MADISON, Wis. (AP) -- A Madison police detective suspected of taking heroin from evidence for his own use before being badly injured in a car crash will not face charges.

Dane County District Attorney Brian Blanchard says he doesn't plan to file charges against 39-year-old Jeffery Hughes, who was off-duty when his car crashed on Interstate 90 in November. Hughes has been hospitalized since the accident.

Blanchard says he doesn't think Hughes could go on trial because of his "medical disabilities." The district attorney's office says Hughes suffered a brain injury and has been undergoing extensive rehabilitation but has severe impairment of short-term memory and attention span.

In the past, Hughes had cluster headaches that caused him to miss 40 percent of his work days in 2005 before he had a surgical procedure to reduce them.

Blanchard says the heroin use was evidently linked with an attempt to escape the pain of a serious neurological disorder.

Didn't you guys know? Heroin is only illegal for people who aren't cops. For them, its ok as long as they have headaches.

I wonder what they would do if they busted you for heroin and you told them that it was ok because you have headaches, and you can't go to trial anyway because you are too sick.

You know what they would do?

I'm not even joking either, this is ridiculous, and total slap in the face to all of us (the whole United States/world really).

Someone who lives in the great state of Wisconsin PM me, we'll start an online petition. I don't know if only signatures from that state will mean anything, or from all over the US/world, but I want this guy locked up.

FUCK THAT...if I didn't reside on the east coast I would totally sign up, unfortunately this type of shit isn't restricted to Wisconsin, it the whole fucking country. We need to stand up and end shit like this, unfortunately, you try to do that shit on your own, cops just gonna knock you down and lock you up...lets see how much you can do from prison motherfucker....thats why ppl need to gather and make our voices heard. yeah it's so fucked up cause we're not charging a guy who's severely mentally disabled due to the crash 8) i know it's popular to hate on cops but the guy was in a coma and still has major trauma from the accident.

"His doctors cannot foresee a time when he will regain the capacity to participate in a trial with the ability to understand the proceedings against him and assist an attorney. In light of Hughes' current and foreseeable medical disabilities, there is no point in filing criminal charges that would either be dismissed or held is abeyance," Blanchard said.

I live in the great state of Wisconsin. I don't think I've ever attached the word "great" in front of it, though.

Pretty disgusting, but does it really pay to waste money on a guy who can't stand trial?

I don't think they're saying they're letting him off because of his headaches- there are legal ways of obtaining medication for them- but rather because he simply can't stand trial.
 
I don't give a fuck why he used it. If a non-cop would have done that they would have been in jail. And when they get out, they'd have a fucked up police record.

Fuck him. I'm sure he didn't have any qualms about locking up heroin addicts when he was on his beat.
 
what a load of grade A bull shit. if he was in such bad pain, im sure he would get an rx pain medicine. how come they dont aruge that? either way you cut it, heroin is illegal, just because he is a cop and is in pain doesnt mean he can be exempt from the law. they should lock him up for that shit, fucking cops.
 
Even if he is not medically able to stand trial now, they should still charge him when and if he recovers.

Someone I knew got charged with simple possession after being in the hospital for 6 months because they got hit by a car before they were charged. There is no reason that they shouldn't charge him.
 
if he was to go to court and get off, wouldnt that set a precedent for future people caught with drugs without a prescription used to treat a medical condition?
 
I can't believe anyone here would side with this piece of shit. Yeah thats right, I'm calling him a piece of shit, like cops have called me when they knew I used heroin. The only difference is, I bought my heroin, with money I earned. I didn't steal it from where I work - that place being the police station, or rather - the police station's evidence room, where they keep heroin taken from pieces of shit like me when they arrest me. And they keep it there for evidence, not so some faggot can steal it later to cure his headaches.

If they don't prosecute, then I hope his headaches get so bad he blows his shitty brains out of his skull.

from the articles i read he's not expected to recover. the guy was in a coma and is still severely mentally disabled. if he does recover soon of course he should stand trial... (except no one should stand trial for using drugs imo. maybe for stealing evidence, though at least he did only steal from the evidence which was to be destroyed so that it did not affect active cases [and probably would be less noticeable as well]).

he would be in jail too if he wasn't mentally disabled now from the car crash 8( the article doesn't make it clear but the headaches and whatnot are not why he's getting off.. he took the heroin BEFORE he crashed the car and before he developed the medical problems which prevent him from standing trial.
 
Yeah, Frizzantik's 100% right- it has nothing to do with why, but rather to do with the fact that he can't stand trial, and likely never will be able to.
 
He's mentally incapacitated... whatever..

Jail's out of the question, but his pension and benifits should be removed. I'm tired of seeing dirty cops getting paid for life going out on disability.
