A Willoughby man is accused of raping a woman in a Bowling Green State University dorm room while both were under the influence of LSD.

John McCullough, 25, went on trial Tuesday before Wood County Common Pleas Judge Reeve Kelsey on four counts of rape, possession of LSD, abduction, trafficking in marijuana and possession of drugs.

According to the Sentinel-Tribune Daily Newspaper in Bowling Green:

MucCullough raped the 19-year-old freshman on April 8, 2010, while two of her male friends — who also used LSD — were in the room.

The alleged victim testified that if she tried to yell for help, the defendant would grab her throat.

She also admitted the drug “somewhat impaired” her thinking. In addition, her friends were only a couple feet away from the assault, but were wearing headphones and could not hear the attack, she testified.

Defense attorney Scott Coon is arguing the sex was consensual. He showed the jurors security camera footage from the dormitory hallway showing the woman leaving the room five times during the alleged time of the rape. Coon also provided records to show the woman made or received 12 calls from her cell phone during that time — none to 911.

The trial is scheduled to last four days.

kinda sketchy..

how do you get 4 counts of rape stemming from one incident?

even sketchier

If he is still accused of raping and the trial is scheduled to last 4 days, then it's likely that there's no verdict yet. Quality journalism right there...

^ LOL nice catch, I didn't even see that. I like the line right under it too:

So according to the journalist, he raped her, but she's an alleged victim.

if she was walking around, if she had a normal amount of lsd, she was likely in possession of her faculties. she may have had a more hedonistic orientation in her mindset..

hmmmm ???

Her friends were in the same room with her and didn't see the rape?

I honestly don't know what to think in cases like this other than it's sadly all too common of a scenario, especially on college campuses.

The question of consent is very difficult to pin down after the fact when the act occurred while the involved parties were in no state to even comprehend what was going on at the time. While it's obvious that the accused acted immorally (the girl is clearly traumatized by this event), it's hard to say if what he did was actually rape in the legal sense. Because of conflicting accounts and the nature of LSD intoxication, we will never know if he forcibly had sex with her in spite of her objections or if she consented at the time but later felt she did not. At the risk of coming off as unsympathetic to rape victims, I think justice is best served by dropping the rape charges against this guy. It's better to let a possible rapist go unpunished than to ruin an innocent mans life because of false accusations when the case is this murky.

p.s.

This is a reminder why it's best to reserve sexual activity while tripping to someone that you already are involved with.

It must have been refreshing to write about something other than people under the influence alcohol in connection with rape.

ha! the thing is, in addition to being terrible writing, it's also pretty reflective of society. when someone is accused of something as hate-able as rape, people have a hard time remembering "innocent until proven guilty."

While it's obvious that the accused acted immorally (the girl is clearly traumatized by this event)

I don't know what Draconian society you come from, but in the Western nations, we have a notion called ""Presumption of innocence". Which is slightly misleading. But what it means is that being accused of something does not equate to being guilty of it. That's why in Western civilizations we have what are known as trials and that guilt must be proved beyond a reasonable doubt.

I can say you were the person I saw push down an elderly man and nick his wallet last week. That's an accusation. It doesn't mean it's true. And it certainly does not mean you're guilty.

it's hard to say if what he did was actually rape in the legal sense

It's hard to believe this case even made it to a courtroom.

"She also admitted the drug “somewhat impaired” her thinking. In addition, her friends were only a couple feet away from the assault, but were wearing headphones and could not hear the attack, she testified."

"He showed the jurors security camera footage from the dormitory hallway showing the woman leaving the room five times during the alleged time of the rape. Coon also provided records to show the woman made or received 12 calls from her cell phone during that time — none to 911."

I am generally VERY sympathetic to victims of sexual crime, especially because it's a personal issue for me.... but I also have the capacity for logic.... so she had other people in the room, she was in and out of the room five times, and on the phone 12 times..... insignificant details like that kind of make me sincerely doubt her claims.

Because of conflicting accounts and the nature of LSD intoxication, we will never know if he forcibly had sex with her in spite of her objections or if she consented at the time but later felt she did not.

Are you reading some other article? Because based on the information presented here, we don't even know if she objected at all.

At the risk of coming off as unsympathetic to rape victims, I think justice is best served by dropping the rape charges against this guy. It's better to let a possible rapist go unpunished than to ruin an innocent mans life because of false accusations when the case is this murky.

There is a trial where prosecutors and defense lawyers present their case and the evidence should speak for itself.

The only thing wrong here is that tax dollars are being wasted on a case where if the article is at all accurate, should NEVER have made it inside a court room.

Most people don't leave the room and come back five times and make 12 phone calls while being raped.... with two friends in the room.

^guess it makes her pretty special then. something to make her stand out from the rest. her claim to fame.

but "during the alleged time of the rape"? who knows what time it is when they're on acid?

yeah, it reeks of bullshit. with LSD in the picture, she had the ability to fuck this guy over. pun intended after the fact.
the girl is clearly traumatized by this event
did you read more of the article than i did? can we tell this, even from the article?
no state to even comprehend what was going on at the time
i can have what is equivalent to hundreds of collections of novel art dart across my eyes, while at the same time kicking ass on starcraft or writing philosophy.

it's called tripping, and it's nothing like being drunk. unless you take an absolutely absurd amount, or are new to tripping, or get a "bad trip" (it doesn't appear any of these were the case...) you're quite aware of what is going on unless you slip into a meditative closed-eye-visuals state (in which case, you aren't having sex...).

If you don't think that LSD makes almost everything you do a tiny bit sketchier than I think we are taking different acid my friend.

Looks like she had a bad trip on LSD & subconsciencely believes she was raped. Having sex on LSD can be amazing but if you are not comfortable with your surroundings, it can me a nightmare but from ive read from above with her making 12 cell phone calls & coming & going from the room showing in the video tape, she will not win this trial. Also, if I was being raoed & I had 2 friends in the same room, I would have been yelling at the top of my lungs, no matter if the person had their hands on my neck.
