Mints Believed To Be Crack Land Man In Jail

KISSIMMEE, Fla. -- A man is suing the Kissimmee Police Department for an arrest over mints. When officers pulled Donald May over for an expired tag, they thought the mints he was chewing were crack and arrested him.

May told Eyewitness News they wouldn't let him out of jail for three months until tests proved the so-called drugs were candy.

May said he was just minding his business, driving home from work, when a Kissimmee police officer pulled him over near 192.

"I don't know how it occurred," he said.

May was pulled over for an expired tag on his car. When the officer walked up to him, he noticed something white in May's mouth. May said it was breath mints, but the officer thought it was crack cocaine.

"He took them out of my mouth and put them in a baggy and locked me up [for] possession of cocaine and tampering with evidence," May explained.

The officer claimed he field-tested the evidence and it tested positive for drugs. The officer said he saw May buying drugs while he was stopped at an intersection. He also stated in his report May waived his Miranda rights and voluntarily admitted to buying drugs.

May said that never happened.

"My client never admitted he purchased crack cocaine. Why would he say that?" attorney Adam Sudbury said.

May was thrown in jail and was unable to bond out for three months. He didn't get out until he received a letter from the Florida Department of Law Enforcement and the State Attorney's Office that test results showed no drugs were found.

"While I was sitting in jail I lost my apartment. I lost everything," he said.

While May was behind bars, the Kissimmee Police Department towed his car and auctioned it off. He lost his job and was evicted. Now May is suing the city for false arrest and false imprisonment. He wants to be compensated for the loss of his car and job.

May's attorney and the city of Kissimmee discussed a possible settlement last year, but failed to reach an agreement.

What an absolute wanker that cop is! :!
And how on earth did he think he would get away with such a thing, or that what he was doing was right?
Fucking mush-for-brains... :|

Wow they ruined his life for this.... They auctioned his car ffs. I wonder what the settlement will be. 3 months of unjust imprisonment, that man deserves to get paid.

Okay, there has to be something else to this story. This guy looks pretty white to me. Furthermore, drug tests don't take 3 months.

If it is completely true then obviously the guy deserves to be set for life. But something tells me there's a missing element that we don't know about.

hhhmmm? maybe. But i got caught with a bag of m der 2 years ago, and it was four months B4 they knew what it was to charge me, but i cant c wats so fuckin hard about it 4 it to take 3 months!!? probably just the lazy ass cops round here!
cant believe they just towed away his car and sold it, dats just low....
I cant see why they would got a positive on field test? wtf was he testin 4, sugar?
I think you could be right. that cop had to have something against him 4 this to happen, i mean, he doesnt excactly look like a crack dealer. he must have upset somebody......:\

That is pretty fucked, what a retarded cunt of a copper.

Hopefully thi guy gets paid out big time and the piggy gets fired. Maybe when they actually start punishing officers properly for such misconduct it will stop happening.

i still think trancendance mite be on to sumting...?
I mean, no-one's that fuckin retarded are they?? these are the people in charge, and they make a fuck up like this?...na, some1 had it in 4 dat guy, watever he did.....

It's always a shame to hear stories like this. Police in this country do stuff like this all the time. It's totally ridiculous and that guy definitely deserves to get paid.

It is extremely naive to believe that innocence is a defense against the state and its employees.

Police harrassment like this has nothing to do with the facts. The officer believed he was destroying evidence, regardless of the situation, and pursued it.

Every time (and I mean this literally, every time) I am pulled over for a moving violation (speeding, headlight out, etc), I am told they have probable cause to search me and my vehicle due to the 'aroma of Marijuana'. However, I haven't smoked Marijuana since highschool, before I got a drivers license, and have never let anyone smoke Marijuana in any vehicle I've owned.

This is the cops way of saying "I don't like the look of you, so I'm going to see what you've got". You can't resist or protest, you may end up with a resisting arrest or obstructing a police officer charge- whether they find anything or not.

I sincerely wish everyone knew what it feels like to be singled out, profiled and harrassed by police.

A good article on the subject:

White in the Middle of Richmond
I live in Berkeley, which is in the East Bay of the San Francisco Bay Area. Although I could score on the street in Berkeley, for various reasons I do all of my business in Richmond which is a couple of cities north of Berkeley.

Berkeley White, Richmond Black
Berkeley is mostly a white city and I'm a white guy. Richmond (at least the parts of it that I visit), on the other hand, is almost completely black. Those people who aren't black are Mexican. If you see a white person in the neighborhood I score in, you can bet that he's there scoring drugs.

The drug hierarchy is racially divided. The Mexicans bring the heroin into the neighborhood. But the thing is, they won't deal with whites at all. I don't know if this is because of fear about police or some understanding with the blacks or what. That's just the way things are.

If you're white and you want to score heroin, you have to buy from the blacks. So the chain goes from Mexicans to blacks to whites. Even with this supply chain though, the cost is low and the quality is high. This is the main reason I go to Richmond to score rather than scoring in Berkeley.

