If its legal to sell needles OTC in your state, can pharmacists refuse?

IN NEVADA, Vegas specifically:

Fortunately I normally had good friends who'd go do this shit, we'd split the cost, or buy em off eachother for $1 or some shit. We had probs a few times but I think thats cuz she looked high as fuck and didnt even try to cover her arms. The few times I had to get em myself I'd pretend like I didnt know wtf I was doing and I'd *call* my uncle, grandma, whoever and "ask" to make sure I got the right kind.. "K, love you gramgram see you in a few minutes" lmao. Oh how I love grandma. <3

But yeh, never had any probs. I look innocent as fuck anyways, aside from a facial piercing, you'd prob think I was 15.:p

In Florida its half and half. Although state law says a prescription is required only for minors alot of places still refuse. CVS almost always says no. Walgreens which there is like 4 of them i go to usually sell them to you I have only been refused a few times, but sometimes you do have to show ID and/or sign their needle sales ledger book. Wal-mart, target, and publix have always done it. And the Flagler Beach pharm which is a tiny mom and pop is my spot, I just walk in and they know what I want, sometimes they give me the long instead of the short which I prefer and have to correct them but going in there every week and buying them, they are not rude or anything, I joke with them, talk about families and other people in town, and they know whats up with me, I got tattoos, a 6 inch mohawk, tracks down my arms and I have taken my scripts for OCs in there before but they are nice and never ask never say anything about it and always help me out.
 
I'm outside of Dallas and called around first.....I made up some story about why I needed them...diabetic relative and they basically told me what I needed to say when I walked in to buy them and five minutes after walking in I was walking out with a box of 100.....try larger places they seem to be more about cash....
 
Here is another online site that may help. compare prices with the site posted eariler, although this site may be overseas sterilesyringes dot com. sorry guys if this is against the rules. Of course there are lots of online sites that will sell them. I've never heard of someone needing an Rx to get them. Around here in Western NC however most ppl are suspicious assholes and i've had a very tough time buying them. Thats why I turned to online suppliers. Ive never used the website I mentioned by the way. I was getting them through a friend, who buys online or over the phone one. I am going to try the site mentioned eariler, seems legit and in the us. Shipping is cheaper seems like, i feel both sites are good however.
 
I live in New Hampshire as well and have never had any problems buying the 10 packs of syringes. I was refused once at a Walmart because I didn't have a prescription, but assumed it must either be store policy or that they didn't carry syringes in small quantities and have since just stuck with Rite-aid and Hannaford and have never been refused at either place. So I don't think the law has been changed. As far as the legality of pharmacies refusing sales, I'm not sure....I would assume that if they carry the 10 packs they would be obligated to sell them to any adult...it also helps to be very specific about what you want...I just ask for a package of .5cc insulin syringes...but it helps to know your preferred gauge and whether you want long or short tips as well

But, like someone else said, be confident and specific. Maintain eye contact. If you look nervous or your voice wavers, then you look weak. Just walk in and DEMAND what you want with authority. You wouldn't believe how well this works.
 
It's legal in Massachusetts. Pharmacies have a right to choose not to carry them. You have to be 18, and I believe that certain pharmacies scan your ID, like they do for anything with dextromethorphan in it. CVS carries them. If you are having troubles in NH depending on where you are living, Massachusetts might be a short drive over the boarder.

And by the way---people can refuse to sell you anything at any job. I worked at a bodega that sold beer and my boss refused to sell it to a guy once when he tried to pay in pennies. That was off topic, but all businesses have the right to refuse to sell you things/refuse service.
 
i will tell you why we refuse

I looked up the laws for syringes in New Hampshire, and it said that OTC sales of 10 or less syringes in pharmacies were legal (Prescription law excludes <11 syringes for adults). So I decided to see what would happen if I went to 3 different pharmacies to buy rigs.

At RiteAid, the first time I went, the male pharmacist sold me rigs after checking my ID and giving me a pamphlet on health and saftey. The next time I went to RiteAid, the female pharmacist got all mad when I asked and said she would not sell them over the counter (when I told her that her coworker sold them to me, she said "well I thought we were all on the same page about this but I will NOT sell them.")

At CVS, the woman said that they would not sell rigs OTC without a perscription, but referred me to Walgreens because they did.

At Walgreens, I got syringes with no questions asked, no ID needed.

Is it legal for pharmacists to refuse to sell rigs OTC if state laws say its legal? And is what happened in RiteAid, with one pharmacist selling them and one
 
i will tell you why we refuse. As a caring pharmacist, a health professional who cares about the welfare of human beings and has dedicated themselves to making people well, I truly am upset that we (pharmacists) are put in this position. There are needle exchange programs where you can get clean syringes but only in large cities where drug abuse is prevalent, Camden, Atlantic City , Newark there are none is the area I live within a short distance drive. So all of you addicts come to the pharmacy. Please I ask that you all get help and get clean. The excuse I hear is you have no insurance and cannot go to rehab. You need to detox on your own, when you cannot bear the withdrawal just go to the hospital, but continue with it. No good comes from drug abuse. You have family and friends who love you, and you are hurting them and yourselves. Please ask for their help to get clean. Peace, we don't judge you,we want to help you.

