Should driving under the influence of medical marijuana be punished the same way as drunk driving?

Should driving under the influence of medical marijuana be punished the same way as drunk driving?

That’s what Colorado lawmakers will soon be deciding.

Drivers with a blood alcohol level of .08 or higher are charged with a DUI. There is a similar test by other states, involving the active ingredient in marijuana, THC. Anyone who has five nanograms per milliliter of blood, is considered over the limit.

That type of bill will be introduced to the state legislature next year

Nonsense. I mean, that may be the law, but THC is deposited in fat cells and daily smokers may have unlawful serum THC levels even if they haven't smoked for hours.

(this is speculation on my part; I haven't read the research that led to the 5 ng/mL standard)

Any kind of drug will 'cloud' your ability to operate a car!!! Medical or not - it's still DRUGS! YES, they should give DUI's for that!

talk about an ironic user name

I got a DUI when I was trashed on GHB. They took blood and didn't find the GHB but I got a DUI for marijuana -- I hadn't smoked in 4 days but they still hit me for it..

5 ng/mL = 5 mcg/L

5 micrograms THC per Liter of blood times 5 Liters of blood in the average human equals 25 micrograms of THC in a DUI driver's blood.

Wikipedia:

The minimum amount of THC required to have a perceptible psychoactive effect is about 10 micrograms per kilogram of body weight.

the average human weighs 70 kg. Therefore a weed-naive person would need at least 700 micrograms of THC to even begin to feel somewhat affected.

Therefore a serum DUI level is 1/28th of an active dose.

bollocks

Yeah they BETTER get a qualified scientist to advise them an this, and actually listen to his advice unlike the Brits.

At my rehab, the cutoff for testing positive was 50ng/ml, meaning anything below that and you don't even test positive. It took daily pot smokers on average 3-4 weeks to test below 50ng/ml ! This is insanity.

If anyone is following the news in the UK, they are trying to alter to wording on their Misuse of Drugs Act such that they no longer need to have any scientists on the Advisory Board For Misuse of Drugs
[read: If they want to make a drug a controlled substance they don't need scientific opinion about it]

Lets hope Colorado does not follow suit.

In Australia they rolled out drug driving testing into a few states. in NSW (Sydney) its an offence to drive with illegal drugs in your blood stream. impairment isnt even considered. very sad huh?

thats how it is in georgia, detectable amount = dui

I live in Colorado, and marijuana is so big here that there is no way this law will pass if put to a public vote.

There are parts of the city where there are more medical marijuana dispensaries than Starbucks, and so many people are prescribed marijuana that it would be absurd to turn around and cite them a DUI for "taking their medicine".

Marijuana possession, in relatively small amounts, is a laughable offense here. In Boulder, you get punished more harshly for littering than you do for marijuana possession. That being said, I did have a friend in college who got a DUID for smoking a blunt while driving, so this law isn't completely revolutionary.

you can get a dui for benzos or opiates or *any* drug in my state. doesn't matter if you are just "taking your medicine"

We have 10 dispenseries in my small town in colorado... ...this law seems a little extreme to actually pass in CO
