SAN FRANCISCO (Reuters) - California prosecutors are cracking down on kava-drinking motorists who are driving under the intoxicating influence of the herbal tea.



Following their first successful conviction in June, San Mateo County prosecutors have filed three other cases, after about a dozen motorists had been pulled over in recent years, said San Mateo Deputy District Attorney Chris Feasel on Monday.


Kava, while not considered as a drug by federal health officials, is classified by the U.S. Food and Drug Administration (news - web sites) as a nutritional supplement that can be used to relieve anxiety.


Motorists under the influence of Kava had a "thousand-yard stare," Feasel said. "They're drooling on themselves sometimes, their motor function is so bad," he added.


He said that police had pulled over kava-addled motorists who were swerving, veering into other lanes and drifting onto the road's shoulder.


"Kava basically has the opposite effect of alcohol," Feasel said. "Kava affects your motor skills before it affects your mental abilities."


The June conviction is believed to be only the second successful one in the country, following a 1996 case in Utah.


In the pending cases, motorists have admitted to drinking between 10 to 20 bowls of the bitter tea, which comes from the kava root, a member of the black pepper family.


"We're cracking down on DUI drivers," Feasel said. "Whether it's driving under the influence of kava, or a good merlot or Advil, you're going to be prosecuted."
 
They're getting at the idea that it doesn't matter whether a drug is illegal or not, if you're driving under the influence of something that inhibits your driving skills, you will be prosecuted for DUI or reckless endangerment or whatever....

Personally, I think that's a great thing. If only Wisconsin would figure that out....

I don't think it's placebo at all.. I haven't tried it myself, but I have read book called "Tyynenmeren Onnelliset Saaret". I don't remember the writer or its english name, so it probably doesn't say much... but it was about south pasific islands, and indigenous people somewhere there used kavakava, and it sure didn't seem like placebo. Maybe your preparation method was wrong.. They chewed fresh kava root, spitted it in a bowl and then drank it. Writer mentioned that the saliva made it stronger.
 
Kava is not placebo. If taken in capsule form it can be more powerful than Xanax... It is a very good muscle relaxant...
 
I agree with this so much, because I have seen people on kava none of them thankfully werent driving, but i do agree with this.

I just hope that people take this sort of thing seriously in that it wont lead to the possible scheduling of kava.
 
i think there have been cases in the past of people getting DUIs for kava intoxication. depending on the preparation and how much you drink, kava can definitely impare your driving ability, so it makes sense that you could get a dui. you can get a dui for being under the influence of any legal or illegal drug if you are driving unsafely.
 
"Did you drink anything?" "No...well, twenty bowls of kava but its not a drug though!" Why would these idiots admit to taking it? Like they have a kava sobriety test or something. I'm not saying that driving fucked up on kava is right but if people can get away with driving high every day smelling like weed then kava should not be a problem.
 
yeh, really, is there like a breathalizer test on kava, why would you ever admit you took anything?
 
These people were probably on something else, thought the cop may have noticed, and decided to use kava as an excuse. They probably thought it wouldnt get them in trouble since it is legal...

This amazes me. You can get a DUI on legal substances? It doesn't seem to make sense to me whatsoever. Am I the only one who doesn't understand how this is possible? Ugh! Fuck the US Government... 10x. Either I'm really dumb and maybe thats why I don't understand this at all, but I thought you would only get a DUI on substances that were scheduled. 8o 8( :( :\

Of course. If you are intoxicated, i. e. your driving function is imparied, it's only fair. Not too many accidents are caused by a cup of coffee or a cigarette, unlike the dipshit above you is trying to imply, and I don't like substances such as Kava coming to the forefront of attention, but if the driver's abilities were clearly impaired, I don't see a problem with it.
 
Kava -- meaning the drink from the southern pacific islands (like Fiji, where it is immensely popular), NOT the useless supplement they sell in health stores in America -- can be very intoxicating. They have Kava bars in Fiji that cater to Kava drinkers. The basic idea is that you pay for your drink, drink it right there in one go, and then go lounge around on chairs or couches inside the bar or nearby.

I really have to go to Fiji sometime and try this out. =D

The natives actually used to use Kava to settle disputes between tribes -- I guess they figured the negotiators would be too happy to start up another war.

the dipshit above him did have a good point

plenty of car accidents involve either being tired or depressed. also plenty of drugs that impair driving for one person don't for another. this isnt a black and white issue, especially considering the personal financial trouble these laws can cause

i do agree however that just because a drug is legal doesnt mean you shouldnt be able to get a DUI on it

i think you may be the only one who doesn't understand how this is possible. alcohol is quite legal where i live but very very definition of dui is, for most, drunk driving.

can you see that there's a difference between use and overuse/abuse.?
