There is no end to the problems that life can throw lol...

So, my toilet has had an issue clogging since I moved in 6 months ago. To save the elderly landlords a hassle and expense, rather than complain I just plung it everytine it clogs every few days. Well, last night it started leaking from the bottom, which caused my landlords separate house under my apartment to get a small leak from the ceiling. No major damages, certainly not that my deposit can't cover, if I'd even be considered responsible for her faulty equipment.

This caused them to enter my place unannounced, without knocking or calling, and she found my kitchen sink totally full to the brim with unwashed dishes, a mess on the counter, and in the microwave. It was spotless a week ago when I returned from several months out of state.

Now, she has threatened me with eviction for being messy, and given me 30 days no move out.

Pretty sure I could fight it but I really don't want to wind up with an eviction on my record and unable to get a new place.
 
Surely landlords don't have the right to enter your home?

Fight it.
Talked to an attorney. They have the right to enter in an emergency (such as a flood), coming in the second time was probably illegal but hard to prove and splitting hairs.

They likely can't evict me, but they could make my life hell if I won, and he said there is a slight chance they would win based on me kindly not reporting the malfunctioning toilet, and here in USA evictions go on public record and then finding a new place is next to impossible.

What is best is i leave in the 30 days and sue for my security deposit, in small claims court, filing without an attorney. He was nice enough to tell me I'd win without retaining him.
 
I was a landlord for a long time, and I don't think there is a clause in your lease that says you must wash your dishes in a timely manner. The only thing that would matter is if somehow your mess was causing property damage, a foul odor that could be detected outside your apartment, or otherwise violated the lease agreement. I'm pretty sure those things don't count.

Thank you not feeling alone its a comforting feel. I am exposed by a similar land lord who decided on foe not friends.
Or a friendly conversation, reach mutual ground. No. Wasted energy and inteligence on my part.

They are coming, coincedence 12 september claiming i cant deny entrance. They def not coming in and i be filming taping waitin them. Intuition, the law says the direct opposit.

It a skill you if youre gonna use it you must first take lots of time to master. Sticking to the truth, the way i chose to react.

Do you have lawyers for Minima, that would be the first go. Check the law to its c ountry specific, i am Dutch so.

"The rules in the rental contract are not necessarily valid, even when the contract is signed" taken from a lawyers site.
Checked my contract and indeed doesn't comply to the law, rules on personal privacy. and most stunning.
The renter has a lot of obligations little rights. Vica versa the renter has no obligations and despise my rights on paper.
the landlord don't practice em real life very well.

Your location is your main aim, the rules, the law concerning rent an renters.

Overhere there are letfovers of what ere once non profit housing company's that got privatized over which you have the most power.
A*dam, good example is filled with 'House-Milkers', basicly criminals. Some have a few tough gys on the payroll.
For the type of renter that needs some intimidation or a bit of violence to comply.

If the Police where you recide is not corrupt would me my first call, treats and violence to civiliance they can handle.

The other thing is that, in the US, actual lease violations which have not caused some kind of big damage will be excused by a judge if the violation is "cured". If you've fixed it. Then the landlord has spent time and money taking it to court and you're still there.

For repair or checking overhere not, other visits YES. But not according to the rental contract but according to the law.
The rental contract is not in line with the law, smart move but a flaw. Its just to scare.

Lucky we have very on the renter aimed rules ment to protect the one living. Its in the constitusional Law.
Evereymen has the basic human right of a roof over his head, so eviction is hard. You have to deal, grow weed or are just insain/ not paying type and have a not so emphatic jugde but its pretty solid protection. The court ordered a fine to the landlord to be paid to renter and the problem being fixed within ...
Imagine this 5 years 10 times as intense [my situation]. I can stand a year smell, but if thats deliving money.

No organisations that stick up for the renters rights overthere, they multiple options but which if any is the most helpful?

Tomorrow they doing a vistit areperation check up, written in the Law, can t deny.

How i warned about the Asbestos in my provious house.
For which they had a Polish men to take it out illegal and unprotected !

Warned the guy, called/ mailed the landlord, sent pics of the Asbestos.
Denied everything, but they let the kitchen be. The foolish worker though also did the lays of tiles in the toilet.
To the bottom layer, the Asbestos from the 50-ties, with a drill. Closed door. The obvious wafer like glue pattern ⚠️
Glad my wife and kids had escaped the work. And the landlord pure denial.

Now 10 years later, now my exes house, they gonna remove the Asbestos officially. Gloves, masks & vacuum ed.
While there was no 'Asbestos' according their old reply s.

Reminded them of human integritiy. The use of poison in relation to what we leave for our kids.

it's not really my landlady who is pissing me off, but the guy who does the administration of the house i live in and another that is on the same lot (but separated by a fence).
he is such an jerk, no idea how old he might be, late 20s or early 30s, and he is the son of one of the other neighbors. but he thinks he owns the place. being that he is also the gardener here (included in the rent) i can hardly tell him to gtfo unless of course i want to hire another gardener. which i might if this stupid prick doesn't learn to respect the things that were agreed upon when i rented the place.