Drug Treatment: The Ultimate Drug Source
You may wonder how I discovered Richmond given that it isn't an area I would normally go to. It all came about because of some people I met when I was in a methadone detox program. Needless to say, the detox didn't take--but I got better heroin connections.

Editor's Note: A reader responded with his own experience in the article:; Guilty of Not Being Black.

Not Black
Heroin helper seems to have some kind of psychic link with me. The day after reading your story White in the Middle of Richmond, I became the victim of this exact same thing (although in a different city).

The Chase
I was with my girlfriend, driving to my dealer's house. As we turned onto the dealer's street, I noticed a cop car headed toward us. Needless to say, we didn't stop; we kept driving, but I could see in my rear-view mirror that the cop car was making a three point turn in preparation to follow us.

It followed us for about a block and a half before its lights started flashing. I pulled the car over and two cops got out. Both of them were big guys. The one approaching me was white with a shaved head. The one approaching my girlfriend was black.

No Honkies Allowed!
The cop asked for both of our licenses, but before doing anything with them, he started asking me questions. "What are you doing here?"

I told him that we were on our way to a friends, that we had gotten lost, and we were trying to get back on the freeway.

Pleading Guilty
He asked if I was on parole or probation. I told him, no. Then he asked if I had ever been arrested and I told him, yes. He asked what for and I told him, "possession of a controlled substance."

He said, "So you're down here to buy drugs."

I said, no. This seemed to make him mad. He said, "Look, if you're gonna to try an bullshit me, I'm gonna impound your car and your gonna walk home."

Given my options and the fact that with the seizure laws, I would most likely never get my car back, I gave up. "Okay," I said. "But we didn't."

He went back to his car and ran our licenses, finding that we were clean. During this time, the black cop watched over us, not saying or doing much.

The Get-Away
When the main cop came back, he handed me the licenses. That was a huge relief because I knew it meant that we were not going to be arrested. Not that we left on friendly terms. He told me if he caught me in the neighborhood again, even if it was in a different car, he would seize the car and arrest me.

I drove a couple miles away and called my dealer. He drove to meet us at a near-by gas station. We've done that a few times now. It's a total pain in the ass--but not as a big a pain in the ass as going to jail. I don't know what this cop thinks he's doing. Does he think he's really stopping me from doing drugs? Or is this just his way of torturing other people? If it's the first, he's deluded. If it's the second, he's an asshole--I'm mean: he's a cop.

This is the cops way of saying "I don't like the look of you, so I'm going to see what you've got".
In my experience that's usually the reason a white guy gets pulled over in a non-white neighborhood. It has nothing to do with anything besides them not liking something about you. Be it how you look, your car, etc. They'll then use whatever convenient reason they want to pull you over. Tint is too dark, you got a cd hanging from your rear-view mirror, music too loud, you have a license plate frame obstructing some irrelevant writing on your license plate, you're going too slow/fast, you circled around, etc. Who needs probable cause, right?

Kissimmee ass mother fuckers!
aye, +1

Hope this guy makes out on this one. They ruined his whole life over MINTS?? Jesus christ how unreal this guy must have felt getting out. Three months locked up, meanwhile they sell off your car you lose your home and your job, and everyone you know thinks your a friggen crack head! Fuckin police state rising. Hope the kop gets busted for obviously falsifying statements too... man I hate Florida, fuckin heat makes people so damn crazy.

Does anyone doubt America is a police-state? The cops feel they have the power to examine what you are eating. WTF!

The United States is not a police state and those that actually do live in such a situation would find your comment offensive.

However, the entire "system" (which is made up of many different parts ex: education, judicial, political etc) in the United States and other first world states is discriminatory in many different ways (race, religions, sexual preference, income) and this is an effect of that.

Wow a breath mint really that's pretty messed up and if he's on the up and up I hope he takes them to the cleaners.

I've always thought it would be kinda funny to get arrested for possesion of little tic tac sized pieces of roofing tar wrapped in celophane (you could even refer to them as tar to the cop). Mainly it'd suck, but it would be kind of funny. Also this guy should sue the police, why didn't the cop just smell the "crack"? I've never heard of crack smelling minty.

In related news, there was a group in the 1960s called the Provo who would call in tips on themselves and then get busted with bags of random shit in order to make the cops look like fools. Check it out- http://en.wikipedia.org/wiki/Provo_(movement)

Hopefully thi guy gets paid out big time and the piggy gets fired. Maybe when they actually start punishing officers properly for such misconduct it will stop happening.

Cops don't seem to get fired for even wrongful deaths so good luck. I am willing to bet money this fucker gets a promotion.

I hope this guy gets paid out big. 15k is not nearly enough for three months. Over the course of a year, that would only be 60k salary, not including the loss of car, apartment, and job added to the pain, suffering, and damage to reputation. Not to mention jail is not the healthiest place and usually, from what I hear, have shittier facilities than prisons (though the cell mates might not be as bad).

I doubt the cop had anything against the guy. I think the cop was probably just power tripping, thought he had the guy when he saw him chewing, and preceded to turn off his brain for the remainder of the arrest.

Terrible story, another victim of the drug war, it is pathetic and sad I have to say this, but at least he came out alive...
