Court cases about trafficking - interesting info

hey guys, I have found there is some interesting stuff in the sentencing remarks of people who have been done for trafficking.

For example check out this http://www.courts.sa.gov.au/sent_remarks/sr/0513_marjanovic_palma_donoghue.htm

There was '26.02 g in total, with a component weight of 2.01 g of methylenedioxyamphetamine' - which means roughly 12% of the content of the pills were MDA.

It is also illuminating to find out the wholesale prices these guys are paying for 100 plus pills.

Have a look through the remarks, and also the other state's court's websites, and lets see what tidbits we can find!:D
 
That was really interesting.
Just to summerise someone onsold 120 pills for only a bit over $100 profit. they got caught.

2 guys were given a 3 year suspended sentence, and the other guy got given a 2 year suspended sentence.

btw 2 grams of MDA divided by 120 = like 16.6mg of MDA per pill. piss weak - you'd need 4 to get a buzz.

It was also interesting that the defendents all claimed they had become addicted to ecstacy and had turned to selling it to fund their drug use. Back when pills were good, I know people who overused ecstacy and would rarely have a night out without it. but I am yet to meet anyone who is addicted to it in the way that someone is addicted to alcohol, speed, benzos or heroin. I'm not even sure it can cause physical dependence.
 
What I found most interesting is this:

I have had regard to the telephone intercept material provided by the prosecution. It discloses some discussions between Donoghue and Marjanovic dating back to July 2009 and concerning potential drug transactions, but it mainly relates to arrangements over the transaction the subject on this charge.

There is, however, rather more extensive telephone traffic between Marjanovic and Palma and third parties relating to other transactions over that time. It cannot but be the case that their offending must be viewed as having been committed against a background of other drug trafficking, at least between July and September that year.

Does that mean they were actually listening to phone calls for people selling such small quantities of pills? Or are they just referring to text messages found on the phone after the arrest?

The fact that the deal took place under surveillance is also interesting.

In short, sounds like they went to a lot of effort just to grab someone so small time.

Hardly seems worth the risk. They're either really dumb, or maybe they're just claiming they made hardly anything to try to avoid getting their assets confiscated. I reckon it would be the latter...

As for NSW, where I imagine there is some cool stuff, I have had trouble finding where the trafficking cases are listed. They should be here somewhere, but the problem is that I am not sure what court they would be in. In other states the large amounts are in the District Court or even Supreme Court.

In SA it is easy because all sentencing remarks (so you dont even have to wade through the whole case) are listed here

QLD lists cases, but not the topics, so you would have to open each one to find out if its interesting.

WA is here, but few sentencing remarks published, and no subject header.

One thing i noticed in the SA remarks is that every single person got a suspended sentence because of how fucked up their lives were (and to a man/woman/trannie, their lives were massively fucked up). I felt particularly sorry for a couple who were being extorted by the bikies, and they ended up smoking crackies all night to stay awake to protect their house! This shit goes on in Australia too...

All this, just from trying to find the docs related to the control order on the Bikie in SA! (That will make for some juicy reading when I track it down...)

interesting about the Ibrahim case was that most of the speed that he was planning to sell was 1% to less than 3% purity. and the judge commented this was standard purity for street level speed.

buy a gram, get 10-30mg methamphetamine.

What you say to judge has no basis on reality quite often. Everyone seems to be depressed, which is why a person got drunk and did the things they did, or they turned to a certain drug because they were depressed, and then the only reason they take the drug more than once is because they became addicted to the drug.

The amount of times I've heard defence in a magistrates court claim their client turned to marijuana due to depression and then became addicted to the evil drug is... well it's ridiculous and not at all believable but apparently that's what magistrate judges want to hear.
 
^^ yep, in court its about how shit is worded. mental health issues? great! get a psych report and tell them how fucked up your life has been and we'll cut the sentence in half!

i can't complain, i'm going through that exact scenario for outstanding warrants lol.
but some of the shit you hear in court is so fucked and anyone can see through it, but most judges just want a good story rather than someone having the balls to say they fucked up.

i was wondering this also, but id assume that somebody probably informed, and maybe because of the plea they laid out what happened, but that still doesnt explain how the cops where onto it in the first place! sounds like they had an informant...
