Federal Analogue Laws and JWHs

I want to post a question about analogue laws and JWHs. I know they haven't been applied as of yet because JWHs are not an anologue of THC.

But what about the fact that JWHs in the states are starting to be illegalized as a reaction to the proliferation of 'smoking blends'....K2 and such? If a state, like mine is in the process of doing(TN), bans the better known synthetics like JWH-018 and JWH-073, would the other synthetics then be de facto included by the analog act? In Tn the bill as proposed reads:
SECTION 1. Tennessee Code Annotated, Section 39-17-438, is amended by deleting
subsection (a) in its entirety and substituting instead the following:
(a) It is an offense to knowingly produce, manufacture, distribute, possess or
possess with intent to produce, manufacture, or distribute the active chemical ingredient
in the hallucinogenic plant salvia divinorum A or the synthetic cannabinoids JWH-018,
JWH-073 and HU-210.
SECTION 2. This act shall take effect upon becoming a law, the public welfare requiring
it.
*side note- sad to see they followed the current trend and threw in salvia while they were at it....though I'm not fond of it myself* :\


In other words, as I have zero chemistry knowledge, are the synthetic cannabanoids analogs of each other? What about HU or WIN varieties with regards to JWHs?

And if they are, though this is more of a law question, can the federal analog act be applied to state laws with regard to illegality? Or would it not apply until the federal government schedules one or more of the JWHs(or HU-210 or a WIN?)?
 
The Federal Analog Act is a federal law. It applies only to the DEA schedules of controlled substances, not your particular state such as Tennessee's controlled substances.

Federal law is prosecuted by the US Department of Justice in Federal Court, enforced by the FBI, DEA, etc.

Aminoalkylindoles like JWH-018 and WIN 55212-2 are not scheduled substances federally.
 
Gracias. Thats what I assumed....so if this bill passes I may have to start looking into other JWHs....like 200 or 250. I gotta be honest though...I've only recently acquired and tried jwh-018 and jwh-073, and I'm pretty damn fond of jwh-073. I'm really gonna miss it if I have to take it of my list.

But I've heard decent things about jwh-250...so who knows? On the other hand...I've been able to find out VERY little about jwh-200, so i'm at loss as to its real value. Same with WIN 55212-2.
 
Did you check the Tennessee code for an analog provision? Many states passed their own versions, borrowing heavily from the federal one.

CP 55940 and CP 47497 haven't been banned either.
