Drug dealer spared because of 'fear of prison'

A ROOKIE drug dealer has been spared a jail sentence because of his fear of imprisonment.

Kym Sidney Tyrone O'Hara last week faced a 25-year prison term for selling $700 worth of ecstasy and methylamphetamine to friends at Port Lincoln in 2003 and 2004.

But Judge Barry Beazley said the "hard working and highly motivated" 22-year-old's "fear of imprisonment" and his sporting abilities would lead him to reassess his life.

O'Hara was released on a two-year, $1000 good behaviour bond.

Judge Beazley ruled O'Hara's fear of prison would be an "effective deterrent" against future crimes. In sentencing, he said the Adelaide man had been arrested as part of a large-scale police investigation into drug dealing on the West Coast.

Telephone intercepts recorded O'Hara arranging to sell eight ecstasy tablets for $50 each, and six deals of methylamphetamine for $50 each.

"You had been in Port Lincoln for about six months (and) got involved in the local social scene, which involved rave parties," Judge Beazley said.

"You formed a friendship with (a drug dealer) and you were able to source such drugs from him.

"In consequence, your friends also would ask you to source such drugs and provide it to them."

He said O'Hara, a Sacred Heart graduate, had moved to Port Lincoln for work. "You are highly regarded both for your sporting ability and for your work in the construction industry." he said.

"You are a hardworking, highly motivated individual who, through perhaps immaturity and the first occasion being away from your family, got involved in a group who used the drugs regularly in rave parties.

"I have no doubt the seriousness of the offences to which you have pleaded guilty has shocked you into positively reassessing your life." Judge Beazley suspended O'Hara's two-year, three-month jail term with a 12-month non-parole period. "Your future is in your own hands, you realise that?" he told O'Hara as he left court.

He should be imprisoned for selling that shit $50 each. I mean wtf.
 
So what is this methylamphetamine? If it's meth, that's the first I've heard of it referenced as such.

I haven't heard of it myself either - I've heard of methylphenidate, but not methylamphetamine.

Nope. $50 is a rip off (some mate) In South Australia $30 each and obviously lower the more you get. The part that worried me was that he "faced a 25-year prison term for selling $700 worth of ecstasy and methylamphetamine"
Can anyway confirm if this is possible???? 25 years for such a small amount?

ummm judges do shit like that all the time... deferred sentencing; diversion, prop 36 (i think thats a CA thing) drug classes, etc, etc, etc.
not everybody goes to jail

Think the guy spilt everything to the cops? ou guys pay amazing prices. In the UK, a pill is about $4-5 (US). Guess we are close to The Netherlands.
 
Wow a judge with some sanity, interesting. It'd be nice to have a few more in the US that are interested in the results of their judgments instead of merely tossing more people into our immense prison population.

$50 (Aus) is $38.5650 (US). I didn't realize it was still so bad after the exchange rate was factored in.

As far as methylamphetamine, meth is short for methyl as in -CH3. A simple example is methyl alcohol (methanol); CH3OH. Whenever you see meth or methyl just think an alkyl group with a single carbon atom. What throws me off is why some Brits pronounce meth with a long E as in "me".
 
they probably meant 25 months.. at the end it says his 2year sentence was suspended.. 25 years dont sound right.. i got caught with a couple bundles of heroin and only did a little jail time and then was released with 1 year probation.. depends highly on the judge and DA

Yea but that actually had this guy recorded talking about his sales, not to mention he had multiple counts of the possession with intent to sell, and they are all felonies since they're Class A (or whatever it is in Australia) drugs.

They're only really that expensive if you only buy a few. I wouldn't want to paying more than £1 ($2) each if I was buying in any kind of quantity.
 
This is Australia. Judges don't like sending people to jail because it fucks up lives. Its a very last resort thing here (which is funny as the whites that were originally here were all convicts from england), when the offender keeps re-commiting crimes and has broken bonds, suspended sentences and failed to do community service many times. Or ofcourse for serious assault/battery, rape, child sex offences and murder, or big time drug dealers/traffickers/producers.

$25 is standard single price for pills in aus btw. $1us=$1.29AU. but the pills are a lot stronger and cleaner than american pills 95% of the time.
