21 year old gets life for heroin sale that killed teen

From http://sun2.science.wayne.edu/~bio103/toxicity.html:

"The reported, directly alcohol-induced U.S. annual death rate is at least 100,000, which is 3 times the combined illegal drug death rate, 5 times the homicide rate, and twice the U.S. deaths in the entire 9 yr Vietnam War. Adding the alcohol-induced accident deaths (about 25,000) and alcohol-related suicides (about 13,000), and all unreported or unrecognized alcohol-induced fatal diseases, we likely approach or exceed the 375,000 annual death rate from smoking. None of this includes all of the non-fatal effects of alcohol on individuals and society in terms of disease, family dysfunction, and costs of nonproductivity and health care, etc. (over $120 million annually)."

Alcohol kills more people than all illegal substances combined. I think it's safe to say that heroin's statistics are much more favorable.

I live in the GR area and it seems like heroin has been dominating the news as far as drugs go. Hope everything turns out ok. -J

Yeah, heroin and violent crime in general. Arsons, abductions, shootouts... some parts of this town are gettin really rough.

Me though, i'm on the east side. I'm pretty much the closest thing to disturbing the peace here. Whereabouts are u located^?

"do you think a salesperson/grocer should be jailed for selling a 12 pack that leads to a car wreck, or a bottle of vodka that leads to alcohol poisoning."

In reply to this and all other related posts, what if the salesperson sold the alcohol to a MINOR who then crashed the car, then what?

I believe the sentencing would have been alot different had these two been the same age, however an adult supplying hard drugs to a minor is asking for it in the first place.

People do lots of grimey shit on their hustle and if you gotta eat you gotta eat. The point is a smart drug dealer doesn't sell hard drugs (Being potentially lethal ones.) To a minor (unless on happens to be a minor his/herself) Because these people are more prone to being irresponsible (No offence meant to anyone here.) If they happen to wind up in a hospital they are questioned harder (Cops may care more about someone selling to kids than "junkies".), Will talk faster, and are more prone to freak outs (leading to unnessecary visits and questioning.) If they die, the case will get media attention and will no doubt be persued to the fullest extent. (Much unlike a "junkie" found dead in the ghetto.)

Basically the dealer was an asshole and put his wallet ahead of his freedom (As well as basic morals, but thats besides the point.)

Peace

For all we know they could have been friends and the 17 year old kept bugging the 21 year old to get him some H.

Heres a similar story, I guess this kind of charge is goin to be the new 'norm', or at least if the victim was related to a police officer or government official;

Murder charge for selling lethal heroin mix
August 28, 2006

NEW YORK: An alleged Chicago gang member has become the first person to be charged with murder for selling the supercharged heroin that has killed hundreds of addicts in the US in recent months.

Corey Crump, 35, is charged with the drug-induced homicide of the teenage son of a Chicago police chief. The youth's body was found slumped in his car and he was clutching foil packets of the drug cocktail in one hand.
The heroin was cut with fentanyl - an opiate used in anaesthesia that is up to 100 times more potent than morphine. It has caused more than 400 fatal overdoses nationwide since it hit the streets of Chicago.
Efforts to warn drug-users have backfired as addicts seeking the drug's powerful high have flocked to areas where police say the tainted heroin is being sold.

So strong is its appeal that it is sold on the street with names such as "Bone Crusher" and "Get High or Die Trying".

The heroin-fentanyl combination can kill a user before they remove the needle by causing the ribcage muscles to seize. The equivalent of three grains of salt - or 125 micrograms - can be lethal.

Because the mixture often kills before an ambulance can arrive, some needle-exchange programs have started giving addicts prescriptions for an antidote, naloxone, to keep on hand in case of an overdose.

Authorities believe that the drug combination is being smuggled from Mexico.
In May, Mexican police raided a laboratory in Toluca, central Mexico, and arrested five men, one a chemist suspected of manufacturing the painkiller to be mixed with heroin.

The first murder charge stems from the death of Joseph Krecker, 17, who was found on June 6 in his Jeep Cherokee on Chicago's West Side, half a block from where he allegedly bought drugs from Mr Crump.

Mr Crump was described by prosecutors as a street-corner dealer who had been in and out of jail for convictions including drug possession, armed robbery and aggravated battery. If convicted, he faces 30 years in jail.

I was really surprised that our legal system would do this to a 21 year old - but then I started thinking about all the things the government teaches our society about drugs: Alcohol is good but Marijuana is bad! If you think about it, this was an easy case for the prosecution, all they had to do was explain that the 21 year old sold the heroin and show how sad the dead kids mom is, any jury full of parents would convict.

I personally don't think he will end up doing this time, I think that he'll get an appeal and it looks to me like he's already got support from a group that could possibly pay for his appeal attorney.

