12 Arrested In K-2 Undercover Sting

Posted: 10:32 pm EST November 18, 2010

ORLANDO, Fla. -- A synthetic marijuana known as K-2 is legal in Florida but the Polk County Sheriff says he won't tolerate stores selling it.
Sheriff Grady Judd is using a state law that prohibits the sale of imitation controlled substances to arrest anyone caught selling it even though the law doesn't ban possession of the substance.
He sent deputies undercover to try and purchase K-2.

This is ridiculous. If it's legal, then that sheriff has NO RIGHT to try and arrest anyone because he disagrees with what a person wants to use or not use.

By his reasoning, I need to go arrest him since he drinks alcohol, and I think that he shouldn't.

This is just a microcosm of the bigger picture, the govt. telling us what we can and can't eat/smoke.

Fire that fucker.

Judd said deputies will go back to the same stores where they made the arrests to make sure the stores do not try to sell the synthetic pot again.

Judd isn't the brightest light-bulb if he's going to publicly announce future potential undercover sting operations. If I read this and was a store owner I'd wait for customers that purchase normal products and become regulars before offering it to them (most are gas stations or liquor store/markets anyway). Or better yet go completely off the grid considering they conveniently offered pictures of where they busted. On top of that I'm pretty certain you can see what car they took the pictures from in this slide.

In short: I feel Judd is only concerned on getting a promotion/raise by talking loud and demonizing "K-2". You were a nobody now you're a local hero, ruining lives when there are (probably) worse crimes occurring or unresolved.

:\

the synthetic marijuana is usually herbs, spices or other types of dried plant material sprayed with synthetic THC, the active ingredient in pot.

wrong you twats

btw they can beat these charges; I hope they take this to trial instead of copping a plea.

Interesting; I'd like to read the exact law he is charging the folks with..

817.564 Imitation controlled substances defined; possession and distribution prohibited.--

(1) For the purposes of this section, the term "imitation controlled substance" means a pill, capsule, tablet, or substance in any form whatsoever which is not a controlled substance enumerated in chapter 893, which is subject to abuse, and which:

(a) By overall dosage unit appearance, including color, shape, size, markings, and packaging, or by representations made, would cause the likelihood that such a pill, capsule, tablet, or substance will be mistaken for a controlled substance unless such substance was introduced into commerce prior to the initial introduction into commerce of the controlled substance which it is alleged to imitate; or

(b) By express or implied representations, purports to act like a controlled substance as a stimulant or depressant of the central nervous system and which is not commonly used or recognized for use in that particular formulation for any purpose other than for such stimulant or depressant effect, unless marketed, promoted, or sold as permitted by the United States Food and Drug Administration.

(2) In those instances where the appearance of the dosage unit is not reasonably sufficient to establish that the substance is an imitation controlled substance, the court or authority concerned may consider, in addition to all other logically relevant factors, the following factors as related to "representations made" in determining whether the substance is an imitation controlled substance:

(a) Statements made by an owner or by anyone else in control of the substance concerning the nature of the substance or its use or effect.

(b) Statements made to the recipient that the substance may be resold for inordinate profit.

(c) Whether the substance is packaged in a manner normally used for illicit controlled substances.

(d) Evasive tactics or actions utilized by the owner or person in control of the substance to avoid detection by law enforcement authorities.

(e) Prior convictions, if any, of an owner, or anyone in control of the object, under state or federal law related to controlled substances or fraud.

(f) The proximity of the substances to controlled substances.

(3) It is unlawful for any person to manufacture, distribute, sell, give, or possess with the intent to manufacture, distribute, sell, or give an imitation controlled substance. Any person who violates this subsection is guilty of a felony of the third degree, punishable as provided in s. 775.082, s. 775.083, or s. 775.084.

(4) It is unlawful for any person 18 years of age or over to knowingly sell or distribute an imitation controlled substance to a person under the age of 18 years. Any person who violates this subsection is guilty of a felony of the third degree, punishable as provided in s. 775.082, s. 775.083, or s. 775.084.

(5) It is unlawful for any person to place in any newspaper, magazine, handbill, or other publication or to post or distribute in any public place any advertisement or solicitation with reasonable knowledge that the purpose of the advertisement or solicitation is to promote the distribution of imitation controlled substances. Any person who violates this subsection is guilty of a misdemeanor of the first degree, punishable as provided in s. 775.082 or s. 775.083.

(6) No civil or criminal liability shall be imposed by virtue of this section on any person operating in accordance with the Florida Comprehensive Drug Abuse Prevention and Control Act who manufactures, dispenses, sells, gives, or distributes an imitation controlled substance for use as a placebo by a licensed practitioner in the course of professional practice or research.

this wont hold up

appeal the fuck out of it

then sue the police department
If it comes to that, sure. But I strongly suspect this will be dismissed before it ever gets to court. They already got a headline, which was all the probably really wanted.

I dunno if they'll actually be convicted or not.

The law is intended to stop people from saying that baking soda is cocaine, and selling it as if it were. No one is saying that K2 is marijuana. They're saying it's like marijuana. That's not the same thing by any means. I don't think the law can be stretched like this.

Ultimately, though, it comes down to what the clerks said. Depending on what they said to the people they were selling it to, they could be screwed. I'm pretty sure if they even talked about non-incense uses of the product they're going to be in trouble regardless.

It's a federal offense to use a product in a manner inconsistent with its labelling (would have to double check to see if incense is covered by this law), and if they were marketing this to customers in such a way (anything but incense, again!) they could still face penalties.

Some of these fucks are tough though. I went to buy some "Kush" once (a JWH-073 containing blend) and the indian guy behind the counter starts telling me that I should buy the 5g pack, only fifty dollars he says... I said no four times before he relented and sold me the 1.5g pack.

PLEASE tell me he didn't arrest the people working at the counter if they weren't the owner or manager. Because i think he did. Which is fucking insane.

Not to mention, as stated above, the law he is arresting them under has nothing to do with k2. It pains me to think about how i live in a time when the government has so many better things to be doing but they are instead wasting time on what people can and can't do with themselves when it doesn't concern hurting anyone.

Fire that fucker.

If the people let the government decide what foods they eat and what medicines they take, their bodies will soon be in as sorry a state as the souls who live under tyranny.

Thats because the people in our government have no money and are thinking of ways to get back what they once had much of.. unfortunately they came up with the conclusion of declaring war on their own people/constituents.

He is trying to get a promotion by making other people suffer.

In his case, he's trying to get reelected. Marijuana is one of the worst states in the US, and a lot of counties elect their cops instead of hiring them.

Apparently there's a lot of excitable moms in Polk County
