Marijuana Tax Stamps

What exactly are these? They're active in my state, here is a copy/paste from NORML.

Marijuana tax stamps: This state has a marijuana tax stamp law enacted. This law mandates that those who possess marijuana are legally required to purchase and affix state-issued stamps onto his or her contraband. Does this mean that if I purchase these stamps and put them on the bag holding my stash then I'm allowed to go without my stash being taken or getting any charges?
 
No because a lot more states have marijuana tax stamp laws than states that have medical marijuana laws. For example, in NC where I live, marijuana is outlawed but marijuana tax stamps are in place.. What does this mean? Through a little Google research I found that some states (I believe Alabama is one) they can give you a $7,000 fine and up to 7 years in prison for not having your stash stamped. Where I live though, in NC, nothing seems to happen to those that don't have marijuana tax stamps on their stash.
 
No! This law is retarded, its the gov's way of trying to tax something they dont allow to be sold those greedy fucking bastards. Basically if your ah-hustle'N & that shits active in your state & they arrest you with say 50bags without the tax stamp they make you pay mad $$. Basically if your selling illegal drugs they want to put you in jail for they want you to go to them showing your face & buying a product specifically for selling drugs*an illegal activity* and pay like 2$ each stamp & stamp each and every baggie you sell while they're trying to fuck you.
 
This basically how they got Al Capone. He went to jail for evading taxes on illegal activities. How does a law like this get past the 5th amendment? Has it just never been challenged? What reason beyond self incrimination would some one buy a stamp? Has anyone ever bought 1 of these stamps? I hate politicians.
 
Its a catch-22. You can't buy the stamps unless you have the marijuanna and if you have the marijuanna without the stamps, you are in violation of the stamp act.

Exactly, no matter what you're pretty much gettin' screwed either way. Hasn't this been a law since like the 1940's since the prohibition of marijuana?

It does not, unless maybe it is for authorized medical cannabis.

United States, part of the [Marihuana Tax] Act was ruled to be unconstitutional as a violation of the Fifth Amendment, since a person seeking the tax stamp would have to incriminate him/herself.[6] In response the Congress passed the Controlled Substances Act as Title II of the Comprehensive Drug Abuse Prevention and Control Act of 1970[7]. The 1937 Act was repealed by the 1970 Act.

e.g. Connecticut:
State Code § 12-651
Tax Rate $3.50/gram if owner possesses 42.5 grams or more
Penalty for Nonpayment (Civil and Criminal ) 200% of tax and up to $10k or 6 yrs prison or both

It looks like a legal loophole for posessing marijuana (some states support it in court, some do not.. look into people v. state(s) for examples).
 
As a thing pointed out, the federal Marihuana Tax Stamp Act was struck down in a Supreme Court case involving Timothy Leary (yes, THE Timothy Leary). The current Controlled Substances Act was the replacement. I wasn't aware some states still had these laws, but I would assume that they are just another add-on charge for people caught with large amounts. At any rate, trying to buy them is an almost sure-fire way to get arrested, I'm sure. There's certainly no rational reason to buy them; they won't make your pot legal.

Like I said, check court cases... some have upheld the Tax Stamps.

i have looked real deep into this (also here in NC) and what i have found out is for 1 that you dont have to submit any personal info such as name, address, social security number and you dont have to show your face to get them either which confuses me on how you actually get them. and the 2nd thing i have learned about them is that by having the stamp on your stash then it protects you from getting your assets seized when you get caught with it which is the new thing in court around here. they have been dropping charges but making people pay controlled substance tax. how ever if your tax is paid via a stamp then they cant freeze your bank account or take your car etc. because they would have to give you the money it brings when they sell it because you technically you dont owe them anything unless they fine you. (i looked into this when my brother in law had to pay taxes on 20 methadones which came up to almost 700 dollars but they dropped his charge.)
