what to do if your not receiving minimum wage?

my girl works at a resaurant and minimum wage for waitresses (what she does there) is $8.90 an hour. She's getting paid $7.50 an hour. What would be the best way to address the problem
 
That's a damn good wage for a server! But yes call your local labor board. It's illegal for her employer to retaliate against her for it, but they will prolly look for any reason to can her after.

In my state servers make $2.63
 
If a server earns tips, the restaurant does not have to pay minimum wage. In fact, I've never heard of one that does. In Texas, food servers make $2.13/hour + tips. If your GF is making $7.50/hour + tips then she's doing pretty well and you have nothing to worry about.
 
Servers have a different minimum wage. Here in Ontario, minimum wage is 10.25/hour. I believe that server's minimum wage is 8.90/hour (could be wrong on this number but it's around there). But the server has to be earning at least server minimum wage.

Consult labour board.

This does not apply to the rest of the country or the world though. Thus it is best to seek local advice as these rules.

ex.

In Ontario the min wage for a liquor server is $8.90.

Maybe not the rest of the world, but in the u.s., I've talked to, no matter where there from has told me the same thing. Not necessarily about what minimum wage is, but the whole servers making tips etc.
 
In Ontario, the stated minimum wage is $10.25, and for a business that serves liquor, minimum wage is $8.90.

These laws prevent places that share tips, or have low turnover, from making people work for less than minimum wage.

OP, as someone else mentioned, you should check your local labour laws, and put in a complaint to your local ministry, if they aren't being followed.
 
it really depends on where you live and the rules and laws and ect.... in texas for a example in you get tips..... then her boss doesnt have to pay the min wage....
pretty much saying what everyone else has already said but it really depends on where you are from ya know.
 
at hooters a girl can be told she wont be hired for being..black, small breasted fat ugly etc...all legal..why? they are hired as actresses to play a part..and that is not same as hired as a employee..a self-contractor and entertainer.....yep..if a hooters wants white big titty girls with a southern drawl and a weight of 99lbs/less they can get it..no legal recourse..same as movies/tv..you fit the part description or go home
