Louisiana committee OK's doubling heroin mandatory minimums: Snapshot

At-a-Glance: Just more than a decade after mandatory minimums for heroin addicts and dealers were lessened by Louisiana lawmakers, they're likely to increase again after a bill to double minimum prison terms passed its first hurdle Wednesday (March 26).

The bill: House Bill 332 is sponsored by state Rep. Joe Lopinto, R-Metairie, who also chairs the House Criminal Justice Committee. The bill would increase mandatory minimum sentences for heroin producers, manufacturers, distributors and dispensers from five to 10 years. Heroin users, who aren't currently subject to mandatory minimum sentences, found guilty of heroin possession would be jailed for at least two years.

The debate: Sheriffs, state police and district attorneys in Louisiana testified in support of raising the minimums for both users and dealers. But, Robert Toale of the Louisiana Association of Criminal Defense Lawyers and Judge Robert Morrison of the District Court Judges Association raised concerns about mandatory minimums for heroin addicts, urging lawmakers to focus instead on treatment. Toale also said he was also concerned about rising prison costs in Louisiana, the state with the highest incarceration rate in the nation.

Democratic lawmakers usually opposed to mandatory minimums, like Helena Moreno of New Orleans and former State Police Superintendent Terry Landry of New Iberia, said they're in favor of the bill in this case because of the drastic spike in heroin overdose deaths in Louisiana in the last two years.

The vote: The bill was approved without dissent. A voice vote was not taken.

Yikes.

Let's try this failed policy again, it didn't work last time but I've got a good feeling about it this time!

Not that I'd wish misfortune on anyone....buuut it would be pretty hilarious if this guys son or daughter was looking at 2 years for a dime of shit dope. Anyone think he'd make them do the time or would the problem just go away lol. I sold MDMA and mushrooms to the Lt gov daughter a few times back in 2k as she was a friend of a friend, but her mom was one of the ppl fighting the scourge of club drugs as I think they were called back then. Ppl in power love the double standard.

Absolutely insane... put a heroin user in jail for two years, that will make them stop using it. 8)

Price rises, crime level explodes, prisons fill beyond capacity, even more heroin in prisons, more prisons built, use of heroin rises. Let's do it all over again, Dur!

what in the mother fuck do you expect god damn it. I hate seeing stupid shit like this. so lets put a user in jail for 2 fucking years minimum. HOLY fuck its so fucking simple. treatment > prison anyday for someone that is down that road. As a victim of the drug war this shit is absolutely insane. I thought this country was trying to go the other way from mandatory minimums?

These people that sponsor these draconian laws like this are obviously being "lobbied" (aka bribed) by the private prison industry (aka legalized slavery paid for by each US citizens).

even though i hate at least 75% (probably closer to 95%) of the junkies i've ever met it really shouldn't be a criminal matter to use heroin

i'm fairly certain a large portion of opiate addicts commit crimes to fund their habits based on what i've seen but if they don't get caught for it the pigs can't be making that assumption.

Yeah man but that SHOULD be the beauty of American FREEDOM!!!! Let Diacetylmorphine be legal and able to be purchased by anyone, well lets say anyone over 21 (as thats an agreed upon age of a 'real' Adult). That way it would keep it CHEAP and available to all those "junkies" you hate and I promise you that you will never see those junkies again, because most of them will revert to normal functioning adults with a opiate dependence - but they wouldn't be taking doses that made em nod out 24/7 because they would know the exact dose of the medication they were doing and could just stablize on it... The ones that are just self destructive no matter what are going to do destroy them selfs with ANY drug that can destroy a person if abused on a ridiculous level. So basically THOSE kinda users will be obviously offered help and access to treatment but if they refuse that is their god given right to take whatever the hell they want to... Im obviously a Civil Libertarian when it comes to freedom of using all herbs or chemicals that are not obvious just straight poison or virus' and dumb ass shit like that.

You should have recorded that surreptitiously and used it to get the lieutenant governor to soften her position. ;)

Haha, I used to think about what if I had...but then again she's a Kennedy so I may have ended up in Gitmo lol...the gov sucked but her daughter was cool. Just another young person of great privilege who wanted to say fuck you mom lol. This was like 14 yes ago tho, so I have no idea where she is now, highly doubt she's going to follow in mums footsteps

Private prisons whose owners include the very sheriffs that run them.. highest incarceration rate in the world by far.. yet four year olds swing crack on bourbon st. Slavery and its sick.. fucking fourth world corrupt portion of the states.. pathetic and I I will never set foot there again until this shit stops.. really hope a bunch of these devils get caught in a huge scandal so this whole delery is forced to end. ANYONE WHO WANTS CARNIVAL GO DOWN TO THE REAL THING.

Louisiana is the world's prison capital

Thanks for posting that. Now I know which state to never evaer visit lol. You'd think the article was written in Georgia in the 1890s...its beyond scary that a place cab be so fucked and backwards. All because a bunch of good old boys lobby so they can keep their slaves, I mean inmates. I'd love to see those shit eating priv prison companies policy makers spend a day inside the machine they create to destroy other humans.

. I also just wanted to add, if anyone searches Google for Louisiana and seized maserati, there is a case where they seized a quattroporte and the sheriff ended up driving the thing for like 2 years! The douche also said they planned on using the car to show kids the dangers of selling drugs...are these ppl fucking crazy??? I'm sure all the disenfranchised kids will think I better not sell drugs BC I don't want a maseratti. The office of the sherrif I think must have gotten shit for keeping the car after the drug seizure, but they put the value of it at like 80k, then 40k BC of supposed repair needs. Sounds like the hick doesn't know how to drive a maserati lol.
