legality of the NBOMe compounds

can anyone confirm the legal status in the uk of the NBOMe analogs that seem to be starting to creep out.

it was mentioned in the NBOMe-mescaline thread that it would be class a in the uk, is this accurate and if so does this apply to the rest of the 2c range?

Here is the law:
any compound (not being methoxyphenamine or a compound for the time being specified in sub-paragraph (a) above) structurally derived from phenethylamine
an N-alkylphenethylamine
a methylphenethylamine
an N-alkyl-a-methylphenethylamine
a ethylphenethylamine
or an N-alkyl-a-ethylphenethylamine
by substitution in the ring to any extent with alkyl, alkoxy, alkylenedioxy or halide substituents, whether or not further substituted in the ring by one or more other univalent substituents.

So, uh, it's not N-alkylated, so it may be kosher, but the wording of this law is bizarre.

If these are legal (2C derivatives), so would be NBOMe-mescaline.

bizarre enough that the first few people who go to court for these chemicals might get off because the law is vague? (just speculating)
 
Or bizarre enough that they might get charged with it based on expert witness testimony even if the original law didn't intend to be used that way.
 
i think this is an important stubling block as all the sources for these chemicals are to my knowledge outside of the uk so in order to buy them you have to import them yourself and recieve it through customs.

shame its such a grey area. i feel that in a situation like this the law would side with the authorities because it didnt really know where to go and would take the lead from the police or who ever. too bad

im not competent in chemistry but that first sentance you quote really stands out

including 'for the time being' seems like an attempt at a catch all to me so any derivative of a phen that they havent had the presence of mind to thing of is also included as an when its appears
 
Benzyl is not really considered alkyl, and most chemists worth their salt realize the law is a sham and will support the defense on that basis.

That said, don't sell them openly or do anything stupid, because you can probably get nicked for fake drugs.
