A "crop-sitter" who had been smoking cannabis since he was 11 has been jailed for more than two years after he was caught with almost 100 kilograms of cannabis plants in a Werribee house.

Father of two Billel Kassar, 24, pleaded guilty in the County Court on Friday to cultivating a commercial quantity of cannabis, one count of theft of electricity, and one count of dealing with property suspected of being the proceeds of crime.

Judge Chris O'Neill said a sophisticated hyroponic growing system had been installed in the Werribee house when Kassar was arrested in October 2012.

"An electrical bypass system was in place and it was estimated that over a period of approximately three months during which the crop was grown, electricity to a total value of $8,500 was stolen," the judge said.

Police also found $29,500 in cash hidden in the kitchen.

Judge O'Neill said a psychological report revealed Kassar, the married father of a five-year-old daughter and a 12-month-old son, began using cannabis when he was 11 before experimenting with other drugs, including ecstasy and methylamphetamines.

The 12 days he spent in the Melbourne custody centre after his arrest was so traumatic he twice attempted suicide.

"According to the submissions of your counsel, and despite the admissions in the record of interview, you did not own and establish the cannabis crop, but were rather a “crop-sitter” for other persons," Judge O'Neill told Kassar.

"Your counsel referred to part of the record of interview where you indicated that you had no money to pay bills both in respect of your family and your extended family and were struggling to make ends meet."

The judge said Kassar had turned his life around since his arrest and started a courier company in November last year while on bail.
"I accept that any period of incarceration would be difficult for your wife and young family, although that difficulty does not attain the level of hardship necessary to warrant a grant of special mercy," he said.

"Because of your disjointed early life, your education has been modest and this has led to restrictions in your ability to obtain and maintain employment, and the financial security that brings.

"What must be said about the narcotic plants discovered is that the quantity was substantial. The combined weight of the plants was almost 100 kilograms. On any view, this is a large crop, even accepting the number of plants involved was only 39."

Kassar was jailed for 28 months with a non-parole period of 14 months.

Yes. A substantial amount of stem, trunk, roots and probably vermiculite - I'm surprised they don't weight the nutrient water too. But, hey, who cares if there were only 39 plants - Imma gonna sentence you as if you had 200lbs of dried, cured bud ready for sale :|

All so the cops look like they could possibly be putting a dent in the war on drugs.

This is nothing, and his life is ruined.
although I doubt the whole it was for some one else thing.

Yeah I've read of several large scale hydro houses being busted with alot more plants in it than this one, some with hundreds all through a house and when busted they have found a couple of ethnics in it who dont speak english and the police claimed were not the people who had set up the operation but were just being paid a small amount to tend to the plants (crop sit).

Jesus. He was watching a PLANT grow. Nothing to get so intense about. No reason to punish him so much that he tried to commit suicide. He is a father, and his children would be left fatherless. Is that going to make the world a better place?

The poor bastard; he found himself mixed up in the wrong scene at the wrong time, and now he's paying a harsh price for it. Maybe they went so hard on him because he refused to co-operate with busting his associates/employers...?

If he's lucky, I guess they could send him to a really low category jail, and could get significant time off for good behaviour. It's not much, but they could have really nailed the guy properly; I've heard of far, far more ridiculous sentences handed down, some of them so harsh it borders on la-la land.

And yeah, we're talking about growing plants; it may have sounded like a pretty commercial scale operation here, but the principle applies: somebody was thrown into prison for growing some plants in a house, somebody whose kids will go fatherless for years. There are violent, dangerous people involved in the drug trade, for sure, but when you get down to it this exactly the sort of shit that happens in the so-called war against drugs; people are finding themselves in situations just like this.

^ Yeah he probably wouldnt name any names and possibly didnt have much money for decent legal representation, and maybe the cops and judge were just assholes as it quite often the case too, who knows.

I'm informed that, in Qld, they would wash the roots clean, allowing the already rapidly drying out plants to take up more moisture (@1 kg/L) then put them in plastic bags, to keep the moisture sealed in, and the weight at maximum, then took them to the cop shop, for immediate weighing in.

Yeah? That actually doesn't surprise me at all. I've seen decades of them parading their seizures for the world to see, usually claiming the prices at street, which usually sound highly exaggerated. This shit is PR for them; it's their way of telling the world: "we've got this, and we're gonna get every last bit; were necessary. In X years when prohibition is history, well be looking back at these fools with amusement. (At least I hope so)....
