Did my dr. break privacy ? (USA)

I went to urgent care the day after ingesting a 60mg oxy OP (not prescribed to me). I couldn't hold food down and this was making everything worse, so i went in with my mom and got an IV and felt much better. I'm 22 btw..

Anyhow this whole time i told my mom i was hungover. I told the doc what was really going on once alone. Later, he went back and told my mom exactly what i had. Of course this caused friction in the family.

Did he break privacy agreement? Can i do anything about this?

I know Dr. questions are touchy here on BL, i figured this was different. Thanks y'all.

If you didn't tell the doctor not to say anything then he prolly Thought that it was ok to tell her. Especially if she
Was in the room when you talked to the nurses and stuff.

Although in my opinion he should have asked you if he could share your information with her.
 
i was gonna say if your under 18 then no cause your not an adult, but at 22 i would say he did violate your privcy but i agree with welderman above..he prolly figured with your mom there she was gonna find out by you anyways cause yu brought her, and she just asked the doc what was up

its not like she went back 2 hours later after she dropped you off and went and went and asked him

I would say he did break your privacy and he probably went with his mom because she could drive and he felt to ill too.
 
when you go to urgent care you fill out paper asking about your privacy rights..on one of them it asks if any info can be shared with family members(i just went the other day and remember that part of the form) theres a chance you or your mom checked the box that says it can be shared with family members.
 
I have been in similar situations several times and there really isn't a damn thing you can do about it. Are you going to get a good enough lawyer to be able to beat a doctor's lawyer? No.
 
Thanks for your advice wiggi. I thought this may be an open and shut koind of case. Honestly i would take this doc to court cause he totally put me back where i was 2 years ago with my family. I figured he could say i was doing 'self harm' and it also doesn't look good in court when you obtained oxy w/o a script. So, fuck it, i needed to clean up my act a bit anyways i was slipping
 
He definitely violated his HIPAA agreement as a physician. If you're over 18, it doesn't matter who you show up with to the hospital. What you tell the doctor is in confidence, and the only way he can tell your parents/anyone else is if he gets permission from you exclusively. I'd mention it to the doctor and say that you don't appreciate how he didn't honor the patient-doctor confidentiality
 
If you didnt specifically sign a piece of paper saying they could tell your mom then he violated the HIPPA act which is a big deal.
 
Have you listed your mother as an emergency contact or a person with whom medical information regarding you could be shared? You may have filled out this form designating your mother as the contact well before your most recent visit. If you have, then the physician did no wrong. More than likely, however, your physician assumed that because you came together and that you are not a minor that your parent was aware of the reason for your visit. To pursue this legally, you would have to demonstrate that the breach in confidentiality allowed you to suffer damages that are measurable.
 
I think the lesson learned here is not to bring someone with you whom you don't want to know about your drug use. What the doctor did was wrong but you won't win this. This question has been answered and we really shouldn't be getting into your legal options if youchoose to go that route. My advice would be to just let it go. It sounds like your mom cares and she will get over it. If you have any questions or for some reason want this open then please pm a mod. Closed
