A 10-year-old girl has been arrested and charged with the killing of her 3-month-old brother, according to court proceedings in Maine.

The ten-year-old girl, faces charges of criminally negligent homicide following the death of her three-month-old brother after being left with him alone.

An autopsy revealed that the infant had large amounts of prescription drugs in his system, the same used by the 10-year-old to control her ADHD.

No specific details of the juvenile charges were released because of the age of the girl and no official cause of death has been released. The mother of the baby said that she was told that her baby died of suffocation.

The mother said that she saw her child at the funeral. He had a black eye and bruises on his face as well as marks that looked like fingerprints on his cheeks.
The 10-year-old is the youngest person in 25 years to face such charges in the state of Maine.

The mother left the baby alone with the 10-year-old despite knowing that she had been identified as a danger to children, according to documents of social services.

DHHS documents said that the 10-year-old suffers from behavioral problems, including oppositional defiant disorder, attention deficit disorder with hyperactivity and attachment disorder.

The mother of the 10-year-old did not give her daughter the medication she needed, the social worker said.

Either this is old news or something very similar happened not so long ago.

A third possibility is that I am insane.

Why was a 10 year old looking after a 3 month old? Is there any charges for the mother?

I didn't know "oppositional defiance disorder" was a thing.....

Shit, I think I have that!

Anyhow, I'm appalled! throw the whole fasmily in prison for life and outlaw anyone under the age of 18 from caring for children under 12! Increase the penalties and put metal detectors in all buildings used by the public, including restaurants, gas stations and convenience stores, because infringing on the rights of a nation of 300 million people is worth saving 100 or so lives a year!

Something very similar did happen.
Though, you may be insane as well :)

i believe this article is simply clarifying that the girl was being charged with homicide - the last i had heard lawyers and other leeches were deciding whether or not she was to be tried as an adult, whether it was to be homicide or manslaughter charges, etc. i believe it happened in september or november.

Yheah seriously why the hell was a ten year old left alone with a 3mo old to babysit? I mean maybe for like mom to run a quick errand, but that is really reckless. That poor mom must be in pieces. Well looks like that ten year old girl better get used to being institutionlized.

i wonder what the relationship between the mother/parents and that 10 year old are like now. "you're grounded for a month!!!" fucked up shit, does a 10 year old really need a bunch of amphetamine type meds anyway? whatever happens no one from that family should ever reproduce again.

From the comments at the publication's website (I don't know how/if the the commenter knows this):
As I understand it, the mother left her kids with a friend of hers named Amanda, requesting that the older girl not be left alone with the baby. It later turned out, she says, that they were sleeping in the same bedroom unsupervised. The mother was at her mother's house when she got the call. So she's trying to get this Amanda person charged too. In the autopsy, they found that the baby was healthy and had ingested her sister's ADHD meds. The mother says she was also bruised.
I'm confused. The bruises indicate the 10 year old girl was physically abusing the baby boy, which suggests she maliciously fed him an overdose of ADHD meds in order to kill him. But how is that "criminally negligent homicide" and not first degree murder by poisoning? Negligence implies lack of intent, yet lack of intent to kill in this case would presumably constitute an accident where the girl negligently left her medication in the open and the baby ate it without her being aware, or possibly a case where she fed the baby a pill being ignorant that it was potentially lethal, yet I assume it was she who led her mom to believe the baby suffocated, suggesting willful deception. Or are they just calling it negligent because the degree of punishment is less than for second degree murder?

In any case this is a chilling story, especially considering not just the age, but the gender of the killer.
