NORML Breaking News: California Assemblyman Introduces Legislation To Tax And Regulate Marijuana Like Alcohol

Speaking at a landmark press conference today, California Assemblyman Tom Ammiano (D-San Francisco) introduced comprehensive legislation to tax and regulate the commercial production and sale of cannabis in a manner similar to alcohol.

“With the state in the midst of an historic economic crisis, the move towards regulating and taxing marijuana is simply common sense. This legislation would generate much needed revenue for the state, restrict access to only those over 21, end the environmental damage to our public lands from illicit crops, and improve public safety by redirecting law enforcement efforts to more serious crimes”, Assemblyman Ammiano said. “California has the opportunity to be the first state in the nation to enact a smart, responsible public policy for the control and regulation of marijuana.”

The proposal is the first marijuana legalization bill ever introduced in California.


“It’s time for California taxpayers to stop wasting money trying to enforce marijuana prohibition, and to realize the tax benefits from a legal, regulated market instead,” said Dale Gieringer, director of California NORML, a sponsor of the bill.

As introduced, Ammiano’s measure would allow for the licensed production and sale of cannabis to consumers age 21 and over. Licensed cultivators would pay an excise tax of $50 per ounce of cannabis. In addition, the proposal would impose a sales tax on commercial sales. (Ammiano’s proposal would not affect the state’s medical marijuana law, allowing patients and caregivers to grow their own medicine.)

If enacted, the measure would raise over $1 billion per year in state revenue, according to an economic analysis by California NORML, available online here.

Ammiano’s bill comes at a time of growing public support for legalizing marijuana. A recent Zogby poll reported that nearly six in ten west coast voters support taxing and regulating marijuana like alcohol.

Faced with a $40 billion budget deficit, other public officials have joined in endorsing Ammiano’s bill, including San Francisco Sheriff Mike Hennessy and Betty Yee, a member of the State Board of Equalization, which oversees collection of sales taxes.

Currently, tens of millions of dollars are paid annually in state and local taxes by licensed distributors of medical marijuana. However, these sales only represent a fraction of the overall statewide marijuana market. “The millions of dollars raised each year on the sales of medicinal cannabis is only the tip of the iceberg,” Gieringer said. “Kudos to Assemblyman Ammiano for proposing a path-breaking bill that would benefit our economy, safety and freedom by making marijuana a winning proposition for California.”

I am in support! This would be akin to the first crack in a delinquent egg shell imo. Especially good the state gets the tax money, more power too it! More states would likely follow once shown the way to salvation. Anywho- The Federal Gov. Is making all the money off of prohibition so iitd be a kick in the groin to them on behalf of cali! Its time for the states to take the reigns, turn down the federal bail out money(our own money given back with strings attached), legalize & tax.
 
sounds cool but its hard to get excited about something ive seen fail so many times before, california did pass prop 8 after all so i dont have too much faith in them anymore.
 
^ yeah, my sentiments exactly. I'm so tired of hearing about weed legislation that seems destined to fail time and time again. I'll consider it breaking news when weed is legalized. Wake me up then.

ditto. Weed bills get introduced all the time and 90% fail. Hell Barney Frank even introduced a federal bill to decriminalize marijuana.

This isn't really breaking news until it the bill passes the governator. Arnold will most likely veto it if it makes it through the senate.
 
the fed gov will threaten to cut aid to the state. It's like when ever a state tries to lower the drinking age the fed says well if you do that your roads and freeways are gona start to fall apart unless you can come up with the flow. Would be nice though but where i live Santa Barbara if you get caught with up to ounce its a $100 dollar fine and its the polices lowest priority. That and like Blacksoulman said Arny will never sign it into law.

I wouldn't be so pessimistic. The electorate of California wants it by a very substantial margin, so if you live there, make your voices heard. The Governator has been open about his marijuana use and may very well pass it, especially considering his state's financial woes. $50 an ounce tax is a bit steep though (but still worth it if they legalize).
 
I'll stay pessimistic. The governator has made clear his intentions with bills like this in the past. I don't have the source, but I believe the medical marijuana industry has already offered arnold $1 billion if he decriminalized or legalized...can't remember.

federal funding is several billions of dollars. 1 billion would barely even begin to offset what they would lose from the feds
 
if that passes.. 1 billion a year in revenue is pretty good considering all the money that other states pay to arrest marijuana users.
 
Hm, well lets just keep out fingers crossed and not get our hopes up, if the federal government doesn't threaten to cut funding I wouldn't be too surprised if it passed... but at the same time this is basically a big middle finger to the federal government so I would be surprised if they didn't threaten to cut funding, and with California already in a deficit this is defiantly not a good time for us to really piss off the federal government. If the feds DO threaten to cut funding, I would hope that it wouldn't pass, I mean I'm a pothead, but at the same time I'd rather my state doesn't go to shit just so I can smoke weed legally (in two years anyways)
 
I scanned through the actual text and it is a pretty good bill. If I am correct I believe there is even a provision for adult personal cultivation, but I could be wrong. The bill also removes the cannabis plant, all it's compounds and derivatives from the California controlled substances act and allows for smoke shops to openly sell their goods for cannabis consumption. I only regret that this bill was not placed in front of the people in a proposition, because I know without a doubt that it would pass. I do not know how the state legislature leans on this issue but I know chances are Arnie will veto this bill since he has for past mmj bills. I am also looking forward to the Oregon cannabis tax act which supposedly is written to withstand a federal challenge.
 
^Yes medical, but not personal, but hell, are the cops gonna get you for that if it passes? I wonder if the $1 billion figures in tourism, because I guarantee that you will see a lot of visitors in Cali.

Also, I was watching CNN Headline News the day the story broke, and they played this story about every half hour. They took viewers calls, aired some good points as well as some ignorant bullshit. The best part was the text message poll where they asked if it should be legalized and taxed, and 95% were in favor. Not a scientific poll by any means, but fuck if that isn't a landslide.

Not likely. If they wanted to they would have pulled it during the bush years over MediPot. With Obama in office, I don't see him doing anything so drastic.
 
i hope this gets passed. yet another stepping stone. i can't believe we have so many doubters when we got 12 states that have it medicinally legalized and penalties in other states dropping all the time. the time may not be now but it will be VERY soon. ;)
