Stimulants Pharmacy Question: Does 30-day rule for Sch II apply from date written or dispensed?

I had a script of 90 Adderall 10mg written roughly a month ago, but only filled a week and a half or so ago due to pharmacy stock issues (damn shortage... at least it gets me Dex sometimes).
The shortage issue is specifically why I want to fill it... It's in stock now, and when it's not, well... it leads to this.


When my doc wrote the script, he gave me 3 separate ones, with each successive one noting "Do not fill before 1-X-2012" and "Do not fill before 2-X-2012"

Will I have a problem filling the script at the same pharmacy (cash pay; no insurance regulations... major chain pharmacy) on the date noted on the script? Would the 30 days be from date dispensed or date issued?



If not, what about another pharmacy? I've been looking into this for like an hour, and can't find shit... No first-hand experiences or knowledge, no reference in Louisiana laws, etc. Hoping for the same pharm, because I pay $86 there, and the only other that had it in stock charged $140ish.



One thing to take into account is that this is not a refill, it is a separate script stating the earliest allowed fill date. This is because for SII drugs, a doctor can not legally give refills (but are allowed to do it this way) under federal law to my knowledge.
 
It's from the date filled. They fill you a 30-day supply, therefore you can get it filled again in 30 days, or up to 3 days earlier in some cases.

I feel for you though. I have had my ADHD prescription paper just sitting here for the past 2 weeks, and I doubt I will be able to get it filled due to the shortage.
 
Eh that sucks if that's the case. I'm basically having to wait 2 months per 1 month script this way. Thanks, DEA! :-)

I may try taking it to another pharmacy to see, but I'll have to look further into the letter of the law first, as my state keeps a drug database / PDMP. I've read that certain pharmacists interpret the laws as 27/30 days from date dispensed, but I can't find any non-anecdotal information on the actual legality as opposed to perceived legality. Oh how I love poring through statutes and guidelines lol... Sifting through the PDMP protocols atm :-/




Edit: Also, counting the pills I have left, it seems as if the pharmacy in question shorted me 30 or so of them. Someone got 30 free Addy I guess. This is the first time I've picked up this particular script, so I didn't know how a full script of it should look, but my fault for not counting sooner (not that the pharmacy can / would do anything if I did).

Last time I'll use Walgreens; Google is loaded with other stories of this happening with Walgreens. Not sure if it was a careless mistake or a malicious act, but lesson learned I guess.

Heh in my search for the actual law, I just realized the pharmacist violated state laws in regards to this script also... Careless enough to disregard that = careless enough to "misplace" 1/3 of the script IMO



1. Pharmacist didn't initial the bottle (nor is there a pharmacist's name on it)

LA RS 37:1225
"All receptacles containing ... prescriptions shall bear a label showing the ... initials of the pharmacist actually and personally responsible for drug regimen review, filling, compounding or dispensing the prescription ..."



2. Didn't give a shit about ID... For a Schedule II heh. Not required to ask if they know the person, but this was my first time ever filling at this location.

LA RS 40:971
"Every pharmacy ... shall require every person purchasing ... any controlled dangerous substance to produce a photo identification card, unless the patient or the patient's agent is known to the pharmacist..."



Normally I couldn't give two shits, but I'm pretty pissed about a large portion of the pills missing. Still don't know whether I should report the shit to the Pharmacy Board though :-/
