Spice now illegal in Idaho and Oregon

Published: October 15, 2010 at 9:37 PM

ONTARIO, OREGON -- Starting Friday, it is now illegal to sell, buy, and of course, smoke Spice in Idaho. Spice is technically an incense, but some people smoke it to get high. That caused concern among state and local leaders.

As a result of that concern, swift action was taken to outlaw Spice. First in Meridian, a city-wide ban was approved earlier this week. Friday, Governor Butch Otter signed a temporary statewide ban on the chemicals commonly found in Spice.

One spice seller told us that other sellers might turn their attention to Oregon to make money off it there, but now, they'll experience the same roadblocks across the border.

In almost simultaneous action with Idaho, the city of Ontario, Oregon banned Spice last week with an ordinance. Now, the Oregon Board of Pharmacy has temporarily banned the substance statewide, making spice a schedule one controlled substance, effective Friday.

In Oregon, classifying the substance as an illegal drug doesn't require the governor or legislature's approval.

They banned ALL CANNABANOID ANTAGONISTS meaning there no loopholes no other chems you can get this is by far the toughest anti spice law out there no state or country can really even match that! This is how spice will go underground states will start banning all cannabanoid antagonists and get all the chems with 2 words!

This makes economic sense. They grow and sell the real shit there. The price of bud will already drop when its legal in cali next month. They cant afford competition.

when i first read the headline "synthetic cannabis illegal as of Friday in Oregon" elsewhere I thought it meant Marinol / true cannabis derivatives. didn't even think about this poseur stuff. i doubt this will even be noticed, outside of high schools .. who else smokes these things?

Can't say i've ever tried this doppleganger cannabis stuff, but I only like the freshest greens, and don't recommend nor advocate consuming anything else via combustion.
Cannabis is so green and plentiful in Oregon, and when placed in context with the same Board simultaneously making cannabis Schedule II it seems logical.

Again though, this decision does not seem to write it into the legal code; [INCORRECT - I don't think it means possession is illegal; perhaps only statewide distribution is illegal. -- INCORRECT ] (as a Schedule I drug, it obviously cannot be sold/prescribed at all).
Oregon was the first state to ban pseudoephedrine in order to shut down domestic meth production. thereby outsourcing our market to Mexico.
Kids who want this JWH-stuff can just hit the Internets and order it from whatever other states still sell it, so long as the Feds don't step in (and they seem preoccupied at the moment).

Spice? Is that the same as the k2 stuff? I know someone who started smokin that when he got put on probation because he could still pass drug tests. I refused to smoke it because it was freakin incense. I heard that it's really bad for you also, so this is a good thing.

I choose to put whatever the hell I want to put into my body and if I want to inhale more incense than you normally inhale, I'm going to inhale more fricken incense and if you don't like it you can go about your own way, k Mr. Government? K!

If K2 and all that stuff is actually 100 percent damiana like it says (plus chemicals) its not really that bad. People smoke damiana alone for a light relaxing feeling.

NOOOOOO. I was gonna get some. God damnit. It sucks there are people out there purposely trying to illegalize MORE drugs.

And, Fuck the Boys and Girls club. They can suck my farts like a bong toke. To think I actually wore one of their tshirts when I ran out of clean shirts. Now I'll just save it if I run out of toilet paper.

You sound just like the government.
People that take our freedoms because of some hearsay.

We should have the freedom to alter our consciousness - this is a fundamental right.

Without carefully controlled studies, without any scientific evidence at all they make something illegal because, like you, they "heard it is really bad for you".

I am deeply offended by such actions, and by such a philosophy.
Do you really think that the government's job is to protect us from ourselves?

If so , they are doing a pretty horrible job.
Alcohol and tobacco are "really bad for you", but they are not illegal because of money.
Cannabis and LSD are not "really bad for you", but they are illegal because of money.
See the pattern?

Legality of a substance has little to do with its health effects.
Economics (= politics) is the determining factor.

In any case, let ME decide what to put into my body.
Just because you heard it might be dangerous - or even if you know for a fact that it is dangerous - leave my consciousness alone.

I've seen a lot of similar buzz (no pun) about this in North Carolina lately too. And it's obviously just a matter of time before it passes everywhere. Here, every time I go to the head shop there is a line of people waiting to buy spice or a knockoff brand. People from all sorts of backgrounds picking up like 10 grams at a time. It's insane...you see all the people leaving the smoke shops with shit eating grins on their face like 'woah I just scored some smoke legally...sweet".

It is really confusing to me, it's like 'they' are trying to drive people towards illegal drugs. Ban spice? Ok people will smoke cannabis. Write prescription opiates like crazy then clamp down? Ok don't worry heroin is more available and purer than ever.

However I'm glad that it's clear that legal highs are here to stay. I'm curious to see what kinda drugs get dreamed up in the next 20 years.

As of this week, I have seen what might be the very first felony case come through for "synthetic cannabis."
It was filed as a Class B Felony, Possession of a Controlled Substance Schedule I, 475.840 (3)a ... the catch-all drug code for any of the Felony substances not specifically legislated under their own code (cannabis, cocaine, meth, mdma, or heroin)

the amount was not specified; however, I assume, like other illegal drugs, any amount (even trace) = illegal, which = felony.

Excepting cannabis, which one can possess up to an ounce of, and (generally) be given only a Violation-level citation for. which, ironically, a co-defendant was cited for.

Have not heard anything else nor seen a change in legal charging documents re: my above mention of Cannabis supposedly being made Schedule II in Oregon.
As our drug laws generally follow Federal Scheduling, and as cannabis laws are very specifically codified (475.864 et al), I do not think those statutes will change, if in fact the Schedule-2 rumor is correct.
