The sophisticated cell phone and mobile computer is becoming as popular with police as it is with consumers because it can provide investigators with so much information that can help in solving crimes.
While some phone users routinely delete information from their devices, that step is seldom as final as it seems.

His intent with it is quite obvious. I just hope he was planning to sell it as MDPV and not doing anything else dodgy with it.. In which case, he deserves jail.

Consult a lawyer. One who specialises in CRIMINAL law. Not a friend of a friend who works in commercial litigation or conveyancing. Criminal procedure is a highly specialised area and one that most lawyers will never have any contact with.
Especially if you have been charged or warrant was issued under suspicion of an offence relating to the Misuse of Drugs Act (WA). The misuse of drugs act does not have any analogue provisions and relates mainly to possession of your typical illegal drugs and associated implements. I dont think MDPV has been specified in the MDA(WA) regulations yet so therefore it is not prohibited. The Feds should have charged you/had warrant issued for suspicion of offences relating to the Commonwealth Criminal Code.
Dont admit a thing and get to a lawyer asap. If you or your bf are charged, you have a very good chance of getting it dismissed immediately on procedural grounds.

that Act they refer to 'drugs of addiction'. In determining what is a
'drug of addiction' the MOD Act refers to the Poisons Act. In that Act
they have a Schedule which lists certain drugs and MDPV is not included
in that list which is why we were initially hopeful of fighting the
charge, however s20A of the Poisons Act describes how a drug not
expressly listed in the Schedule can be included in the schedule and
that is how MDPV will be included.

yea one of my mates got done importing commercial quantity of GBL from china. caught it at customs, raided his house, search thru his computer and email and all that. not good
but on a side note:: what about facebook/msn? i have heard that both of these are really unsecure (obviously facebook chat, i know someone's wall is pretty unsecure lol) and that even the live chat from facebook is stored for ages. anyone know any info on these types of communication?
pretty sure skype is rock solid from what i've heard. the american govt even got real pissy with them and said its too secure and they need to lighten up, not sure what happened tho.
any comments appreciated, but i kno email definitely aint safe. clearly iphones aren't either lol.......altho saudi arabia wants to ban blackberry's cuz they're bombproof and cant be traced at all

s20A(1) allows the minister to identify a substance in a schedule any way he sees fit. However, because this is a penal statute it shouldn't allow this to be done retroactively. i.e. the minister gazetting a substance (say MDPV) after you have been charged with an offence involving MDPV.
s20A(2) and (3) - wow! these are doozies. They allow a substance to be identified in a schedule by reference to another substance contained in a schedule. Woah. im going to see if these sections have been considered in any case law. They seem so broad and incredibly vague. Does this mean MDPV can be taken to be included in the Schedule simply because the chemically similar MDMA is specifically listed??? Im having a hard time figuring out what the actual purpose was for their enactment? I'll have to look up the amending act as well.
By the sounds of it you seem pretty on top of the legal side of things anyway. Like i said, consult a criminal lawyer, a decent one will know their shit back to front and inside out because they deal with it everyday. can you let me know what you discover please.... one thing I can't find any info on is how a search is to be carried out, what is the standard etc. like when they turn on and off video camera what is meant to be said and if the camera is to be on at all times while searching can they search a room by them selves etc.
