Think about and compare 1970s prohibition on drugs and modern-day drug leniency and research. Since the "war on drugs" prohibition the US is changing its view on scheduled 1substances; psychedelics by allowing research and in some cases the administration of mind altering drugs to treat depression and addiction.

While possession of most psychedelics remain a scheduled 1 offense a hefty price to pay for getting caught, availability seems to be growing. I predict psychedelics will be for consumer use in the near future, however, I would not abstain on the basis of government approval. Hard drugs like cocaine and heroine will likely remain a class 1 felony in the US and I'm not certain that MDMA will be legalized given the hazards of long term use.

LSD, mushrooms, peyote, San Pedro, and similar may be harvested and sold for recreational purposes, one can only hope.

There was a time before government intervention taking these substances were legal but thanks to the fear, ignorance and prejudices of our leaders the war on drugs propaganda movement lied to American citizens to gain control of the situation by imposing strict punishment and hefty fine to deter use. Monumental films depicting the insanity of marijuana use in Reefer madness and intentional misinformation that LSD causes schizophrenia are two examples of controlled media.

With all of the national changes by the current administration legislature may approve enhanced leniency toward possession and use of psychedelics based on harm reduction.

In the banning there were no laws prohibiting use but thanks to our glorious leaders who found a way to profitize from individual freedom decided to prohibit use and punish users with hefty fines and long prison sentences. This was done as a means to control African Americans, sources of availability and prevent medical research. In the 1970s Nixon lost control of the country and blamed his inadequacy on people who opposed the war. It just happened that psychedelics came on the scene and gave young people a different perspective of life,. The powers that be unjustly feared being overthrown so they told lies and spread rumors about drug use and locked up anyone who opposed their authority.

People in power are used to getting their way no matter how misinformed and corrupt they may be.
 
Most drugs were legal in the US until the "Harrison Act" in 1914. Prior to that one could buy drugs anywhere. Sears even sold many drugs, including Cannabis, Cocaine and Morphine in their early 1900's catalogs.
