoxicated to the extent that she was not capable of caring for her child in a safe and appropriate manner.”

Miss Goddard said the defendant was “careless and drug-fuelled”, and that no sober person would have failed to notice the dangerousness of a child’s head lying so close to a heavy television.

“Her needs were more important than her child,” she said. “The simple step of moving Kian would have saved his life.

“She showed careless indifference to the life of her child that night.

“This was not a tragic accident, every parent’s nightmare. This was an entirely preventable death. An accident that should never happened.”

The prosecution also said that Hanratty had a responsibility to Kian and that he too was in no fit state to look after him and should have ensured someone else did.

McMillan, now of Clarendon Road, Leeds, denies manslaughter by gross negligence and child cruelty.

Hanratty denies child cruelty.

McMillan rang 999 in the early hours of December 6 to say she had been “messing around with the telly” when it had fallen.

She had noticed a lump on her son’s head and he was not feeding.

When paramedics arrived at the family home in Scarlett Street, the boy was unconscious and blood was coming from his nose, the jury was told.

Miss Goddard said several ambulance staff recalled both parents appeared to be under the influence of drink or drugs and were seen to stagger with their eyes closing.

A police officer followed the couple as they were taken to hospital by ambulance with their gravely-ill child.

She too thought they were intoxicated and also said she had to tell them both “more than once” to come inside the hospital while they smoked cigarettes outside, said the prosecutor.

McMillan and Hanratty later agreed to switch off life support to Kian.

Miss Goddard said: “The extensive brain injuries were entirely consistent with a television set falling on the child’s head, causing bleeding on the brain, severe swelling and a lack of blood and oxygen supply.”

Both the defendants were arrested and drug tests later confirmed McMillan had taken heroin and valium close to the time of the fateful incident and that Hanratty had used heroin and cocaine in the 24 hours prior.

Hanratty later told detectives the pair had bought valium tablets before the television incident.

A police search found valium tablets in the baby’s cot, the jury heard.

Syringes, thought to be used to inject heroin, were discovered in a kitchen cupboard.

The trial continues.

Yeah I really look down on the people who recklessly endanger other people's lives just for a high as well.

I look down on people with a reckless disregard for others (epecially children) whether they're drug users or not.

What a terrible story.
I would certainly blame the mother.
I think the article was right on when it said:
“She chose to become intoxicated to the extent that she was not capable of caring for her child in a safe and appropriate manner.”
That was the problem.
If someone does heroin while their kids are around, but someone (e.g. the other parent) is sober and can look after the kids, I have far, far less of a problem with it.

good i was a bit worried that would come across wrong was not want to insult any body with it . i know in a way i'm not the best to talk as i have reckless streak my self but that drug has destroyed more lives around me then any thing i had to learn how to give adrenaline shots a 12 because of some one i loved be a junky now though i could not careless if he die or not

OT and no offense but I don't think anyone with your history and frequency of drug use (especially all the very new and very unresearched chems you claim to indulge in your post history) is in any position to judge others or their drug-distorted judgement. My 2 cents.

and if you read above that's what iv said and no offense but that still does not excuse your joke p.s iv no family or friends as such the friends part being a chose as iv got such a bad habit iv been using for a good twenty year setmining from being abused as a child its not like mine is just because im a heartless waster who does not care that's why iv taken myself a way from the world around me . i at least exsept that this is my own doing i got hooked drugs no one forced me but they had a child and no matter what that came first not them

That baby sounds like it was being a totally bitch and probably deserved it. That's why when I was a four months old I never pissed off my mom when she was on her infamous coke binges.

I KEED I KEED

not funny

also i bet the valium is in a big way to blame for this death- poor motor, control stupid careless behaviour sounds like valium to me

I don't really see how this is negligence... I mean, yeah sure the Mom probably shouldn't have been that fucked up around her kid... but you think she knew the TV would or even could fall?

When little kids are sitting in front of my TV, the LAST thing I think to do it move them because the TV might fall on their heads. That's called delusional paranoia, and how many of you would have been thinking to do that? Not a single one of you, is the right answer.

i agree with you that this could of happened whilst sober however taking the said cocktail of drugs whilst looking after a 4month old baby is beyond reckless
its stories like this that give drug users such a bad image

I think you have it all wrong.
Having taken drugs does not invalidate anyoneʻs opinion. Period. It does not matter how frequently or which kinds of drugs they have taken. I would have hoped that you would have learned this already, but please stick around and keep your eyes open, and I would place money on the fact that you will open up to this idea.

If someone were to take a strong dose of research chemicals for the first time while responsible for a child, that would be bad judgment.
If someone were to take the same dose of the same chemical while responsible only for him/herself, that is completely morally acceptable, and while some might say that s/he is an adventurer or explorer, and others might say that s/he is a stupid risk-taker, it is his/her own right to do so.
Canʻt you see the difference?

Also, having bad judgment is pretty independent of drugs, I would say.
Some people have bad judgment without drugs, and others have good judgment even while fucked on drugs.
The mother in the story had terrible judgment before she was even high - "Oh, I know, I will shoot up an unknown but probably pretty hefty amount of heroin while I am supposed to be taking care of my baby, and my husband is nodding on dope already, and there is nobody else left to take care of the baby. That sounds smart."

^ TBH it seems like your rather trying to demonize the mother :\

It seems to me she got high as fuck and wanted to put on a movie for her kid so he at least wouldn't be wandering around the house or something. Obviously that is still VERY irresponsible, but it's not like she just had absolutely NO regard for her child's safety.

She was probably just too fucked up while trying to put on The Wiggles, knocked over the TV and the child just happened to be sitting there.... the same thing could have happened if she was sober.

I have to disagree with the bolded part she did in fact have NO regard for her child. She didn't find someone to take care of her child while she was getting fucked up. I realize I sound like a judgemental dick but that's only because I'm a judgemental dick. LOL
On the drugs she was taking she was totally unprepared to take on the responsibility of parenthood. As such she could have/should have cared enough to have found someone to take care of the kid. Clearly she'd rather be high instead. Now don't get me wrong I don't care about her or anyone else doing drugs, but she was responsible for another life and ill prepared to be. In fairness, the father was equally negligent.

I have the same sympathies as the prosecution. You have to be really fucked up to knock a TV down from where it is. But doing so where it could fall and hurt your CHILD LAYING RIGHT NEARBY, LOWER THAN THE HEAVY TELEVISION... that's negligence. Not just an "accident". Mothers are supposed to be concerned for the welfare of their children. You can't parent when you're all fucked up on 3 downers at once! Young children are not self sufficient at 4 months. They don't have any risk assesment skills, they'll drink antifreeze if you give them a chance.

Both of these parents are negligent at best and criminals at worst.

She most likely knocked over the TV because she was too fucked up. The child also did not "just happen to be sitting there" - it was a four month old baby, it was placed there by a parent.

Taking heroin, valium and alcohol whilst a four month old baby is in your care could be the very definition of having "absolutely NO regard" for the safety of the child IMO.
