out there, surfing the psynapses


for those who dont know, i will give a quick rundown.

18months ago, somebody dobbed me in to the police,
cuz i had 6 tiny seedlings growing in a box, and had a cupboard in my garage full of grass. all up, they weighed around 4.5 kilos. 60% of this was leaf and stem tho. the left over stuff from the trimming process. they still got 2 kilos of good afghani heads tho.

they also got, 27 grams of dried mushrooms.
a blend of psylocibe subeareginosa and psylocibe azurescens

now, you would think that it was the grass that they would be most concerned with,yet that was not the case.

they charged me with 27 grams of psylocen. which put that up into the category of commercial trafficking of a large amount of a prohibited substance.

they were attemting to make out like i had somewhere in the order of 10 000 + doses of a dangerous drug. idiots.
when it was clear to anyone that saw the bag, that it was a small bag of dried shrooms.

the judge saw it like that thankfully, and gave the prosecution a stern earfull for distorting the facts.

if the crown{prosecution} had convinced the judge, i would have looked at a minimum of 10 years before parole. craziness eh.
as it was, the crown, after all that, still pleaded with the judge to give me no less than a fulltime custodial sentence. she was a right bee-atch.

so, anyways, the upshot of all this is, i am free. conditionally.

i have a 22 month suspended jail sentence,

300 hours of community service, a counceling programme to attend,

and also, a 12 month good behaviour bond.

much better than a fulltime custodial sentence.
i have a certain sense of relief that it is finally over.
yet, at the same time i feel very bitter and violated.

so anyway, i am free to be with my kids, and my wife,

and am free to go to psyfari. YAY

for all of you who have wished me well, with my run in with the law, and the courts, i thankyou kindly.

mods. i feel this is relevant to us all here, and a lot of bl'ers have followed the story, and all want to know the conclusion.
however, i will also understand if you think it should be removed. if you want to remove it, i would ask if you do it after 1 week, so people to get to find out the conclusion, ask questions etc, without clogging up somebody elses thread, like the mushie thread. thankyou.

Awesome news mate, first smile I've had all day :) It seems ludicrous and almost comical that a small bag of mushrooms could potentially land someone in that much strife. It's a crazy world we live in..... All the best of luck for the next 22 months of being a squeaky-clean and upstanding citizen %)

Mate forget the mushrooms, for that alone I find it incridibly hard to belive that you got let off without any time to serve.

Count your blessings, and learn to be more careful in the future. Although with a good behaviour bond carefull shouldn't be the issue, more so abstinance.

You fucked up, you got VERY lucky. Good to hear that there's not another poor soul in the clink for harmless ethobotanics but I dont think the thread has much merit other than that.

Wait, suspended? That would equate to you doing that time at your discretion wouldnt it? ie. you have to do it just the when part is up to you?
 
This doesn't have a real purpose here. But under OPs request I will leave it open for a while.
 
It's a good lesson to all of us to be careful.
In the future we might not all be so lucky to have a judge that is wise to the prosecutors tricks.
 
yes, i am very lucky. thankfully i have a near spotless record.
and i also had a good barrister, and also, the judge was very good. she looked at all the photos and just saw bags of unprocessed lesf, as she put it. she claimed that it was worth next to nothing and didnt see why i had even taken it from the person that gave it tio me. i was surprised too, that there was no mwnbtion of the heads. but anyway i am not complaining.

yeah, abstinence is going to have to be the way for me for a while, as they want to do random urines.
i dont use grass very often anymore, since the bust, so thats ok. i no longer use hard drugs like smack or ice, so thats ok.
i do hawever, love my acid and shrooms, so i will be thinking very long and hard about wether i should indulge or not.

i just read in the reports that i got, that it was 4 kilos including the glass jars. so at court it was a lot less. they were actually talking of the leaf only just beimg over the indictable amount of one kilo. it was at the lower end, when 25 kilos was at the top end.

