After an overreaching proposed ordinance last month which would have made the smell of marijuana illegal in Denver, the city council has given preliminary approval to much looser rules that would allow citizens to smoke pot on their property and even on their front lawns.

The Denver Post reports that marijuana consumption would only be legal on property that is owned by the marijuana user and also legal where permission has been given by the owner to smoke pot on rented or leased property.

The city council is attempting to define what "open and public" consumption will mean for marijuana users in Mile High City. This new proposed rule stands in stark contrast to the original draft from October; which, if passed, would have made the smell of marijuana, or even just the sight of someone smoking marijuana, illegal if it could be smelled or seen by others . It also could have carried a fine of $999 or a year in jail, 7News reported.

Colorado voters passed Amendment 64 last November making the limited sale, possession and growing of marijuana for recreational purposes legal for adults 21 and over. A64 states that adults can possess up to an ounce of pot, can grow as many as six marijuana plants at home (with only three flowering at any given time), but home-grown marijuana can only be for personal use and cannot be sold. However, adults can gift one another up to an ounce of pot.

Backers of A64 said the original proposed ordinance which would criminalize marijuana use in private was unconstitutional.

The final vote on the "open and public" consumption rules will take place in early December. The first retail marijuana shops are expected to open around the state on Jan. 1. 2014.

I'm ecstatic to see this change! The way that the proposed ordinance was written, it would have made it extremely easy for anyone that didn't like their neighbors to get them sent to jail by calling and reporting "seeing" them smoking pot on their own property. It was ridiculous. Very happy news!

So they are allowed to have three plants flowering at one time, but can only be in possession of an ounce at a time?
What do you do when you harvest those plants?

How can tourists enjoy this legal weed? I am not going to rent a house for a week. Do they still have smoking hotel rooms? If you light one up on street or park i guess thats illegal? Are there going to be Amsterdam style cafes? I cant imagine people freezing asses off smoking cigs outside bars wold be happy with that. You should be able to toke anywhere people can smoke, that seems fair.

Cant smoke cigs in bars or restaurants in CO. You guys are looking at this law to literally... we all have been smoking all around for years and have had no problem.

We still have cigar bars and hookah bars though. I imagine that MJ bars will pop up.

The city of Denver is going to be very restrictive and some counties have already opted out of legalizing weed.

Its going to be messy for awhile.

As long as they keep it legal up in the hills I will be happy.. dont see that being a problem though. You know with the certain counties opting out.. I dont think we all have to live the same way or have the same laws.. but on this issue I think people should try and develop a live and let live or tolerate people with different morals and values living in the same area as long as they are not causing any problems. The world in general has a long, long, long way to go as far as this goes. As far as MJ smoking bars popping up I wouldnt be surprised at all as if there is money to be made people will try and expand and develop those areas. But i hope it doesn't go like the dispensaries where good people put all that money into business just to have the paranoid controlling straits shut them down with an ordinance.

You know what I belive in god but think that most organized religion is the scourge of the earth.. and I put up with their no tax paying freeloading crazy houses all over so why can't others put up with a calm place where people gather and smoke..

It really shouldn't be surprising that Focus on the Family got the entire county to opt out... I agree with you about organized religion 100% FotF got Soul Mechanics shut down in the Springs which was home to some of the sickest vibe parties I've ever been too besides MESS events (warehouse, full moon, and Mosaic Dance Studio). There was never even an overdose case at the venue. They just got it shut down for stupid bs. I avoid that part of the state.

I forgot what individual cities voted no on retail marijuana.

Either way, I wonder how many more people aren't going to show up to work on January 1st? ;)

Thats awesome. Smoking has been banned here for so long I forget smoking bars still exist. The bring your own pot cafes here makes you go in the back patio outside because they fear the anti smoking by laws. Pot is illegal but they fear the anti smoking laws more. I have high hopes Denver becomes Amsterdam of America.

This isn't directed at you 3rdeye<3 as i hope it represents what we both want;)

Hopefully better than my experience of amsterdam (01) at that time it seemed like a place where people from europe went to act like assholes with no rules.. pissing in the streets and other things that screamed WE NEED A DAMN BABY SITTER like the government to oversee us and be responsible for our actions.. To those from amsterdam<3 i place no blame on you guys at all and I love the city.. the national museum, the people, the freedom, the bikes and so many other things are without reservation the very best.. but I irks me that idiots cant handle the gift of freedom that you have offered them and choose to "enjoy" it like animals. If the legalization of drugs is to come about then it will come with responsibility.. and as we in CO have been given allot of freedom with drugs for a long time.. the last thing we need or want is a lot of "gappers" acting like fools and justifying the controlling idiots fears.. dont mean to sound preachy but I know its coming off as this.. you all know that im not aiming this at the Blue light community.. but more at the sheep.. so yeah I just hope the damn sheep dont fuck this all up as we have a chance to be able to think for ourselves on a legal level like we already need to in real life.. we all can get whatever we want in less than a day so it would be real nice to prove that we deserve the right to to this legally.
