Australian Analogue Legislation

Hey guys, what's happening?

I am in a wired mood and I am not sleeping so instead I wanted to read the analogue acts in Australia, the state and federal legislation. :)

Does anyone know where I can find these or have a copy of anything? I've tried searching austlii but came up with nothing, maybe I didn't look hard enough.

Also, does anyone have a PDF of scheduled substances in Australia? I used to have that and handed it out to a few BL'ers, but now I've lost it and am rebuilding up my data after a year off Bluelight. :)
 
For importation offences the analogue legislation and the list of substances covered by the analogue legislation is found in the Commonwealth Criminal Code. I cant remember the exact chapter off the top of my head but you'll know you're in the right spot when you start reading about border controlled substances etc.
 
p_d has posted the long and short of the code here on bluelight, it more or less states that any drug that is substancially similar to an already scheduled substance (lets say more than 50% of the molecular make up is identical - ridiculous i know), it is considered an analogue.

Or the chemical in question produces the same pharmacological profile as an already prohibited substance, or produces a prohibited substance in vivo (prodrug).

I thought that the Federal Act wasn't that broad, whereas some of the State acts were?

I haven't got time to look at everything now, but thanks for the links everyone I will have some reading ahead of me today! :D

Ahh yes, try to import any of theses substances and you will be breaking the law. BUT - the analogue laws for importation do not apply.

To get busted for importing an analogue, the drug must be an analogue of one of the drugs listed as a "border controlled" in the Commonwealth Criminal code. This list is decidedly smaller than the import/export controlled list.

DISCLAIMER - This is not an authoritative statement of the law, merely my interpretation of it. Although I am a solicitor (well lowly articled clerk) i have no criminal experience and therefore, dont rely on what i say. Ohh and to any law enforcement agencies monitoring these boards...can i have a job?? please..i want to remember what the sun feels like. =D

I'll do some Bluelightin' then I'll start reading the Criminal Code as it pertains to drugs and border controlled substances. :)

lol... fun for some maybe.... although the idea of being bent & nailed by the feds is definitely not my idea of a good time! :o
 
according to the Aus laws List of drug substances requiring import and or export authorisations that is to say, cantharides, cantharidin and yohimbine,preparations containing cantharides, cantharidin or yohimbine, and any other substance or preparation that is, or is likely to be, productive, or is capable of being converted into a substance that is, or is likely to be, productive, of effects substantially of the same character or nature as, or analogous to, those produced by cantharides, cantharidin or yohimbine.

So this means i cannot order ay yohimbe or yohimbine products from Aus?
