The 2018 Trump Presidency thread

I was referencing the courts doing political things like not allowing the unconstitutional executive order ‘DACA’ program to be ended or declare the travel ban from the six countries Obama’s regime determined to be of the highest threat, to be unconstitutional, when it’s clearly within a presidents power.

This might blow your mind, but even if Obama acted outside of his constitutional authority to create the DACA program, repealing the program after it's already been established could also be unconstitutional. Because, you see, that would be the equivalent of a "bait and switch," and the government is not allowed to do that. It can't create a program that people come to rely on, and then just change its mind and throw those people under the bus.

And Trump's travel ban almost certainly would have been a perfectly constitutional exercise of presidential authority, that is, if he'd been able to keep his big mouth shut. He literally said it was a "Muslim ban," so he shot himself in the foot by not understanding how the game works, and now he's not allowed to play with his little travel ban toy anymore. Sucks for him, but that one was his fault.

This may blow your mind, but whether or not illegals are afforded the same protections under our constitution is hotly contested. Obama acknowledged that it was set up on shakey ground, and by ending the program there simply couldn’t be any new applicants. It will be ended by the Supreme Court ultimately, much like how the travel ban was put into effect. These are petty ass liberal judges, tbh judicial activism makes me sick and it’s the number one reason I voted for trump. Imo the Supreme Court should always lean right for that very reason.

You must've gotten your law degree from Trump University, because that's not even close to being correct. Almost every meaningful protection guaranteed by the Constitution extends to "people," not "citizens." That isn't contested at all, it's right there in the original text. There are positive rights which don't extend to non-citizens (e.g., the right to vote, the right to hold elected office, etc). But most of the Bill of Rights applies to every person on US soil, whether the person is a citizen or not. Even if that person crossed our borders illegally.

And that's not "hotly contested," it's about as far as you could possibly get from even being contested at all, considering that it was settled by the actual Framers themselves, and the Supreme Court has reaffirmed it several times.

Though I must say it must be an interesting time to be in the legal profession. My sister followed a similar path, she went into law school a milquetoast conservative and came out a bleeding heart activist. What happens there in your opinion that causes this? Genuine question

Probably because you falsely equate "believing the government should follow its own laws" with "bleeding heart activism." I'm just guessing.

Starting with a firm in DC this summer, dawg (and nah, they don't do anything related to politics, or anything else remotely interesting for that matter). Gonna put in some time there and then jet to the west coast if I can, or shit maybe even Hawaii.

Perhaps that's because privilege was not violated. The docket for that search-warrant application (SDNY, case 1:18-MJ-03161, Judge Kimba M. Wood presiding) is 50 entries long and almost every aspect of that search was litigated to death by multiple parties. The amount of judicial oversight was exceptional and no stone was left unturned, which is exactly what you'd expect in an ultra high-profile case like this.

If they found something unrelated raiding Cohen's office, let's say for eg. 650,000 missing emails from a separate investigation, would those then be legally admissible?

The president is only one cog in a much larger constitutional machine, and he's not even the most powerful one. I know you wish you lived in a country where you could bow down to a supreme leader and you wouldn't have to worry about the messy, complex business of self-governance. But, alas, you live in America, which is a constitutional republic governed by We The People, not an authoritarian mafia-state governed by Your Man Trump. He's just one of the many temporary employees who are currently serving at our pleasure.

I agree with this. It was never a Muslim ban but I'm sure Trump managed to score a few votes conveying it the way he did (don't hate the player)

If the e-mails were evidence of a crime, yes ("BUTTERY MAILS!" 8().

But this is an interesting hypothetical: let's assume for the sake of argument that the search of Cohen's office was illegal, and in the course of the illegal search investigators ended up finding evidence linking somebody else other than Cohen (some random, non-client third-party) to a crime. That evidence actually would be admissible against that other third-party, because even though it was found during an unconstitutional search, the third-party would lack standing to challenge the constitutionality of the search because it was Cohen's rights that were violated, not theirs. (8o)

Trump is an avatar for his supporters. They love him in the kind of all-encompassing, solipsistic way that infants love themselves. Of course droppers is trolling us, but I also think deep down he really feels that way. This might be the first time he's ever felt validated, and that makes him feel good.

Trump is about dopamine, not democracy.

However you missed one of my questions. I'm guessing because it was actually previous administrations that were progressively turning the country into an authoritarian mafia-state.

I get the feeling you think there's some sort of mass blue blob of evil SJW Libtards in our country because you're entirely informed about it through internet experience, but I have never seen such a thing in real life. I sometimes think the internet was the worst thing to happen to interpersonal relations since the telephone.

And honestly, the 'president' shit is getting really annoying. I know you just do it to piss us off, but it really just comes across as juvenile and pandering. Not to mention, makes it very difficult to take anything you say seriously. David Woody insisted on using that term all the time and I just wrote him off as a complete imbecile. I use it as a term of endearment, many people do, in fact. I use it on Facebook and Reddit with supporters. <SNIP> You were right about San Fran being it’s own entity and there were many of these “sjw” stereotypes all around. I know many in my personal life, though most of them are college age so they sort of get a pass. This is the reality of the world, current year. No joking, you guys think I’m full of it but these are truly the things I say and believe.
