what is a pre trial diversion? also- how can you just calculate my level? its possession of a controlled substance and delivery of a controlled substance. are all felonies federal? i have no federal criminal record. i have paraphenalia, reckless driving that was reduced from DUI, and MIP (or MIC, somethjing like that).. some other stupid stuff. it seems like of ridiculous that your thinking 10 months at the least? I was thinking a month being the maximum time, lol. my attourney was telling me something about drug court, how that could help me also.
OH!!! OH!!!!
DO THE DRUG COURT THING!!!!
If you qualify, DO IT!
Federal... felony...
I thought they were the same...
If you have state charges at a felony offense level....
I dunno if that stuff applies or not.
I was picked up by the FBI in Feb....
The quantity I had would usually be a state offense, but there were extenuating circumstances involving one person in the conspiracy that turned the whole case federal.
State charges COULD be different...
I don't know how the sentencing guidelines apply to the states (if they do at all).
---Side note (99.999999% sarcastic...)----
Flea to New Mexico and seek asylum...
It's the only state with OD protection clauses where you can't be arrested or charged for reporting an OD...
I don't think you can have the charges switched from one state to another - and the drug court thing - that's probably specific to your state so you may not want to flee anyway.
But.... Drug court.
If the lawyer brought it up, ASK FOR IT.
If the charges ARE Federal... you're looking at 10-16 months for the first offense simply for POSSESSION of heroin.
1 microgram of heroin, cocaine... basically... any schedule I substance except for Marijuana... puts you at level 12 because those drugs are "SOOOO BAD!!!!"
10-16 months.
Level 12 is the lowest you can get for any of them.
Hope they're state charges...
You'll be way better with them.
