When your S/O rats you out to the cops

somebody who i am trying not to know anymore has gotten caught with cocaine, stolen pharms, and syringes and is trying to rat me out to the police for their own mistake. saying she got all that shit from my house and everything! the worst part is, i had NOTHING to do with any of this including her cocaine, and the syringes and pharms she stole herself. i was not even there when this took place!!!

by her telling the police all this is it possible that she is getting a search warrant placed on my house, or does that have to get processed through court first?
 
law enforcement need only get a judge, present the evidence showing probable cause of a crime, and have the judge sign a search warrant. it can be done in hours or less. how do you know she is trying to turn you in?
 
she went missing so her sister called county jail. according to the police they said over the phone when she was arrested that she got everything, the drugs and paraphernalia, from me. now it seems unlike her to rat somebody out like that but then again she was on bail and it was her 3rd strike, so it seems possible she blurted it out of fear during her arrest. however i dont know if i can even trust her character anymore because she started stealing shit from the pharmacy AGAIN and was also caught with coke and i did not even know she had coke. another possibility is her sister was just saying that to try to get me to confess whether those drugs were mine or hers.
 
well, the standard advice applies: if the cops call you or question you, do not answer any questions. tell them you would like to talk to a lawyer. if they come to your house, do NOT consent to a search (despite the fact they have a warrant).
 
watch your back... anyone that's arrested will rat anyone out to stay out of jail, especially if it's their 3rd strike.
 
yes u are right, for all i know she could have hidden drugs in the apt that i was not even aware we had. but are u allowed to turn down a search if they have a warrant? wont they just bust down ur door and start tearing shit apart anyway?

you cannot stop the police from using a search warrant. you should not try to stop the police from using a warrant either. however, sometimes they will ask for your consent to search, despite the fact that they have warrant since it will be easier for them to uphold the search should you challenge it in court. do NOT give them consent to search. make them use the warrant and stand aside.

if you think there is a chance that your g/f stashed something, i suggest you start cleaning your apartment. that might be a difficult thing to explain to the police.
 
ok i spoke to my gf in jail and given the circumstances i do not think i will be searched, however its time to dump all the shit thats left anyway since i was just recently rehabilitated. i am a bit devastated cause bail has gone up to $135,000 this time nobody is willing to bail her out
