Caught

This is so stupid.
Some people seriously i swear. I mean i can understand some punk teenager.. 20 years old dude should know the bloody mere basics of protecting yourself against L.E by that age lol.

I'm with AyahuascaSeeker13, the two dudes involved here havn't a brain between them.

Well i guess now you guys will be a little bit smarter now, so really it's a blessing in disguise. Could have kept going on and might have got caught with much more shit. pretty funny what it took for yas to learn though.
 
So the case was refered to the merit program.
be back in court tommorrow and then another 6 weeks to follow progression.
the court said a gram of acid was only posseion( there was only 3 and a half tabs there)
this may have been a disater in the way it has played out, but hopefully this will be a great learning lesson.
1. no speeding while carrying any substance:p
2.dont leave a litle bag in your console while you have an oz in ya dacks.

You're going to jail if they caught you with a 'gram' of acid, but thankfully weighing the medium it is stored on is not legal, I don't think. I'm reading this from a booklet that summarizes NSW law, "Police may search you, your car or your house if they have reasonable suspicion you have a prohibited drug." They can also search your house if they think there is a criminal hiding inside. They can only detain you for 4 hours, never EVER say a WORD to them. To prove possesion they must prove that:
* You know the substance is a drug and you had it in your custody
* You had it in your custody (person, house, car)
* They must prove you have control over them, that is, they arent a friends or not in your control (room mates safe etc).

If you don't talk, they can't prove all these factors. Possesion of a drug for personal use punishemts include:
$2200 fine or 2 years in prison, or both. But usually for Heroin, meth and coke the fine is $150-750 (average 300-400). Fines for cannabis is about $100-500 usually about $250.

So basically, with a couple hits of acid and some cannabis you're going to be copping a $400 fine I reckon.

Supply (trafficable amount)
3 grams of H, meth or coke
0.75 grams of ecstasy
0.003 grams of LSD
300 grams of cannabis

PS: yes australians, we legit have zero rights.

I thought they do count the total weight. Like the weight of ecstasy will include the whole pill weight not just the weight of mdma, powders include the cuts, and I assume LSD includes the tabs themselves? Not 100% sure, someone around here will know.
 
Well that's fucked, because as another posted outlined, if you were caught with a gram of acid, thats like 10,000 hits. That's like supply on a commercial quantity level (0.5 grams - 2 grams).
 
saying anything to cops when u know your in the wrong no matter how minor without a lawyer present just seems silly to me (i am fortunate to have not been in this position, it just seems logical though)

If only we all had the benefit of hindsight
 
I got caught with 3 tabs in my possession on the way to an event, ended up with the help of a lawyer and no previous conviction to get a diversion.

Basically, just acting really sorry for my actions.

12 months good behaviour, $400 fine (paid to Blue Ribbon Foundation), and a letter of apology to police, and half a day at a drug education program.
