Road side Drug Testing questions..

^ Puckboy, I'm not sure on the distinction between the two but,

My mate is also prescribed dexamphetamine and i raised your question with him once and he pointed out that his condition was made clear to the police and that it was recorded on some government medical database that the cop's can check if they test you and you come back positive for dexamphetamine...

Not sure how correct he is though

Maybe some other Bluelighter's can shed some light?
 
I was under the impression that you had to carry a letter from your prescribing physician in your car.

That sounds about right. Carrying scripts etc would be rediculous. It also sounds familiar, when I was getting my suspended drivers license back recently, there were a bunch of posters in the licensing centre all about how you have to disclose any medical conditions and medications you may be taking. Upon looking at them I thought 'what the fuck?, why does it matter as long as you pass the test and are deemed a capable driver by the testers. But I was only looking at it from my point-of-view and didn't consider the huge amount of other illnesses and medications that would effect driving.

It's something I should get out of the way (going and showing the police my prescriptions incase of being tested while driving), rather then waiting until eventually I'd be pulled over by the police and/or searched and have no proof of a script which I'm sure most cops would probably assume you aren't scripted them.

Also, is anyone aware of the punishments in regard to drug-driving? What drugs are deemed worse then others?, if at all. Are the penalties in a similar format to that of drink-driving? The whole thing seems vague and not exact/consistent enough, perhaps they need increased technology/better way of testing?

First offence - (Traffic Infringement Notice) - 3 penalty units fine, 10 demerit points.

First offence - (Court penalty) - Up to 12 penalty units fine and/or six months’ licence cancellation or ten demerit points.

Second offence - (Court penalty) - Up to 60 penalty units fine and twelve months’ license cancellation.

Third and subsequent offence - (Court penalty) - Up to 120 penalty units fine and twelve months’ license cancellation.

* In 2007-08, a penalty unit is $110.12
** People who lose their license as a result of drug driving offense must undertake a drug education and assessment course before being eligible to get their license back.

What state is that for Joshee?
 
Penalties are a bit stiffer in NSW and (suprise, suprise) QLD. Pretty sure 1st offence is a charge with a mandatory loss of licence. If you are going to get caught, its probably better to be caught in Vic in that you may avoid losing your licence and an infringement notice migh not appear on your record for employment, travel etc
 
OK guys - This thread has pretty much seen its end. It's veering into an 'Ask questions about drug driving thread' rather than answering the ops questions. Due to the differences between states, and their associated laws, there is the potential for incorrect information to be provided.

Please refer to the specific State threads that have already been created. It's as easy as using the terms 'Roadside Drug Testing' and the state in the search engine.

If you have further information to answer the ops question then please PM a mod.