I have more to tell you. When you see a pharmacist who does not want to sell you needles. Please go elsewhere to a pharmacist who does not have issues with selling them.
It is not fair of you to pressure us to sell you needles. We took an oath when we graduated from pharmacy school , Please look it up. it is called the oath of a pharmacist.
we promise to do no harm and help dispense medication to help eliminate human suffering. It is against our morals and oath to sell needles to aid people in hurting themselves.
Life has so much to offer. Please do not do drugs that can kill you. If you must use a mind altering substance please choose a safer alternative than heroin. Alcohol is legal and far less dangerous. I am not saying become and alcoholic, but I am saying there are safer alternatives
Heroin is so addictive. most people think they can shoot up one time. This is not the case . Most people get addicted to heroin after one use.
The odds are against you. Many addicts die of unintentional overdoses. Your life is worth something, if it is not to you it is to someone. Doing drugs hurts people you love and hurts you.
Someone you love or who loves you will get hurt. Your life is worth living. We do not want to see you get Hep B or hep C or Hiv. But we do want you to live. That is why we don't want to sell you needles. We feel that if you have access to clean needles you will never stop shooting up. If you could not get clean needles maybe you would think twice.
Did you watch the series Breaking Bad? It is about a high school chemistry teacher who starts to make methamphetamine and starts selling it. Do you see how many people get hurt or die in that series from the use of methamphetamine. the same is true with heroin
Also there are bad batches of heroin and many people are dying because they are shooting up with other drugs and poisons and don't realize it. Please get help. We want to see people healthy and living a wonderful life. I want that for all of you. Thank you for reading. Peace to you and Good Luck.
 
and yes we can refuse. there is no law forcing us to sell syringes. You can buy syringes yes, but we dont have to sell them. Just as an owner of a liquor store or a bar tender can refuse to sell you or serve you alcohol. Just because you can buy it , it does not mean we have to sell it to you. Pharmacist who care and want people to stop doing drugs do not want to sell syringes, plain and simple

So wait a second, you're against the transmission of blood-borne illnesses but yet you're against selling clean syringes to those with the money to buy them? That doesn't make any sense.

Thankfully I've never encountered a pharmacist where I live who is a moralist when it comes to selling medical supplies.
 
seems like most pharmacy places in cities with drug problems ironically wont sell you syringes yet if you go to the suburbs they dont have a problem selling them to you

honestly, ordering them online is a lot easier. or just pay someone a dollar near where you get your shit, theres usually someone selling needles nearby. always

And just know what you want. know the exact type of needle you want to get at the pharmacy, maybe wear some deodorant, and they should sell it to you
 
I've had similar mixed results like most people in this thread, and it fucking pisses me off we have to find stores "willing" to sell to us. Since when have stores not been willing to sell to anyone besides people with social stigmas? It pisses me off that every time we are refused service the unspoken message is "I have judged you and deemed you unworthy."

Thus I recently contacted the legal department of the states pharmacy board in nevada inquiring, while businesses have the right to refuse service to anyone they choose, when no prescription is required for purchase, is not asking if a person has one a form of discrimination? Or at the very least, a violation of doctor patient confidentiality/hippa laws?

I explained my only desire for contacting them is to get more widespread and consistent adherence of the safe injection act, which would decrease the spreading of diseases. But seeing as how I contacted the legal department specifically I'm sure they understand the implicit "threat" of my requests wording, as if they don't work with me I will find a lawyer willing to file a civil suit. No lawyer (especially on a state board) is going to want to have to spend his time and effort fighting against implementing a bill his own state senate passed, that's career suicide.

So yea, I'm working on Nevada. I hope someone somewhere else who is being discriminated against despite the law being on their side gets mad and does something about it, too.

I'll post any important updates...
 
Caring pharmacist. While your intentions are good, you don't seem to reslize every time you refuse service you are breaking your oath. If not having access to clean equipment made people stop shooting up, the spread of disease wouldn't be consistantly significantly higher in places where people lacked accesd to clean equipment.

You are acting on what you want/hope to be true rather than what actually is. I'd wager at least one person youve denied service to contracted hep c as a direct result, and just as many people have OD'ed as would have regardless of your not selling to them.

You can not stop an addict from using, so trying to makes no sense. What you can do is hinder the spread of disease, so why not focus on the proven facts instead of hoping something works when theres no actual evidence to support it?

the nearest pharmacy to my home (apart from the one where I go to get my actual meds because I'd never ask for needles there) always tells me "we are out, shipment later"
