Execution of Briton Akmal Shaikh: China defiant in the face of criticism

China has warned Britain it risks harming diplomatic relations between the two countries after Downing Street condemned the execution of Briton Akmal Shaikh for drug smuggling.

Jiang Yu, a spokeswoman for the Chinese foreign ministry, told a press briefing in Beijing: "No one has the right to comment on China's judicial sovereignty.
"It is the common wish of people around the world to strike against the crime of drug trafficking.

Asked about comments from Gordon Brown, the British Prime Minister, who said he was "appalled" at the execution, Mrs Jiang replied: "We express our strong dissatisfaction and opposition to the British Government's unreasonable criticism of the case. We urge the British to correct their mistake in order to avoid harming China-UK relations."

The Chinese embassy in London said Shaikh, 53, from Kentish Town, north London, had "no previous medical record" of mental illness and that his rights and interests had been properly respected.

Shaikh, who was convicted of smuggling 4kg of heroin into the country, was executed in the early hours of this morning despite last minute pleas for clemency from his family and campaigners.

The statement continued: "During the legal process, Mr Shaikh's rights and interests were properly respected and guaranteed and the concerns of the British side were duly noted and taken into consideration by the Chinese judicial authorities.

"Out of humanitarian consideration, visas were granted to the two cousins of Mr Shaikh on Boxing Day, and they were given access to meeting Mr Shaikh in China.
The statement said Shaikh, who was arrested in September 2007 in Urumqi, north west China, was convicted of "serious" drug trafficking,
"The amount of heroin he brought into China was 4,030g, enough to cause 26,800 deaths, threatening numerous families," it said.

The statement concluded: "The legal structures of China and UK may be different, but it should not stand in the way of enhancing our bilateral relations on the basis of mutual respect."

In a statement issued by the British Foreign Office, Mr Brown said: “I condemn the execution of Akmal Shaikh in the strongest terms, and am appalled and disappointed that our persistent requests for clemency have not been granted,”
Shaikh's family insist that he suffered from bipolar disorder and that he had been tricked into carrying drugs by a criminal gang.

Mr Brown expressed his anger over the fact that the Chinese authorities had persistently refused to allow Mr Shaikh to be examined by psychologists.

“I am particularly concerned that no mental health assessment was undertaken,” Mr Brown said.

The execution of Mr Shaikh was apparently carried out by lethal injection, according to British diplomatic sources.

It is the first time an EU National has received the death penalty in China since 1951, and comes after two of Mr Shaikh's cousins flew to China to make a last-ditch appeal for clemency to China’s courts and President Hu Jintao.

In a statement issued by Reprieve, the legal charity, Mr Shaikh’s family talked of their sadness over China’s unwillingness to commute the 53-year-old father of five’s death sentence.

“The family express their grief at the Chinese decision to refuse mercy, thank all those who tried hard to bring about a different result, and ask the media and public to respect their privacy as they come to terms with what has happened to someone they loved,” the statement said.

Reprieve’s director Clive Stafford Smith attacked China’s handling of Mr Shaikh’s case. “Is the world somehow a better place today because China refused to show compassion for an obviously ill man? Of course not. China’s refusal to even allow a proper medical evaluation is simply disgusting,” Mr Stafford Smith said.
Shaikh had no previous criminal record and had flown to China in the belief that he would become a pop star.

On Monday, six witnesses who knew Mr Shaikh came forward to support his family’s contention that he was a manic depressive prone to delusional behaviour.

Shit :( That must be so awful for his family...
I didn't know when this was going to take place but I was hoping that diplomatic talks between the the spokesmen for each country would have resulted in sending this guy back home and he would be tried here (UK) instead.. I suppose that was naive of me :\

R.I.P

Bullshit executions like this make me sad :(.

The fact the Government is only raising "mental health" concerns, and nary an argument about the scale of punishment > crime, makes me sadder.
No doubt if this had been Akmal Shaikh from Saudi Arabia, the world would never know.

China's revenge for the opium wars perhaps?

I know Thailand has been big on executing drug offenders as well. Maybe a few more high-profile executions will make people re-examine preconceived notions about the righteousness of executing non-violent offenders / incarcerating victimless criminals.

Doubtful. Mexico's drug war has killed 3X more people than 9/11 just this year, and we're only releasing drug offenders early because the states literally can't afford to keep them for their full sentences.

RIP with a prayer, white light & love. This dude seems pretty kool, sorry it took the chineese gov. to take him down. special thanks for the cuzins who went outta thur way.

Dunno what its like in the UK and US, but after several Aussie got fucked up in Asia a few years ago people know not to fuck around over there. Some still do of course but if they get caught its kinda "well you can't say you didnt know"

I wonder how much cash he was going to make off this. He sounds like a mule.

^ Some of your post was very inappropriate, this mentally ill man was executed for taking a substance from point A to point B. Heroin doesn't destroy families, people who can't control their own heroin use destroy families and that is nobodys fault but their own. Adulterated heroin of fluctuating purity is what kills people for the most part, sure its possible to die but most people aren't going to OD knowing their exact dose.

My heart goes out to this guy and his family, it really sucks this had to happen. I wonder how many child molestors, rapists and murderers they let off without being executed over there? Yet this guy has to die.

I wholeheartedly agree (though I don't know about the "inappropriate" part, since you edited it out).
Alcohol abuse kills FAR more families than heroin abuse.
Even tobacco use (as directed) kills more people/families than heroin abuse.

The man was carrying a relatively small amount of a drug.
He most definitely didn't deserve to be killed for this.

Having not followed the case, where's the evidence for mental illness? By all accounts he had no previous diagnosis, it sounds like a last ditch effort to defend him.

