How to write a will ?

Hi Groovers,

How does someone write a will ?

What is required? Do I need a Lawyer? Is it expensive?

I'm having one of my "impending doom days" !

I'm 21 and I have a fear that for some reason I am bound to die young. This could be an irrational fear but still it's a fear. I'm also someone who believes in the ability to sense things, etc based on my life apast.

I own quite a alot of expensive equipment and I normally always have large amounts of money in the bank.

So I want to have a basic will, which says that if I die all my assests can be given to my parents and if they are dead, then all my assests can be distributed amoungst my family and my money donated to a charity of my choosing, and of course I will select that charity whilst writing the will.

Is this a good idea?

Any opinions/suggestions welcome!

For $40 AUS you can get this service to write you a will online: http://www.australianwills.com/index.htm I'm not advocating this site. But it might offer some type of information that you are looking for.

Wills are always a good idea. Here in the US some states will get all of the money/property you leave behind if you don't have a will. Plus it will keep family from fighting over any items you leave behind (it happens to even the closest families). And you can specify how you want to be put to rest (burial, cremated, religious ceremonies, etc. etc.).

Also, you can create a living will. That way if you are hurt and rendered a vegetable you can be assured that whatever your wishes are (to be unplugged from life support or to stay on it) will be followed.

Don't always trust the pre-purchased will kits, they are far easier to contest in court should someone disagree with it's contents and believe they have an entitlement to something.

If you want a will done properly, I suggest you attend a small law firm out in the suburbs and ask for a basic will to be done, shouldn't cost you any more than $80-$100.

They will also keep the original Will in safe custody if you wish (usually the best option, so long as you inform people of it's whereabouts) and give you a copy for your records, or a copy that you can give to your family to hold onto.

If I had of known you wanted one a few months back, I could have done one for you for free before I finished my job, but annoyingly, I don't have any Will precedents with me where I am.
 
This would be far better to post in the legal Q & A. However, will preparation fees are almost always based on assets and can be quite costly. I would suggest you speak to an attorney so as to be safe and to keep you estate out of probate.
 
I have worked in 4 different law firms in two different states of Australia, and not one of them has based their fees for will preparation on the assets of the person having the will prepared.

The only things I have notices, naturally, is that the more exclusive the firm is, the more expensive their fees are - which is why I suggested a suburban firm.

Seriously, some of these will kits are bogus.
