I-502: To Pass or Not To Pass?

November elections in Washington State will mean more than just electing a US President this year. An initiative to legalize the use of recreational marijuana (I-502) is set to be voted on, and if successful could bring in nearly $2 billion in tax revenue in the next five years.

I-502 proposes that for adults over the age of 21, recreational marijuana, like alcohol consumption, be legal. It would prohibit driving under the influence and advertisements for the drug, and would tax its sale. It would be make Washington the first state to regulate legal recreational use of the drug.

The initiative is complicated by the fact that use of the drug, for any purpose, still remains federally unlawful. Other states, like Washington, have passed laws legalizing medical use of marijuana; however, that does not make them immune to federal law. This interference is irregular at best, though, which gives voters and states room to initiate changes if they desire.

California voted on a similar initiative in 2010, but it wasn’t approved when it hit the ballot. Opposition to I-502 claims that the legalization of recreational marijuana would lead to more use and that the black market would still continue. Those in favor of the initiative call notice to the fact that making it illegal has not stopped people from doing so. It is easy to come by, fairly inexpensive, and relatively harmless when compared with other illegal substances. Many see this as a way to regulate its use better and help the state’s economy at the same time.

Whether the initiative will pass or not remains unclear, as do the implications that would follow such a progressive move. All bets are on as the Nov. 6th deadline approaches.

I can't blame you. That makes a lot of sense.

I'd never want to live in Washington state, they have unfair sentencing for psychedelic drug convictions. I was reading about this a few months ago but I'd never forget it.

How would they enforce the DUI aspect? Blood testing? And if so, how would they compensate for pot being in the system for a longer time than the high itself?

I understand what you are saying.
It is very unfortunate, because we need to legalize cannabis, but not without more thought about the DUI issues.
Since there is no test currently that can tell if someone is too high to drive, it is a really difficult issue.
But it seems to me that they could just use a regular field sobriety test - touch your nose, walk in a straight line, etc. - to see if someone is really impaired.
Problem with that is that it becomes all about the cop's judgment.

Opposition to I-502 claims that the legalization of recreational marijuana would lead to more use and that the black market would still continue.
I don't see how this is an argument at all.
More people would use it, at least at first. Is that bad? It would be legal, and they would be enjoying it. Isn't seeking happiness a fundamental freedom?
Would the black market still continue? I don't see how they could compete with stores that sold quality product at a reasonable price. Maybe people would grow their own, and sell it to friends. Grow their own plants - from nature. Problem? I don't see one.

Huh... I've never heard anything like that. I think I would have as well, with the amount of hippies eating mushies and drinking liquid acid like it's water

^ They "compensate" for it by only testing for actual THC instead of the metabolites, but THC by itself can stay in your system for a good couple of days.

I've been googling and can't find a source for it. I'll keep looking.

Fuck it, I give up. I thought I found one site that might have had the info but it ended up as a 404 and I couldn't even get a google cache for it. :|

What keeps you from getting a DUI tomorrow?

THC is actually metabolised fairly rapidly (on the order of a few hours) in people who do not megadose with cannabinoids.

It's still detectable, sure, but probably if you smoke a joint you'll be below 5 ng/L or whatever the blood THC level is. THC is metabolised into 11-OH-THC which is a secondary mediator of effectsm, and then to 11-nor-9-COOH-THC, which is tested for in urine drug tests and is the longest lasting biomarker of cannabis use.

if the question was meant to make me think deep: what keeps me from getting a dui tomorrow is that im a cautious smart stoner/druguser who doesnt fuck with drugs+cars, and a world were there are pot-dui laws, my chances of getting pulled over are still the same as today

but the problem for me is that i most likely always will have an "above the legal lemit" of thc or cannabinoinds because ive been a daily 2gram a day smoker for 3 years, and even though not driving high, i will have illegal levels.

I think the DUI laws are fucking stupid in many ways. But living in a state(AZ) with medical marijuana and zero-tolerance drugged driving laws it's hard for me to sympathizes. Smoke a joint a week ago and it's the same as smoking a fat dank+hash blunt right before driving. God forbid you get a fatal car accident, you could get charged with murder even if it's not your fault8(. Shit in many places you can't even drive on non-fun drugs used for medical reasons, even Benadryl.

Just fucking vote yes. I read the proposition and it's not that bad.

The industry and revenue that would result from the legalization of marijuana would be staggering. I hope the legislation passes.

if u got caught driving stoned today, even with it being illegal you can be charged with duid, driving under the influence, drugs. it being legal or not has no bearing on it.

The law is only going to make the black market stronger. As a grower, I say pass it, sounds like fun. When people realize the state wants to charge about $15 per gram after taxes, for commercial quality outdoor bud grown by non-hippies (meaning it's going to be soulless crap weed) and only an ounce at a time they are going to want higher quality indoor or greenhouse grown bud in larger amounts. Black market price won't be going down a bit because of 502.

By testing levels of such agents, also law enforcement has the ability to check sensory changes from Cannabinoid intoxication on the eyes and how they react to light. There are multiple ways to check for one being under the influence of Cannabis which are reputable.
