drug diversion

hi i searched for this question but couldn't find anything specific to it, plus this is Australia specific so i figured this was the best place to put it. :)

i got called in to an interview with the police, about my phone number along with a sms asking about pills being on someone's phone. they told me because of this, i can basically go to a drug diversion course or to court. i tried to get as much information about it all while i was there, but eventually agreed to getting a diversion and 'interview' to get out asap and talk to someone else with more legal knowledge.

does this sound right? im starting to regret rushing it all to get it over with. i wasn't caught with drugs, or any drug paraphernalia which the officer ticked as a reason for the diversion.

Secondly, Unfortunately for the both of us, you prolly did the worse thing for your situation, These days especially drug charges apart from trafficking, they have a really hard time dealing with due to

A) The lack of quality of drugs (Ergo substances sometimes completely legal get pressed)
B) Quanitiy minus the cutters if your lucky enough to have an actual substance.

From what i can tell, you got scared into the drug diversion, which is exactly what the police aim to do in most first time offender situations.

More or less i'd suggest reading the above thread, fortunately it is literally a slap on the wrist.

I feel sorry for ya that it went all down like that, Hopefully M_B or someone else much more knowledgeable in the field can step in and help out as best you can, May also be worth giving Legal Aid a call.
 
Oh man, if I were u I would never have admitted it. My advice would be its prob just to stay low for a while. I mean imagine what if that was ur 1st ever pill that u were goin to buy? Why should someone go to a diversion program if he/she isnt using?
 
looks like u got conned into a drug diversion bro. nothing more.

and dont stress about it. it doesn't go on your perm public record.

and the session is only 2hrs i think. basically u turn out. some one will try to tell u all drugs is bad blah blah blah.

and thats that :)
 
I was going to say, phone messages asking about pills (if your wanting to buy a couple to have for yourself) aren't going to get you in court or convicted of anything if you have not been arrested with any drugs in your possession.
 
asking is not the same as buying, also if there isnt any txts or phone conversations indicating u two met up, they couldnt prove u tried to get some in yoir possession. You got conned into a waste of time. Lesson learned dont use txts as they may not delete them off phone
 
More reasons than that as to why you shouldnt text about drugs. OP, I award you a lol of the day, and nominating you for lol of the year! Never let yourself be pushed around like that. Not your phone, not your business. You could have made up any story, fuck you could have said that you were talking about magical beans that prevent your midget from growing. No drugs = no crime. Be sure to have fun in ye diversion at the very least :D
 
It's not hard to say (next time or for others reading this) that someone else used the phone. No voice and/or face recording means anyone could have sent a text from the phone. I hear that was the excuse given that during an alcohol fuelled bender, a friend thought they'd send an sms to a random mobile number like "Dave, I've buried the body. I don't know if I'll get done for murder man, help me"

Some supposedly high up (homicide?) officer/detective called my mate that night in front of us asking what the hell was going on. As in the officer (who gave all his credentials plus my mates name to him over the phone, can't think of any other way they'd know besides being in authority) asked if this was a 'game' or not and that if it happened again, the police wouldn't make a courtesy call again and just "ram his arse into jail" or something along those lines. So my mate on the spot just said he was at the pub, which he was and that one of us must've done it 'as a joke'.Bit of a LOL at the time, might be one of the reasons I haven't cared about drinking in the past few years.... heh
 
thanks guys! yeah it is a slap on the wrist and only a hour or so out of my life so i might as well get it over with and be more careful next time! just sucks i went in expecting to have to say some white lies, and they tell me i have to go to drug diversion or court. :S

at least the police gave me a laugh, when he showed me the print out of the text messages and asked whether 'haha' was code for something.

As has been said, you should have requested legal advice right away and not given the police anything. It's too late now, but it sounds like you will be alright because drug diversion isn't too bad. If you can sit there for an hour and pretend to be interested in listening to the counselor speak, you will be set. :)

Apart from that, it sounds like a lot of bullshit that those cops pulled on you. The message is evidence of intent, and I'm sure there is a charge they could have hit you with... such as conspiracy to possess a controlled substance. I highly doubt that going off one message it would have been worth their time though.
 
im pretty sure conspiracy is harder to prove, usually they charged people with consipracy to possess a controlled substance when they switch the goods to dummy stuff, and they go pick it up e.g. customs swaping the goods for dud stuff
 
they can try to charge you with whatever they want...
at the end of the day its their job to prove they are right, and yours to prove that they are wrong.

shitty situation for the OP, but sadly unless you are into law and what not for study, the only way that you will learn about legal stuff is when you are facing charges.
once you have been stung once, you quickly learn its alot of smoke and mirrors by the police and legal advice is always the way to go before speaking to police if you are facing charges.

let us know how you get on though, would be interesting to hear what happens with such a petty thing.
 
grugs the anti terrorism laws have meant nothing for registering sim cards. yes technically you have to have a drivers license or something, but they have piles of sim cards all over shops, and you only have to register those online. and trust me, you dont need anywhere near a drivers license once you have the card in your hand and you're out of the store....

did you mate get caught with some shit on him, and the cops searched his phone and found the text from you? i really wonder how you end up on the radar with a phone, and about the safety of texts and all.
even with extensively looking on bluelight i still haven't been able to sift through the bullshit regarding phones....everyone thinks they're an expert, no one has shit to back it up, and everyone's got a different story.

play it safe, get a unregistered phone, and dont use it for dodgy shit....

Sounds like those cops were desperate for some kind of result or just very bored. Even if you are found with drugs it is better not to admit guilt. Admitting guilt when you are innocent is just plain silly.

How long has it been since you bought a phone at a walk-in store with cash and didn't have to give over any details?

AFAIK there is a law now that requires all sales of new mobile phones and SIM cards to be recorded on a national register (drivers license is required). A family member of mine worked at a local Telstra store mid last year and that's the way it was. It wouldn't be too difficult for employees to take already registered phones/Sim cards.

Your friendly dodgy asian electronics stall vendor's usually sell pre-activated phones under some random asian's alias. The usual saying still aplies here - buyer beware. If the price seems too good to be true if probably is. Do your research and compare prices to legitimate stores before purchasing.
 
Mid late last year? Dude that thing has been around since 2-3 years ago

Even before that, optus used to take student id and bankcard photocopies to buy a prepaid, and that was over 10 years ago

even if you did put false details in, they check it out n notice something wrong, well happy monitoring
