Taken from NORML's facebook feed just a moment ago ...

The California legislature has just PASSED Senate Bill 1449, which reduces marijuana possession offenses from a criminal misdemeanor to a non-criminal infraction, punishable by no more than a $100 fine — no court appearance, no court costs, and no criminal record. If you live in CA, use the link below to urge Gov. Schwarzenegger to sign SB 1449 into law!

California Legislature Passes Marijuana Decriminalization Bill

Just hours before the state's legislative session ended Tuesday, the California Assembly voted to approve SB 1449, Sen. Mark Leno's bill to fully decriminalize simple marijuana possession. The bill passed the Senate in June and now goes to Gov. Arnold Schwarzenegger's desk.

The vote was 43-33 and largely along party lines. Democrats supported the bill 40-8, while Republicans opposed it 23-2.

Under current California law, possession of less than an ounce of pot is punishable by no more than a $100 fine, but is still a misdemeanor. That means people busted for a joint or a half-bag must be arrested, booked, and appear in court, and they get a criminal record. It also means meaningless work for the police and the courts.

Marijuana possession is the only California misdemeanor with a set maximum fine and no possible jail time. The Leno bill changes the offense to an infraction, meaning no arrest, no booking, no court appearance, and no criminal record.

"The penalty for possession of less than an ounce of marijuana is a fine of $100, with no jail time," Leno said on introducing the bill. "If the penalty is $100, with no jail time, that is an infraction. That is not a misdemeanor."

Keeping simple possession a misdemeanor has had "serious unintended consequences," the San Francisco Democrat said. "As the number of misdemeanor marijuana possession arrests have surged in recent years, reaching 61,388 in 2008, the burden placed on the courts by these low level offenses are just too much to bear at a time when resources are shrinking and caseloads are growing."

GOOD LUCK California! ! !! i wish my state was as cool as California... :( ^^^ So does that mean that its is now decriminalized in Cali if Arnold signs it into law??

Unless the Constitution is amended, then he can't become president, ever.

And good job California--now for a federal decriminalization law.

All this decrim stuff still keeps the trade underground, with all the crime and lack of tax money that goes along with it.

All it does is keep the end user form getting a criminal record. It doesn't change availability, quality, related crime, or the governments revenue.

Why the hell don't they stop this tip toeing crap and legalize it?

Sell it openly, all kinds of cool strains, and tax it.

Patience. November is only 2 months away.

I have a feeling Arnie will veto this, he is in the GOP and all.

Yeah, for a Republican, he's remarkably socially liberal; I guess you could say he's almost squarely a libertarian of sorts. For instance, he has refused to defend Prop 8 (the gay marriage ban) during the recent challenge in the California Supreme Court over its constitutionality.

God bless the Terminator... This really is great news if he passes it - I don't live in the States but they do lead the way in many aspects of our lives. With Holland and California (and numerous other states) showing a more realistic approach to marijuana use (and control) this is great.

Progress, definitely, but for the rest of us I fear it's going to be a long, long wait.

Damn, I always thought it was a Violation long ago in Cali, like it is up here*

* unless you are allegedly within 1000 feet of a school 8)

Though here the fine is 6X as much. And will suspend your license for 6 months unless you opt for the brainwashing program.

Luckily Cali cops really don't care anyhow. Feniks was busted with a friend way back when, we got half our stash back and no one got charged.

Regardless of what state you're in, I've been thinking to myself for a while that, recession aside, businesses who discriminate against potential recruits with any hits on their record must have a hell of a time finding quality candidates these days, what with everyone in the Government's net.
Though the mighty Feniks still has a stellar record despite the multitude of interstate felonies committed in less-educated youthful days .. all those tax dollars and a dangerous offender escaped undetected, for shame.
