Prague - Possession of marihuana for one's own needs will be punished much less severely than that of other drugs, under the new Criminal Code that distinguishes between soft and hard drugs that was passed by the Czech Senate today.


The production and sale of drugs will be punished by up to five years and if the crime is very serious, the upper limit may be up to 15 years in prison.

Offer of drugs to children will be punishable with ten years in prison.

The code introduces milder punishment for the possession of marihuana for one's own needs.

A small number is only qualified as an offence, if the amount is bigger it will be maximum twelve months in prison and the growing of cannabis is punishable with maximum six months in prison (hallucinogenic mushrooms with up to twelve months).

The legislation follows up the December verdict by the Constitutional Court saying that growing cannabis in itself is not punishable and does not automatically mean the production of any drug.

Under a government draft decree, the small amount is defined as fewer than 20 cigarettes of marihuana or three plants of cannabis.

In the case of psilocybin mushroom (Psilocybe bohemica) the upper limit for small amount is defined as 25 pieces.

In the case of other drugs, the amount "bigger than small" is to start at about ten doses or 0.8 gram of ecstasy, half a gram of pervitine (methamphetamine) or cocaine, 0.3 gram of morphine, 0.2 gram of heroin and 0.005 gram of LSD.

The government decree is to make it clear whether possession of drugs for one's one needs is punishable. Courts did not have to follow a similar decree proclaimed by the police.

Some illegal performance enhancement methods are now qualified as a criminal act punishable with up to twelve months for coaches and eight years for doctors.

This relates to the methods of artificial delivery of oxygen to enhance the capacity of organism for endurance as it seriously threatens human life, the legislation's drafter and former ski jumper Pavel Ploc said.

Unfortunately, the article doesn't describe what an "offence" is?

Atleast they can distinguish between soft and hard drugs. Really though from a standpoint of legalization "hard" and "soft" are irrelevant since the argument is really about freedom. Good to see people don't appear to face jail sentences for personal use of marijuana.
 
AFAIK what the article calls "an offence" would correspond approximately to a misdemeanour in some US states (i.e. not a felony). The UK equivalent would be a summary offence rather than an indictable offence.

In the Czech legal system misdemeanours don't go to criminal courts but are handled at local authority level, by departments or committees at town and city halls. A bit like magistrates' courts in the UK, I think. Misdemeanours are punishable by verbal warnings or fines, and don't result in a criminal record.

Obviously the amendment of the Criminal Code is a good thing (and it was passed unanimously by the Senate), but in practice it won't make much difference. The Czech police couldn't care less about small-scale homegrowers and kids smoking in parks; they're only interested in large commercial grows. Methlabs get shut down but tweakers aren't hassled. Etc.

sounds good for cannabis, but otherwise not too nice. years in prison are about the same or a bit higher than here, and the "bigger than small" amount is quite small. 0.8g MDMA is nearly nothing.

Yeah but keep in mind, for the AVERAGE end user (non-bluelighters) they'll usually only have at most 200-300mg on them (much lower then .8 ) or a 1/2g of meth, hell for a non addict .2 of heroin or .3 of morphine (quite a bit if you think about it) really isn't more then the average user would buy, hell even .8 of cocaine is generous, most users (casual users) do a half gram in a night

understand these laws are for average drug users, not people on bluelight who wouldnt do coke unless they get an 8ball, or mdma unless they had a gram, or speed if they only had a gram ect.

Way to go, I love these laws they should expect drugs to drop!

These laws, good for 99.9% of drug user who just do, ya know, average amounts. I say rejoice! I hope more country's mirror these laws
 
I am Slovak and i visit my sister in Czech often.You can grow weed here,smoke it where you want and have 3.0g in your pocket without problems.Some police officers smoke weed when nobody is watching :D i saw that! With mdma you will get just little warning and you must pay,but not very much.Muchrooms arent big problem,there is huge mushroom grower comunity becose it is legal to buy spores and grow it.Great country,they have good and cheap beer too.

from what i have seen the average user buys 10-20 pills because it's cheaper that way. still 0.8 isn't that bad, but i was quite surprised when i read the laws of my country to find the limit to be something like 20g or 30g of mdma ;)
in that respect the czech amounts seem quite small, as the czech republic isn't too far from here...

Really? I always thought it was more about the fact that prohibition actually 'increases' the social harm drugs cause, not decreases. At least for some substances, some are arguable.

Either way, great move by Czech.
