No, it's not illegal. If you're under 16 your primary caregiver still has the ultimate authority over the child's medical decisions. But it is a grey area, if the child has the mental capacity to understand what the medication is and why it is being given to them, they can legally refuse it AT ANY AGE, and as is to my understanding this overrides the parent/caregiver's consent. This would mean that hiding medication in a child's food without their knowledge, IF THEY ARE OF A MENTAL CAPACITY TO BE ABLE TO CONSENT OR REFUSE SAID MEDICATION, then that is illegal.Does anyone know if it’s illegal for doctors to give anti psychotics to parents to give to their children in their food? I’m in Australia
It is not illegal for the doctor to give the parent/caregiver the script though, no. It is then up to the parent what they do with the script.
