Street Level Heroin Dealer Sentenced To 40 Years In Prison

Possession of scales is a really poor indicator of intent to sell or supply these days.
Any responsible user should have .001 g scales for HR purposes. They're no longer solely used by dealers, as they are remarkably cheap compared to a few years ago. It's crazy, and should not be used by prosecutors as evidence of dealing.

Agreed. I'd imagine most people on bluelight have, at some stage, owned scales, and probably kept a small stash of baggies and other so called 'evidence of dealing.'

The sentence is absurd. I don't care how little effort he put into the diversion program, there are pedophiles who are out of jail in under 5 years, and murderers who are out in under 10.
 
Yeah this sentence sucks, no way did he deserve a fraction of that imo.

Obviously he was fucking up when he was given a second chance, but society needs to have more empathy towards people suffering from an addiction and realise that it often takes a lot more than one or two tries to get clean.

Selling a few bags to support a habit doesn't make you a fucking king pin and its fucked up this heroin addict is being treated like a hardcore fucking criminal. I don't imagine that jail will be easy on him...
 
That sentence is an absolute piss take. In the Uk even a top of the chain drug dealer wouldn't get a sentence of 40 years.
Sure he was doing wrong but the people he was selling to would have come to him of their own accord as I'm sure he wasn't forcing folk to buy heroin.
Send him to jail for 5 years but not 40 for Gods sake, he doesn't deserve to miss out on his whole life for selling some drugs to people who wanted them.

I really don't know what the fuck has happened to NY state?! It's like there's zero tolerance for anything anymore! It really proves that having a liberal ideology doesn't necessarily equate at all with believing in individual freedom! They were all over e cigs, banning them before everyone else...It's like some very specific ideology being forced on everyone else...Its just so narrow minded...

One day my friends. It will come. First, these old headed pigs have to die off, then we will be the rulers in place. It will happen. 100 - 1000 years from now. It WILL happen.
 
I grew up in that county, went to high school there before I got the fuck out and moved to the city when I was 17. Right now, it is infested with heroin. There's been a large public outcry because there are literally multiple fatal OD's a month. When I was a kid up there and first started using dope, it was the most taboo thing you could do, and it was nowhere to be found and if it was, it was garbage and twice the price it should be. You had to go to the city to cop. Now, there is cheap NYC quality and price heroin all over.. in just a few years the heroin use doubled and tripled. It's not the only suburban county to be going through this either.

But instead of educating their young people, investing money in treatment programs and harm reduction, creating joint task forces to actually track down the source of the drugs in the major cities, they are simply locking up heroin users. It's sickening.

Police precincts all over get their state allocated budgets based on how many drug arrests they have, not murders, not rapes, drug arrests. So they pad stats, arrest a whole bunch of users who are minor offenders and non violent, then flash their fucking arrest numbers and get a big check from the state. Then they use the same numbers to convince all the moronic voters with their head up their ass, that they are tough on drugs and should be re-elected. This is the system we've created.

That makes my bloody boil so baahhaaadly. Reading that child rapists get less than 5 years argghhh!! I did not know about that funding model Mr.Scagnatte. I am sick of this bullfuck. Why are drugs seen as such a top priority? wtf is this man?

1) Seriously is there anything we can do to help this cause for this kid?

2) How do we start to change this system? I am so upset right now.
 
2 years would be a normal sentence for this type of thing. Common sense would dictate that 45 years is outrageous!
seriously...murders and rapists can get out in half that time in some instances. it wasnt like this kid was moving weight. tragic, to sya the least. yea he should get a little jail time but its not like he was doing a service that a dozen other ppl wont step up to fill. one time in traffic court i tried to argue i was singled out bc of my car at the time and the judge said have you ever been hunting for birds? and i said no i dont gun, he said well sometimes one gets shot and the others make it away and that was his rationalizaztion for the crazt fine and tickets. bc i was unlucky when i was just going with the flow of traffic. he just happeneed to be the unlucky one and with the whole heroin thing being the big news story for the moment anyone caught with any dope is going to get harsher than usual sentences,. and if its someone who has fent or fent analog laced dope they will prolly send them to ol sparky.
 
Someone very bad that I knew sexually abused a child n got 4 years while this person gets 40? I don't agree. Don't get me wrong I don't agree with drug dealers n one even got busted on our street for having a lot of cocaine, a tanning place was done for drugs n money laundering (it is a quiet place usually, honest lol) but when a person is addicted n not in their right mind I think the matter is different.
Obviously I can't tell others what to do but Must we talk of cutting people to bits? I find that kind of talk really upsetting.
I think when a person is in addiction, of course they should be punished, but also helped too. Neversickanymore has the right idea. Two years in jail with the offer of rehabs would make sense. All this has done has not only ruined Stefano's life but also his family, as his Mam said "I will not see my son outside of jail again. I will be dead when he comes out."

You can file a motion for a sentence reduction, which will probably be what eventually happens...

38 bags and 19 rocks are nothing...crack is usually cheap and you get deals for buying a bunch...19 is like 3-4 customers, maybe even 1-2 on a Friday...38 bags of heroin is basically nothing as well...I honestly think this is why people started dealing in grams...you get In less trouble..
 
This is fucked up.
40 years for being involved in a thriving drug market that will continue for the entire time of his incarceration.
seems to me people involved in drug court get much harsher sentences then if they had just served off there jail time.
sad that our world handles the problem of drug addiction and the market it creates by putting it off and having people rot there lives away.

Seriously tho if you've already been arrested for similar charges or at all you should probably take it as a chance to clean your shit up and get straight so this doesn't happen.

Sickening and probably extremely profitable for some one along the totem poll so it will never get changed. Wouldn't want to save lives and reduce crime now would we? smh..

40 years is... enough to make me nauseous just thinking about it. Poor guy. It's obvious he was dealing to support his habit.
 
Several people in this thread have stated that he should serve some prison time.

Why do you feel that way? Do you feel that:

1) Heroin should be illegal. The penalty for selling it should include a reasonable period of incarceration.

or

2) Heroin's illegality is irrelevant. Anybody who breaks a law should be punished, regardless of whether the law is a good law.
 
Personally, I don't feel that anyone should serve any time for drugs...I was just pointing out that, given his past criminal record and the amount of time typically given to people in his situation, a sentence of 18-36 months would be "fair"....and it seems that this guy was pretty much an "all around criminal", not just a simple drug addict...
 
Serving less time for murder is a bit of a stretch. He has 4 counts. There are no 4 counts of murder were you serve 40 years.
He could get 6 years of good behavior.