If someone from overseas came into Australia and then committed a serious crime, I'd expect them to be punished to the full extent of local law. I don't support the death penalty and I sure as hell don't support drug prohibition, but I don't see any reason why he should be treated differently to any chinese citizen caught with 4kg of heroin. When you enter another country you're agreeing to abide by their laws.

sorry for the rant..

this sucks! thats pretty brazen of china, kinda egging on the west, since there is this on-going animosity growing. funny thing is our govt may be even more controlled by almost-centralized mega-corporations than china is, and regarding human rights, we basically live in a police state. Angry? inflammatory? well please hear me out..

Lets look at some statistics! according to census.gov[1] which I'll be using for the next few numbers which are based on the 2009 census. 74.3% of the US population is Caucasian, and 12.3% is African American. Unless there are certain social reasons(of course there are, just another part of the feedback loop of racism that maintains the stratus of power), as a biological reasoning would be difficult to prove as well as a crass hypothesis in the first place(that's the old way of oppression anyways, its way too obvious). For whether one race is more inclined to commit violent or other high-caliber crimes is not really something that can be gauged, but both parties(in this case, African American defendants and Law Enforcement, Judges, and Juries) could be visualized to take part in a feedback loop. Ie. racist history that shapes current laws and distribution of wealth(ie. generational wealth) causes common inequalities that shape common patterns and behaviors within those in power and all members of society. Dis-inclusion from quality school systems since public schools are funded by the tax brackets of the surrounding area, so low income areas produce poor schools(no pun intended). This perpetuates the class system in obvious ways. For a remotely "equal" society one would expect or hope relatively consistently proportional population sizes compared to the # of executions. The consistency of the proportions is important in providing a convincing reason to believe it to be a pattern.

Texas, the most trigger-happy state regarding capital punishment, where execution means the warden with a magnum and and apple(ok I made that up, maybe I shouldn't be joking on a thread like this, but I gotta keep our spirits up for these next few set of statistics), has a population that is 71.4% white and 11.3% black[census.gov again]. The statistics on the death penalty in Texas[2] show that since capital punishment has been re-enacted in '76, there have been 166 executions of blacks, and 204 executions of whites in Texas. That's only 38 less executions of blacks than of whites in a state where blacks are only 11.5% of the population, state-wide. The # of blacks currently(as of July 1st '09)waiting for their demise in death row is currently 142, whites being 107.

Keep in mind there is no race gene. "race" a real scientific term, [source[3]] It is often unclear how race is defined by the input and the options available for the stat, also what happens to those who have parents of different ethnicities? so these statistics are more guidelines to patterns than anything. However more research will show that this the normal way of business and should be considered genocide imo. On deathpenaltyinfo.org, same page as the source above, they compiled the stats from '76 including the race of the victim of a crime resulting in a death sentence, which also supports the fact that the US govt is a racist state, black president or not. Excluding crimes which resulted in multiple deaths, the number of white defendant / black victim crimes that resulted in a death sentence for the white defendant is 15. For the black defendants, the death rate is 245.

dont believe me? look:

I meant "Race is *not* a scientific term" btw in my above post

publicly, what does killing a drug smuggler do if you are in charge of the country....? makes ya look bad, also makes you look like you were reallly fiending for some dope! we all know the US govt runs a big part of the illegal drug market, hence its commitment to the "drug war" which just makes sure the market is still a black market, which is profitable, while keeping the christian "moral majority" happy lol. Some christian fundamentalists have a lot of power too so they help in this process by funding part of it, though I doubt they realize, if they do, they run it too. I mean, they are part of the socialization process which enforces drugs as this mystical forbidden fruit until you finally taste it. and at that point you may be misinformed, or you try pot first, and think hey this isnt bad at all! all drugs must be like this! and this is most likely the type of statistic that could be used to backup the "gateway drug" claims ironically. there are a lot of games that are meant to stay in action as long as possible, maybe this is some sort of power grab, but over 4kg(which IS a lot, to whomever posted that it wasnt.., you know metric?) but if you mean that this is some sort of drug bust that was planned. if it was, how do we know that only 4kg was "found". Maybe China is running a drug business from the top-down like we are, and is only exploiting the fact that the west thinks he is a crazy pinko totalitarian to perform a huge change(or maintainance) in the illegal drugs market

The media has really sucked this story dry. The Sydney Morning Herald reported that he died by firing squad when other outlets (noticeably British tabloids) have stated lethal injection. The man was carefully deceived into carrying the substance in question for reasons which are quiet clear in the article yet his reason for clemency was having a mental illness. It just seems too much sympathy was trying to be gained through making a 53 year old man seem naive through his dreams of a singing career instead of focusing on his supposedly debilitating mental illness.

From face value the courts do seem extremely biased and unreliable when it comes to a subject like this but just remember that drugs don't always just effect the user but the chain of events that preceded or proceeded in the case of this trafficker.

So, evidently, possession of 50 g of heroin is a capital offence in China. This is quite a bit more than I had originally thought, yet quite a bit less than this man had.

Anyway, a lot of folks here have said stuff like, "Don't fuck around in China, those dudes will KILL you!". That's sorta always been my opinion. And after mulling this over, I can think of only two reasons why anyone would smuggle drugs in China. First, they have a "death wish". Meaning, they like to gamble with their lives. Something akin to skydiving. If that were the case, then I say China was right for killing this guy. I mean, who would want to skydive if they were GUARANTEED to live? The second reason, of course, is that the guy was just plain nuts. And it probably is morally objectionable to execute a true lunatic.

who the hell smuggles drugs into china, seriously? either way though he was fucked wherever he was taking that shit.