all in all, it doesnt matter about the weight now, as it is over.
and thankfully the crown saw fit to drop ythr deemed supply of psylociben, as i plead not guilty and was prepared to have a trial. any way, they dropped that and got me on posession, which was enough anyway.

thanks sykik, for agreeing to leave it up for a little. as i said, it will stop other threads getting taken over by people responding to this.

yes, i agree sameria, and that is what is influencing the bitterness.
especially as i was not dealing either. it was just perso, to last me a year or two, and to give to my parents and bro in law. to save them some money.

i told the judge that, and she believed me too. it was fairly obvious i wasnt not in it for financial gains, as when you looked at the footage they shot and the stills photos, that there was no gigantic flatscreen tv, no hot car, only one mobile phone, nothing at all that screamed illegitimate wealth. most people when they see our place wonder how we do with so litle stuff, but that is the way we like it. our wealth is in the time we spend together, not the cargo we collect.
the only thing they could have suggested was the fact that my music studio had 2 pc's, and a number of synths , mixers, drum machines, grooveboxes, vinyl and decks, controllers, mics and the rest. yet , it was all bought legitimately anyway.
and they didnt know what any of it was anyway!!

anyway, it is a lesson for all of us here, that our freedom can be seriously threatened, if we get caught doing the things that we do. a lot of us on this site could get in very deeep traouble, for doing things we think are not very harmful. we all tend to forget that what we do is illegal. i know i did, as i went my entire life without any major trouble with the law.

so, stay safe everybody. harm reduction is not just about reducing the physical and emotional/psychological damage.
it can also extend to reducing the chances of having to deal with the law and the judicial system.
 
So glad to hear you got off without a custodial sentence mate! It's a fucked situation but you came out pretty much as best as you could of hoped.

I hope your celebrating in a wholesome and legal way :P sucks you will have to abstain for a while, but atleast you can be with your family and thats the main thing. Make sure you behave yourself now mate. ;)

I find it hard to believe the police are really that ignorant. I'd say they're more likely just being c*nts as some, but not all, are. Hats off to the judge for realising this.

Glad to hear it worked out as best it could, and sorry for your predicament.

Yes it does! It is a grave concern for people who pick mushrooms, and people need to understand the dire legal consequences of possessing dried mushrooms, that is a MASSIVE harm minimisation issue, especially this time of year. I had no idea until I saw psynapa's comments in the other thread, this needs to be advertised widely and loudly. I've had mates get busted recently and when I told them what this guy was facing their faces went ashen, if it had of been last year, well, I can't say amounts but they would have been done with considerably more than psynapa. There's at least two dudes who won't be stockpiling this year.

What state are you in, psynapa? Just out of interest?

That's the silly thing about it all. The law fails to realize that this is a SEASONAL mushroom...therefore not available at all times of the year. It just ffucking stupid really.

I also think this thread serves a place. Most people think personal collection of mushrooms is a minor legal matter. Obviously not so small after reading this thread.
 
I seem to recall psynap making reference to trips to the blue mountains, so I am guessing NSW but I could be wrong eh.

I am also interested to hear how you got done with no drugs mr ibis, there must be a decent story behind that, although it probably doesn't belong in this thread.

I have to agree with bit pattern this is a good reminder that picking, drying and consuming psilcybin mushrooms is against the law. It is easy to get in a casual routine and really forget what you are doing is quite illegal. I have definately been a lot less secretive about picking in the past than I am about doing drug deals etc. and much less wary of drawing attention to myself than I would be if in possession of similar relative quantities of any other drug. I guess it's just easy to forget the world is THAT absurd you can be arrested for removing a (non endangered I might add) mushroom from the ground.

being awake for 3 days, beaten and bruised until a confession of guilt was made in line with the bullshit allegations of emo kids who stole the drugs i supposedly had in the first place.

suffice to say, the stronger allegations and bullshit was dismissed, i just took the wrap on the possession and use charges to get the fuck out of there.

There was a heap of other charges for various things (mostly driving offences) that were heard at the same time, which account for some of the sentence.
