SWIM was recently arrested after police saw him leaving a well known head shop. The officer was profiling the the patrons from across the street & observing all activity.
As SWIM was pulling out of the parking lot, he immediately noticed the cop car behind him. A few moments later, the blue lights came on & SWIM pulled over. The officer said he stopped SWIM for an illegal lane change. After asking for SWIMs license, the officer said he smelled marijuana in the car. SWIM denied the accusation at first, but after being threatened & coerced, and assured that if he just showed the suspected pot he had, that the penalty would be less severe, SWIM admitted to having 1 joint. After showing the joint to the cop, SWIM was immediately removed from the vehicle & hand cuffed.
The cop called for backup & they both eventually searched the car. Inside the center console they found a ziplock bag that contained 35g of bud. Upon further search, they also found digital scales, baggies, SWIMs prescription klonopin (approximately 10 pills) in a travel pill canister, and a small bag containing "an unknown substance". According to SWIM, the baggie contained 1/4 gram of heroin.
Upon being asked what the substance was, SWIM blurted out "ecstasy" not wanting to admit it was heroin.
After being taken to jail & posting bond for felony possession of marijuana with intent to distribute, 2 felony counts of controlled substances, and 1 misdemeanor count of pills not in original container...SWIM obtained the police report. Here's where it gets even more fucked up...
The officer reported that he did a field test on the "ecstasy" and it did in fact test positive. SWIM doesn't do heroin regularly, but did in fact use some from the batch that was confiscated. SWIM has done every drug under the sun, so he's positive it was without doubt heroin...not ecstasy...or molly, like he told the police.
It seems obvious that the cop lied about conducting the field test, but why? It takes a few seconds to place a sample in a tube, shake it, wait for the color change...and then definitively come to a conclusion. Was he a lazy bastard? Is it possible the test fucked up & gave a false positive for E instead of H? It just seems really sloppy for a cop with a hard-on for drug offenders to take such a risk.
SWIM doesn't know if the contents of the bag were sent to the lab for further testing, but if it was...what might happen? New charges? Wouldn't the cop be deemed incompetent for making such a mistake...or might it be proved he lied about the field test in his police report? Surely he would be in some serious shit for falsifying records.
SWIM never told his attorney that the "ecstasy" really was heroin. I guess he didn't want to be seen as a junkie...I don't know. Should he mention this now? Is there a chance the charge could be dropped due to a technicality for the cop lying?