---EDIT: This is how I thought before reading on to the other articles. He was offered a plea agreement of 12-15 years and he took the deal. Sometime after that, he retracted his plea, fired his lawyer and went to court on all charges. This was his second felony charge so the life sentance was a mandatory charge. This moron would have been out in 12 years! 9 with good behavior! Don't get me wrong, I think it's horrible that we put someone away for life w/o parole for selling smack, BUT he has a little to blame on himself for the way he acted in court. Everyone knows that you suck up to the state in court, you don't win cases by telling the court to go fuck itself.

(Grand Rapids, April 7, 2006, 11:00 p.m.) -- Eugene Atkins will spend the rest of his life in prison after being convicted in federal court of five felonies related to the drug overdose death of Matt McKinney.

"It's a mandatory life sentence because he had a prior felony drug conviction," said Assistant US Attorney Ray Beckering after the verdict. There is no possibility of parole.

Federal prosecutors say they twice offered Atkins, 21, plea agreements. "The second time Mr. Atkins did in fact enter a plea of guilty, pursuant to this plea agreement. However, he withdrew his plea, fired his lawyer, and proceeded to trial on all charges," Beckering said.

Had he taken the plea agreement, Atkins would have served only 12 to 15 years.

McKinney's friend, Christopher Perrin, admitted to police he was with McKinney in Grandville the night they bought and used the heroin. Perrin, however, cut a deal with prosecutors and pled guilty to lying to police about the commission of a felony. Perrin was sentenced to two years.

Kenneth Muhammad of the Millions More Movement filed a motion in the case, claiming Atkins lost his presumption of innocence when Perrin pled guilty to lying about a felony in which Atkins was not yet convicted.

"We are supposed to have the presumption of innocence in a court of law and this young man lost it," Muhammad said.

Beckering said all three young men played a role in McKinney's death.

"Matt McKinney was partially responsible for his own death for voluntarily taking heroin that night. Christopher Perrin was responsible for Matt McKinney's death for not assisting his friend when he knew he had overdosed from heroin, and the defendant, Eugene Atkins was responsible for his death."

I didn't read the 2nd/3rd page before posting, so if someone already said this, I'm sorry.

I also completely agree with Tobala about this being completely different had it been a white dealer.

this is just fucking retarded

ok so by this logic then, all art supply store salse reps should get life sentences for selling razorblades to suicidal people. gun store owners should get life sentences for everytime someone commits an act of domestic violence with a gun and someone dies. preposterous!!!

a lethal dose

this is even worse, come on the general public is so ignorant to drugs that theyre going to inteperet this as though the seller intentionally gave him some substance to kill him. this is so retarded im pulling my hair out. why is it the seller's fault the kid diddnt know his tolerance/environment/dose????

the older i get the more i hate this world

Right.

Didn't someone sue McDonald's for getting burned with their coffee? I think they even won a shit load of money. I don't know, maybe was a myth...

No, some old lady actually won $1mil for spilling a McDonald's coffee in her lap, because the coffee was hotter than it was supposed to be and didn't have any kind of warning label on it. It wasn't JUST because it was hot - it was served to her at a higher temperature than some sort of food industry regulation or internal McDonald's policy specified, so it was considered negligent.

Show me one instance of a liquor store, a bar, or an sale of alcohol which then plays a major role in the death of another, such as a car crash. Has any liquor store, bar, etc been charged with responsibility?

The proportions of alcohol related deaths and heroin deaths are astoundingly different..

Just for fun let me share a story with you, and ask all of you guys a question.

A friend of mine comes over to my house one night, who wants me to hit him with some dope. He has never used heroin, although he has IV'd before but only on occasion, therefore he does not have any visible signs of IV use. Myself being a regular IV heroin user, have many bruises, damaged veins, dark areas, etc. You only need to look at my arms to see this.

I break him off and cook up the smallest piece possible; I was actually skeptical it would have any effect. I hit him with ease, and he appears to get an intense rush. I'm cleaning up my stuff right after, and I notice he is out like a light, and his lips are blue... Fuck..........

I try as hard as I can to wake him, slap him, shake him, pour water, everything. He is not breathing and has no pulse. I try giving him CPR: nothing. Nothing is working. Eventually, I give up and except the fact that he slipped through.

What would happen to me? What could I possibly be facing in terms of a conviction? How about a sentence if convicted? Let's say I have no prior charges.

Just curious as to what would happen in that scenario. Thoughts?

Man I was just thinking about this kind of thing the other day.

The guy may have sold him the heroin, but it was the teen that took the lethal dose of it. His decision. His choice. His consequences.

Don't get me wrong, I feel for the kid, and his family. It's a very tragic thing to happen, but people gotta look at the bigger picture here.

If I went to the LCBO (Liquor store) and bought 5 bottles of vodka, then drank myself stupid and got alcohol poisoning and choked on my vomit, should the cashier that sold me the alcohol be held responsible for my death?

I think not.

Just my two cents.

I agree. This 21 year old guy shouldn't be in for life.
